Edict of Inquisition

Due to the Edict of Inquisition, the Solicitors and judges have been replaced with the Imperial Inquisitors.

The Rights of an Imperial Inquisitor

1) An Imperial Inquisitor may conduct a trial on sight for those charged with a crime under the Imperial Code.

2) An Imperial Inquisitor may hand out judgement and punishment to those found guilty, but may be subject to review if execution is the punishment recommended by the Inquisitor.

3) An Imperial Inquisitor may call upon third parties to testify or give a statement regarding an investigation. An Inquisitor may also call upon an expert for their opinion in regards to a subject.

4) An Imperial Inquisitor may question both the accused, victim, or witnesses to complete their investigation.

The Duties of an Imperial Inquisitor

1) An Imperial Inquisitor is expected to conduct a fair investigation and gather any needed evidence.

2) An Imperial Inquisitor is expected to uphold the law and conduct fair and proper trials in a timely manner.

3) An Imperial Inquisitor may have an Investigator assigned under him, it is expected that the Inquisitor trains them to be promoted to an Inquisitor once deemed viable.

The Rights of an Accused

1) The accused has a right to a fair and unbiased trial. An Inquisitor that was directly involved with the events of the crime may not conduct a trial with the accused and must call upon another inquisitor.

2) If the accused is found guilty and sentenced to death, they reserve the right to appeal the choice with the Inquisitor General or his appointed deputy.

3) An accused has a right to plead their case to an Imperial Inquisitor prior to judgement and sentencing. Remaining silent and refusing to give testimony is also within their rights and they cannot be compelled to do so.

4) An accused has a right to fair sentencing. The punishment must equal the crime.

During the year 1856, a most violent and wretched attack against the Empire took place. After being lured into Sedan by Argus Romstun, the illustrious Duke of Cathalon, Helton Helvets, was violently murdered in the fallen, and previously standing, Sedanian capital.

II. THE CRIMES COMMITTED

202.04 - On Murder 

202.04B - Where an individual intentionally and with premeditation causes the death of another, this shall be murder in the first degree, a felony.  

204.01 - Treason and Sedition Act (1751): On Treason 

204.01A - Where an individual commits acts with the intent to compromise the integrity of the Crown and its constituent institutions by waging insurrection and seeking the destruction of the Imperial State by impugning the character and person of the Crown through subversive means such as collusion with enemy entities and actors against the State, this shall be the crime of treason. 

202.02 - On Battery 

202.02C - Where an individual intentionally commits upon another an act of unlawful violence which brings about permanent injury, this shall be battery of the first degree, a felony. 

III. THE TRIAL

By order of the Imperial Inquisition according to the authority of His Imperial Majesty, Argus Romstun was hereby ordered to appear before an Inquisition tribunal and stand trial for charges related to the conspiracy and carrying out of the plot to murder Duke Helton Helvets of Cathalon. After failing to show at the agreed time of trial, Argus Romstun has been found guilty on all charges.

IV. SENTENCE

Let it be known that the Imperial Crown and his offices within the Council of State do not look lightly upon the murder of one of his Peers. Neither do we look lightly upon the crime of murder against anyone who belongs to the Empire. Therefore we declare:

For his crimes against the Holy Orenian Empire, Argus Romstun shall be arrested on sight and brought before the Crown for punishment. If He is found to try and flee or have fled the borders of the Holy Orenian Empire, Argus Romstun is to be killed on sight by order of the Imperial Crown and Inquisitor-General.

The Holy Orenian Empire has always carried itself as an Empire of just punishment and fair trials. However, there comes a time when old ideals become bloated and ineffective in their patterns and effects. For too long, the Orenian justice system has been bogged down with the inability to conduct adequate trials for those citizens who have committed crimes against their fellow Orenians. 

This bureaucratic bloat that has blocked justice from ringing true must be expelled, and honorable rectitude provided the ability to flourish. Therefore this edict will serve as the building blocks for a new Orenian justice system through the following. 

• The Ministry of Justice is hereby disbanded. In its place, the Crown raises the Imperial Office of Inquisition. Henceforth, the Solicitor General shall be known as the Inquisitor General, who shall be placed at the head of the Imperial Office of Inquisition.

• The Inquisitor General may, at his behest, submit to the Crown individuals for the consideration of the position of Inquisitor within the Imperial Office of Inquisition. 

• The Inquisitor General may hire employees of the rank of Inspector for his office to assist himself and his Inquisitors in the capacity of their duties. 

• The Inquisitor General may promote one of his Inquisitors to serve as Deputy Inquisitor General for the means of assisting in the maintenance and day to day operations of the Imperial Office of Inquisition. 

• Inquisitors are granted the ability to conduct a trial on sight for those charged with a crime under the Orenian Revised Code. Inquisitors are entrusted by the Crown to carry out this duty with the utmost consideration for all evidence and testimony and are granted the responsibility of sentencing and punishment. 

• Inquisitors shall ensure their trials are conducted in an orderly, speedy, and public forum.

• Those sentenced to capital punishment reserve the right to appeal the sentence to the Inquisitor General.

• Peers of the Empire are not subject to the trials of the Inquisition and may only be judged upon solely by the Imperial Sovereigns.

