To the Jovenaars and Office of the Jusiticar ,

 

I write to you regarding the recent Summons of Baruch et al. z. Surgeon General and urge this claim to be dismissed outright out of both respect for sound legal practice and dignity of the Hospital of Saint Amayas.

 

On Cremation: The Hospital operates the same policy for body collections in all cases. They are preserved for several months after initial autopsy, after which it is the obligation of the respective family to collect the body. It is not the Hospital’s policy, nor has it ever been, to have to remind families to collect bodies. Even if this were the case, the Hospital is currently overwhelmed with injured soldiers from the ongoing Troll War. The families were at all times after the autopsy free to come and collect the bodies. That they waited over a year led to the decay of the corpses, and as such the Hospital had no choice but to cremate them. Between the receipt of the bodies and this Summons - a period of several years - no reasonable effort was made to reclaim the bodies. This is in no way dishonesty or dishonour -- it is Hospital practice when a body is not reclaimed for over several months. 

 

On Harm: It’s quite clear that the Hospital did not cause reputational, economic, or physical harm on the parties. It is, again, the obligation of the families to collect the bodies. They failed to do so for over a year. The bodies were in a state of utter decay -- to leave them any longer would be a great dishonour to their memory. In the absence of any effort by the family to collect the body, the Hospital followed normal policy and cremated the bodies. Given the timeframe, this cannot really be said to be any kind of reputational harm.

 

On Vandalism: The allegations of middling vandalism here border on slander. If indeed such charges occurred, the Office of the Jusiticar is welcome to pursue prosecution. Private citizens have no business alleging unproven criminal offenses, especially in light of the timeframe discussed above, and they most certainly have no business trying to extort money for it.

 

To finish, Jovenaar, please dismiss this frivolous case for the reasons listed above. The Hospital is currently inundated with patients from the Troll War, especially after the recent raid on the Duchy of Reinmar,  and it would be a serious and irreparable blow to morale to allow the Hospital to be sued for such unjustified reasons. Please uphold the dignity of our law, and our Hospital, and deny this Summons.

A response is penned to the Surgeon-General, bearing the symbol of the Aulic Court:

 

"To the Surgeon-General,

It is the unanimous decision of the Jovenaar assigned to the trial of Baruch, et al. z Surgeon-General, that, despite the pleas of the Surgeon-General, there is no reason for us to not allow this summons to go to trial. If all things are as the Surgeon-General claims, we do presume that the Surgeon-General would be able to prove such in front of the court. Additionally, there is no precedent, neither set by the Aulic Court, nor by the Haurul Caezk, that the Aulic Court is able to dismiss a trial.
