Debts Act of 362 ES

Introduced in the Duma.

 

An act to criminalize the failure to pay debts.

INTRODUCTION

The purpose of this bill is to criminalize the failure to pay debts, both to the Crown and to other individuals. It also aims to create clarifications on the inheritance and processing of debts where an individual is no longer capable of paying them.

 

I. Necessary Definitions

-        Debt to the Individual: A sum of money which an individual owes another individual.

-        Debt to the Crown: A sum of money which an individual owes to the Crown.

 

II. Amendments

-        Adding Section 439: On Failure to Pay Debts to the Haurul Caezk, which shall state the following:

 

439: On Failure to Pay Debts

439.01: The crime of failing to pay debts to an individual, where this failure causes minor harm to the individual in question, shall constitute a minor offense;

439.02: The crime of failing to pay debts to an individual, where this failure causes major harm to the individual in question, shall constitute a middling offense;

439.03: The crime of failing to pay debts to the Crown, shall constitute a severe offense.

439.04: For a debt to be considered valid, a contractual agreement which proves the creation of the debt must exist.

 

-        Adding Section 704.05: Inheritance of Debts to the Haurul Caezk, which shall state the following:

 

704.05: Inheritance of Debts

704.051: Upon the death of an individual, their debts are assigned to their heir with the rest of the inheritance in accordance with Sections 704.01, 704.02, and 704.03.

704.052:  Upon the death of a Haeseni peer, their debts are assigned to their heir in accordance with section 704.04.
