AN ACT DECLARING CURON TO BE DISSOLVED, 1661

BE IT DECLARED and enacted by this present Government:—

I. That the Principality of Curon, its corresponding titles, and all its worldly possessions thereunto belonging, shall be hereby constituted, disestablished, and made to be dissolved, and shall from henceforth be destroyed, by virtue of the supreme authority of the Lord Protector and the Representatives of the People in the Municipality of Cyrilsburg.

BE IT DECLARED and enacted by this present Government:—

I. That the legislative authority of the Principality of Curon, its possessions thereunto belonging, shall reside in one person; the stylage of which person shall be the Lord Protector of the Principality of Curon - him being Alexandre Ashford d’Aryn - which will replace the now defunct role of Regent.

II. The exercise of the chief magistracy and the administration of the government over the Principality, and the people thereof, shall be in the Lord Protector.

III. All writs, processes, commissions, patents, grants, and other things in Curon, shall run in the name and style of the Lord Protector, from whom, shall be derived all magistracy and honours in this nation; and have the power of pardons and forfeitures for the public use; and shall govern the nation in all things.

IV. The Lord Protector shall direct in all things concerning the military and the correspondence of relations.

1. Henceforth, the individual by the name of Emelie Fredericka Devereux is unilaterally disowned from the Royal House of Devereux.
2. She will, due to her crimes against Her Serene Highness, no longer inherit, receive grants, gifts, or protection from the Royal Household.
3. The act of eloping serves as an indictment against her dishonourable character against her own kin, and thus she is excluded from the royal court ad infinitum.

Elections by their very nature are messy processes, and are often administered in a ramshackle way, with rules and procedures changing at whim. No longer shall this be the case in Curon, and frankly never has it been. The Chancellor and his designees have overseen elections in a unified manner since the inception of the tradition in Curonian lands. This document serves to catalogue and standardize such procedure, ensuring that through future transitions of power, elections shall be justly and fairly administrated in the same manner. Furthermore a number of reforms, so as to promote transparency and avoid future problems.

COMMISSION

I. There shall be established an Electoral Commission, which will convene to discuss the workings of the electoral system within the nation's borders.
II. There shall be appointed a Commissioner, who will be responsible for the enactment and execution of this here Act, and the maintenance of an Electoral Commission, in which they shall be the chair.

III. The Commissioner shall hold office at the pleasure and discretion of the Chancellor.

IV. There shall be officers who hold membership in the Commission to represent the interests of the people, and who shall be subject to the directions of the Commissioner. 

V. Members of the Commission shall be appointed exclusively by the sovereign, or by virtue of past service as Mayor of Cyrilsburg, or Mayor of a vassal state's city.

NOMINATION

I. All candidates wishing to be duly elected to their respective offices must submit a public writ. 

II. Furthermore, three citizens must support their nomination and publicly declare such.

II. The current qualifications for running in an election shall be as follows.

a. Candidates must be of the majority, at least sixteen years old.

b. A property within our nation must be proved to be theirs.

c. Under Curonian law, they must be a legal citizen.

III. The current grounds for disqualification are listed below.

a. The candidate is a subject, vassal, or owes other obligation to a foreign entity.

b. A conviction of treason, or other such severe indictments.

IV. Candidates must find a second candidate to team up with, declaring one junior and one senior.

a. If elected, they will be Mayor and Deputy Mayor. 

b. One may declare candidacy without a partner and later find one.

c. A team is locked in once polling begins and cannot be changed.

d. If one wins the election and their junior partner drops out, they may select a new junior partner.

e. If a senior partner drops out, they surrender their campaign to their junior partner, who may select a new partner.

ELECTION

I. The government shall declare publicly that the candidacy period has begun, allowing candidates to be nominated as per the above procedure.
II. After a set time, mayoral debates shall be scheduled. Candidates will convene to discuss important issues in a public forum, with summaries published soon thereafter.
III. Polling shall begin soon after debates, wherein legal voters may submit their ballots, and the election shall begin in earnest.

