Article I

Structure

 

Overview: The Government shall be made of a Senate, Chamber, and Crown appointed officials. The Chamber shall form the Government of Balian and be vested with the executive authority of the state.


SECTION I

The Crown

 

Defining the Crown: The Crown is the house that governs over the lands of Balian, referred to as the Crown of Balian, and its constituent jurisdictions are the functioning leading government of the State of Balian. The Crown of Balian is led by the Monarch of Balian, who is advised by the council referred to as the Chamber, under the authority of the Seneschal.

  • The Crown is the highest authority in Balian.
  • The Crown appoints a Seneschal to form a Chamber.
  • The Crown solely holds authority in matters of Succession, Granting titles, and Knighthood.
  • The Crown must sign any legislation passed by the Senate to make it law.
  • It must be signed within one year after being passed.
  • If the legislation isn’t signed by the Crown it is returned to the Senate.
  • The Crown holds the right to veto any legislation passed by the Senate


SECTION II

The Chamber

 

Defining The Chamber: The Chamber is the council of advisors and offices which are appointed by the Seneschal. They act as an extension of the executive authority of the Crown. The Chamber shall adopt the house name of the Seneschal with the nominative “Chamber” as the name of Government, i.e “The Vuiller Chamber.”

Structure of the Chamber: The Chamber shall be made up of offices each tasked with its branch of government;

1. The Seneschal

The head of the Chamber, chief minister of the Crown.

2. The Censor

Charged with the administration of public works, decrees, and censuses.

3. The Magister

Responsible for the control of the Crown’s justice. 

4. The Constable

 Chief military advisor.

5. The Legate

Chief diplomat of the Crown.

6. The Procurator

Manages the finances of the Crown.

 

SECTION III

The Senate

 

Defining The Senate: The Senate shall retain the bulk of the law-making authority of Balian. Those powers not explicitly withheld to the Senate are presumed to be granted.

 

  Structure of the Senate: The Senate shall not exceed seven seats. The number of seats allocated to Nobility and Commoner is determined before elections, though no faction can be allocated less than one seat.  The Senate shall be represented by the two estates of Balian society. Henceforth called ‘Factions’, there shall be two such factions that make up the Senate. The Senate regular session is 8 years.

 

Nobility: The ennobled elite of society who shall strive to pursue the protection of noble lineage and rights, ensuring those who have been raised to lead and govern maintain a powerful say in our society.


Commoner: The faction of the people and common man, citizens of the Balian who strive to ensure the rights of the freemen who are most often affected.


    Eligibility:

  • Must be a Citizen.
  • Must receive a plurality of votes to fill the number of available seats allocated to your faction.
  • May not be an enemy of the State, traitor, or have pending criminal charges.
  • Must declare for one of the two factions.
  • Nobility: Must be a member of the Nobility of Balian.
  • Commoner: Must be a Citizen-Resident of Balian.

 

    Explicit Rights, Responsibilities & Restrictions:

  1. The first business of any Senate session is to vote from all eligible Senators to appoint the Minister of the Senate

  2. May summon any government official and any other individual of Balian, save the Crown, before the Senate.

  3. May not issue punishment and fines against Citizens of Balian; this authority is reserved outside the Senate. Senators may, however, bring charges against Citizens and may choose among them someone to represent the Senate in a court of law.

  4. Are entitled to the honorific of the Senate, i.e “The Right Honorable Senator” while they are serving. 

  5. Shall serve until dismissed by the Crown.

  6. May change or alter decrees of the Crown that are administrative to keep them in compliance with current laws.

  7. May make recommended changes to old decrees for submission to the Balian Crown when those changes are significant.

  8. Confirm Judges nominated by the Magister with a majority vote.

  9. Will introduce and vote on legislation in the Senate.

    1. Most Legislation is passed by a simple majority. Laws will go into effect once they are signed by the Crown.

    2. Exceptions to Majority Vote are as follows:

      1. Impeachment of Official (80%)

      2. Standing Orders of the Senate (70%)

    3. Legislation that is restricted by the Senate.

      1. Any matter related to the Household of the Crown and their authority.

      2. Edicts, Decrees, and Ordinances of the Crown may be voted on to change and alter significantly their nature but must be submitted to the Crown for assent.

  10. The Crown reserves the right to veto any Legislation passed by the Senate.

 

Elections: Elections shall follow a simple procedure. The Senate shall meet its eight-year requirement and be dismissed. In the 6th year, the sitting Seneschal shall begin preparations to conduct a new election with the Censor. The Censor shall certify the Senate's dismissal, and start the elections in the 7th year. Citizens shall prove their eligibility, declare their faction, and be subject to a vote in the 8th year. Upon the vote's conclusion, the election's victors are summoned to the Senate, which begins another 8-year cycle. The first business of every Senate session shall be to vote on a Minister to oversee the Senate.

Offices

 

SECTION I

The Seneschal

 

Overview: The Seneschal is the chief minister of Balian appointed by the Crown and is responsible for the proper maintenance and governance of the realm. He wields penultimate authority and is charged with preserving the coronet by all means possible, including in matters of succession.

    Explicit Rights, Responsibilities & Restrictions.

  1. The Seneschal shall form a government with the Crown.

    1. They may create, dissolve, or continue any offices and those that hold them as they see fit.

    2. All head Offices of Government and specific offices shall be selected by the Seneschal and approved by the Crown. This includes;

      1. The Constable

      2. The Magister

      3. The Legate 

      4. The Procurator

      5. The Censor 

  2. May summon any member of the Government to stand trial.

  3. Will lead the Chamber in advising the Balian Crown.

  4. May establish temporary and ad-hoc offices and officers for the execution of their duties for the duration of their assignment, to be dismissed after their appointment or election unless made permanent by law.

  5. Are entitled to a guard & escort of no more than two Balian Soldiers.

  6. May validate or revoke eligibility for a Citizen to serve in a faction.

  7. Serve as Regent of Balian should the Monarch be incapable.

  8. May veto legislation from the Senate, unless it is approved by the Crown.

  9. Must deliver the opening Senate remarks for each summons, delivering the prerogative and will of the Crown for the Senate.

  10. Will organize one social event for the Senate each summons.

  11. Prepares all documentation required for the Crown to Summon the Senate, and works directly with the Censor to administer the election.

 

SECTION II

The Censor

 

Overview: charged with the construction of public works, the administration of censuses, and the drafting of decrees. They are simultaneously responsible for all public documents, including the issue and sealing of letters, written acts, and edicts. They are also charged with overseeing and holding elections for the Senate.

 

  Explicit Rights, Responsibilities & Restrictions.

  • Shall fairly and impartially administer elections on behalf of the Crown to the position of Senator.
  • Shall determine the eligibility of all able residents through the use of the Census as either freemen or Citizens.
  • Shall validate Senatorial elections.
  • Has no law-making authority.
  • May create ad-hoc institutions and hire as necessary to execute the duties of this office.
  • Handle public work.
  • Is responsible for all public documents.

 

SECTION III

The Constable

 

Overview:  The Constable acts as the commander of all soldiery of  Balian. A chief military advisor and commander who is sworn to protect the realm from incursions and insurrections in both times of war and peace.

 

  Explicit Rights, Responsibilities & Restrictions.

  • Has authority to change the internal training and organization of the Balian military, which shall be the discretion of its senior permanent officer. This includes promotions and demotions.
  • Shall be given funds from the Crown, as allocated by the Procurator.
  • May court martial officers of the military. Enlisted Soldiers shall be disciplined by the Balian officer corps.
  • May award military awards, decorations, and military honorifics on behalf of the Government.
  • May not be trialed for crimes while actively serving as Constable; they first need to be dismissed before they can be trialed.
  • May seize private property for military use for no more than one year, unless approved by the Senate.

 

SECTION IV

The Magister

 

Overview: The Magister is responsible for the control of the Crown’s justice. They are to deliberate and administer cases within the borders of Balian. Tasked with leading the Magisterium, they nominate Judges and interpret the laws of Balian.


 

  Explicit Rights, Responsibilities & Restrictions.

  1. Shall organize their office as they see fit, and may determine the style and method in which they choose to prosecute individuals before a court of law. At a minimum;

    1. The Crown must appoint a defense when the Government is the defendant to determine punishment.

    2. Judges may hear disputes of the law wherever they feel best to administer justice, and are encouraged to help justice expeditiously to prevent unnecessary delay.

    3. Failing to hear a case within two years, without the written appeal of the Magister, shall result in immediate dismissal of a case.

  2. The Magister shall hear all disputes of the law, and is responsible and empowered to prosecute individuals and enforce the punishment decided by judges. 

    1. The guilt of Government officials is determined by the Senate by the impeachment procedure. 

    2. Matters of Treason and crimes of a serious nature shall require the presence of the Magister to ensure punishment is meted out swiftly and in a proper manner.

  3. Nominate Judges to be confirmed by the Senate.

  4. Interpret the laws of Balian.

 

SECTION V

The Legate

 

Overview: The Legate is the chief diplomat of Balian. They are charged with fostering goodwill and relations among fellow nations alongside the foreign negotiation of treaties.

 

  Explicit Rights, Responsibilities & Restrictions.

  • Shall appoint diplomats.
  • Present themself with decorum when meeting with foreign powers.
  • Review and draft treaties.
  • Keep track of all current treaties, and agreements with foreign powers.

 

SECTION VI

The Procurator

 

Overview: The Procurator manages the finances of Balian. They must see the coffers filled, taxes collected, and issue payment for the realm’s debts.


 

Explicit Rights, Responsibilities & Restrictions.

  • Collect taxes each year.
  • Set the tax code for Balian with the approval of the Crown.
  • Establish a yearly budget for Balian.
  • Keep track of all expenses of the government.
  • Protect against the misuse of government funds.

 

SECTION VII

The Minister

 

Overview: The Minister acts as the leader of the Senate. Elected among their peers in the Senate the Minister shall be tasked with holding each meeting and setting the agenda, serving as the voice of the people within the Chambers.



 

Explicit Rights, Responsibilities & Restrictions.

  • Preside over the Senate, acting as its Chair, moderating the debate, and conducting the meetings of the Senate fairly and impartially.
  • Set the agenda for each Senate meeting.
  • Coordinate with each Senator to arrange a meeting.
  • Oversee the meetings.
  • Ensure terms of conduct and decorum are upheld in each meeting.
  • Uphold the standards of the office

Repealing provision
 

The Charter of the City of Atrus (9, B.A.) and any other legislation that opposes this Edict are hereby repealed.