IV. After the completion of the voting period, the Electoral Commission shall convene to count and tally votes. Legal votes shall be counted if meeting below prerequisites.

a. The voter owns property in Cyrilsburg or a vassal city of our nation.

b. The voter gives military service to our nation or a vassal.

c. The voter is an established member of a local family and, while not holding property, lives in our nation.

d. The voter is confirmed personally by citizens.

1. A list of unconfirmed voters will be released publicly for our people to review. 

2. Citizens are encouraged to inform electoral staff if the individual is foreign or not.

3. After public review, those who have not been confirmed legal votes shall be nullified.

V. A mayoral inauguration shall occur, wherein all candidates are to attend. The winner of the election will not be announced until the ceremony takes place.

VI. The first Saint's Day of the new Mayor's reign is the only point where new information may remove them from office without a trial, by way of one of the following.

a. If they are proved incapable or disqualified by this act's terms, they shall be removed in favor of the next highest voted candidate.

b. If citizens or other means verify votes and shift the major victory to another within this first day, the Mayor shall become that newly verified winner.

c. If the Mayor fails to swear an oath to the sovereign, they will be removed from office, and possibly charged.

PROHIBITION

I. In order to ensure the just and fair rule of any elected officers, the following is disallowed in regards to candidates.

a. Conspiracy, where a group of people conspire to change the outcome – for example, by planning to drop out of the election at a certain date to change its outcome, or other such plots.

Neglect is regarded as the refusal to discharge a given official duty by an officer.

b. Neglect, in which the official fails to fulfill the duties they are assigned.

II. Voters too must be held to high standards, and so the following is prohibited on their behalf. These prohibitions obviously apply to candidates also.

a. Bribery, wherein a third party pays the official to sway their opinion, or otherwise exchanges value to do so.

1. Exchange of property, money, services, items, promises, gifts, or anything else of value is not illegal.

2. Yet where that exchange involves two parties who may conspire change or activity, then that constitutes bribery. 

b. They who threaten, offer, or suggest violence, injury, or damage to a candidate in an attempt to voice withdrawal of candidacy, or any support of such, or they who cause, inflict, or cajole any violence, injury, or damage to a candidate for withdrawal, omission, support or opposition shall be guilty of conspiracy to influence an election.

c. Voting more than once at the same election will result in a penalty not exceeding one hundred, or imprisonment for no more than four saint's days.

d. Willfully promulgating a false statement in a statement, application, return, or declaration to the public or Commission in an attempt to defame or hinder the election of an individual is libel and punishable by a 800 mina fine.

Any legitimate issue of the patriarch may lay claim to his lands, according to the succession laws he publishes, or any existent will and testament he writes. Such a will must be copied and delivered to the crown. We do publish these letters in recognition of the rights – and the obligations – that the aforementioned patriarch shall be afforded.

I. He shall be addressed to and styled as His Serenity in official discourse, and in reference to his title, the record shall dub him the Marquis of Caedirn.

II. From the ranks of his people, he may maintain a levy, which is privileged to enforce Curonian law in his lands.

III. To fund his endeavors, the lord may tax property and income within his borders.

OBLIGATIO

I. The patriarch must be a paragon of virtue and justice. He must exemplify mercy and charity, helping to always better his people. Failure to do so is punishable by death.

II. In times of war, the levy must be raised and come to the defense of Curon. It is the duty of His Serenity to promote the national security and welfare of our nation.

III. To promote the canon of God, at least one man must take the cloth from Caedirn, serving the clergy on assignment to the March. One deacon is requisite.

IV. A feudal tax, to be negotiated privately between the crown and the Marquis, shall be enacted upon His Serenity to provide funding for the national government.

We do thus issue these letters to dub Giffourd of House Delaney, as patriarch of his esteemed family and leal servant of our nation, to be the first Marquis of Caedirn. May God grant him and his people peace and prosperity. Let the ink of this edict flow to the corners of Atlas, and let it stand as testament to our dedication to our people. A convention has been held in Cyrilsburg, in the first year of the reign of our most gracious sovereign Her Serene Highness the Sovereign Princess Linette Eliza. Accordingly, a declaration has been prepared to secure the succession of the crown in our most glorious nation. So as to avoid petty feuds and civil wars, all other claims to the throne are legally nullified; so long as the first in line to the throne lives, they alone may inherit, lest the sovereign doth declare otherwise.

PREAMBLE

I. We recognize the need and importance of a natural order of succession, and the smooth transition of power, in the prospective future, of the crown.

II. Whereas it is understood the ordeals pertaining to the succession of the crown, and the troubles which may culminate from such.

III. Insofar as we are concerned, the establishment of these accession laws do seek to maintain the stability of Curon, and the natural order of life.

RULES of SUCCESSION

I. Succession is hereby defined as the consequence generated as a result of the natural death or the abdication of the lawful reigning sovereign.

II. Lawful heirs are granted in absolute terms all the titles, claims, properties, and funds granted by the deceased sovereign, under the obligation that they further inherit any unfulfilled debts or expenses of the succession.

III. The party succeeding must be in existence at the immediate time of succession, as there can be no delay in the passing of titles, property, wealth, or hereditary claims.
III. Persons legally incapable of succession are;

a. They who are not yet conceived.

a. Foreign traitors illegally claiming the throne.

III. Those excluded from succession are;

a. All those who are not conforming to the Canonist faith. If there are heirs who are unbelievers, then the succession shall skim onto the next of kin who are Canonist.

b. Any whom are natural born and not legitimized. 

1. A legitimized natural born child shall not take precedence over a true born child.

2. The reigning sovereign is the only person who may legitimize one born out of wedlock.

ORDER of SUCCESSION

I. The crown of Curon will henceforth adhere to the system of absolute primogeniture, with the firstborn legitimate child of the sovereign inheriting, and the law will consider neither the nature or origin of that which is being passed on.

II. Offspring and their own descendants will succeed their father, mother, grandmothers or grandfathers or any other relevant ancestors without distinction to sex and primogeniture.
III. If the deceased sovereign is left with neither posterity, nor brother, or sister, or descendants produced by them, the succession is granted to the closest living ancestor, and will follow through with their own descendants.
IV. In the case that there is no closest living ancestor available, the line shall trace through the closest deceased ancestor, with a distinction being made according to sex, and will follow through to their descendants.
V. In case of no suitable lineage, the sovereign may see fit to adopt a strong leader upon their deathbed, securing the succession. Curon will never face civil war; it is God's will that rather than fight with one another, we fight the heathenry and villainy of this world.

IV. A feudal tax, to be negotiated privately between the crown and the Baroness, shall be enacted upon Her Ladyship to provide funding for the national government.

We do thus issue these letters to dub Auralia of House Hartcold, as matriarch of her esteemed family and leal servant of our nation, to be the first Baroness of Adylith. It is our hope that this brings stability to Adylith, so that the lands' sons and daughters may live in peace and prosperity for all posterity. May God bless Her Ladyship the Baroness and Her Serene Highness the Sovereign Princess. It is our pleasure to publish this document, legally affirming the rights afforded to the Baroness, and which is contractually binding in terms of her obligation to the state. Per the display of insubordination, Thomas of the House Hartcold will hereby undergo a forced transfer of power to his wife, Lady Aurelia of the House Hartcold. The conditions are listed below:

• Thomas de Hartcold will be known as the Baron-Consort of the Barony of Adylith, however holding no power or authority as a Lord of the Principality of Curon. He is, under no means whatsoever, obliged to a Lordly title.
• All noble titles that were held by Thomas, will be transferred to Lady Auralia de Hartcold. She will no longer be known as the Baroness-Consort of Adylith, but the Baroness. She is hereby named the Matriach of the House Hartcold under the Principality of Curon.
• On top of this, the Hartcold man will receive five lashes within the public due to his insubordination charge.

This act is not up for discussion, and is effective immediately as this document is released to the public.