The Baron of Arichsford is accused of attempting to murder Helton Helvets, the heir to the Duchy of Cathalon, in cold blood in the square of New Providence. Furthermore, after being asked to refrain from violence within the city, the Baron is accused of threatening the Vice Chancellor with death. Finally, the Baron is found to have caused ample disturbance of the peace, fomented sedition against Their Imperial Majesty’s government, and has abandoned his noble duties as prescribed by his oath and the Orenian Revised Code. Seeing such, any leal Orenian must detain this false noble and present him before the Imperial Crown. However, no subject may kill or make an attempt to slay the Baron under the direct order of the Chancellery.

204.03A - Where an individual intention to bring into hatred or contempt, or to incite disaffection against the person of His Majesty, his heirs or successors, or the government and constitution of the Holy Orenian Empire, as by law established, or the Imperial Diet, or the administration of justice, or to excite His Majesty's subjects to attempt otherwise than by lawful means, the alteration of any matter in Church or State by law established, or to incite any person to commit any crime in disturbance of the peace, or to raise discontent or disaffection amongst His Majesty's subjects, or to promote feelings of ill-will and hostility between different classes of such subjects, this shall be the crime of sedition, charged with the crime of treason.

202.01A - Where an individual intentionally makes an unlawful attempt, coupled with a present ability, to commit a violent injury on the person of another, this shall be assault, a misdemeanor. 

204.05 - On Obstruction 

204.05A - Where an individual interferes with, obstructs the progress of, or otherwise hinders government officials and prosecutors during the apprehension or investigation of a criminal or criminal activity, this shall be the crime of obstruction in the first degree, an infraction. 

207.04 - On Vigilantism 

207.04A - Where an individual intentionally apprehends, convicts, or punishes another individual of a crime but is not an agent of the law or given permission by the Imperial Office, this shall be the crime of vigilantism, a misdemeanor. 

207.05 - On Disturbing the Peace 

207.05A - Where an individual intentionally and deliberately hinders or interrupts the common peace by embellished performance or immoral behavior, this shall be the crime of disturbing the peace, an infraction. 

209.03 - On Attempt 

209.03A - Where an individual actively attempts, but fails to commit, a crime, the individual shall be held liable with a mitigated punishment according to the crime which was attempted. 

209.04 -  Inchoate Offenses Act (1788): On Punishment of Criminal Organizations & Entities

209.04A - Where an individual of a criminal organization, or entity, has been convicted of a minimum of two offenses within the following tables of the ORC; CH202, CH203, CH204, CH206, CH207 & 209 or treason. In which scenario any executive legal bodies of the Empire may enact the following law to further arrest, investigate and prosecute any individuals of the associated organization or entity, and is subject to the same class of punishment of the crime committed by the instigator.

I. FOREWORD

The courts and laws of which our Empire is built upon is what protects each and every Imperial citizen from the lawless chaos of this world. But one thing shall be clear, the courts and laws exist to serve the everyday man and woman of our Empire, to ensure that justice is timely and fair. A system to ensure our safety and that those who wish us harm do not go unpunished. To bring about peace and that the rightful justice is served. With these reforms we wish to ensure this. That our courts are just and can better execute their responsibilities.

II. SUPREME COURT

The Supreme Court is directly appointed by the Crown and serves as the highest judicial authority within the Empire and its respective vassals.

The Supreme Court is the highest instance in civil and criminal matters and thus the highest body of ordinary jurisdiction. It reviews decisions of circuit courts and the municipal courts.

The Supreme Court has a guiding and appellate function: its decisions are legally binding and incontestable for the parties and they point the way for all other legal cases. The Supreme Court thus contributes to the uniform application of the law and guarantees legal certainty.

The Supreme Court publishes all decisions in the federal legal information system via Judicial Letters (forum posts)

Furthermore, the Supreme Court may suggest the appointments of Circuit Judges to fill vacant judicial positions and is directly involved with their training and education in respect of the law. Once appointed by the Crown, these then become Judge-Aspirants. These Aspirants are under training and mentored by a member of the Circuit Court. The Circuit Court Justice then may allow the Aspirant to assist with presiding cases at hand. The Supreme Court then may hold trainings and interviews to determine if said Aspirants are ready and prepared to become a Judge of the Holy Orenian Empire and her Judicial System.

III. THE CIRCUIT COURT

The Circuit court stands as the backbone of the Imperial Judiciary. Within its duties to the Empire, lays the vast and important duty of presiding over both civil and criminal cases. Furthermore, Circuit Justices reserve the authority to allow warrants of search. 

They are appointed by the crown at hand of a suggestion made by either the Supreme Court or the Solicitor General, yet the Crown retains the right to appoint a justice by their own will and suggestion. When freshly appointed, a man or woman of this Court becomes a Judge-Aspirant and begins their training and mentorship under a fully fledged Justice of either the Circuit or Supreme Court. Their time as Aspirants is dependent upon their mentor and their progress in studies of the law. 

Once an Aspirant feels they are ready and prepared well enough for the position, their mentor-judge shall inform the Supreme Court of the current situation. Soon thereafter, a member of the Supreme Court shall then conduct an interview within said Aspirant before questioning them upon different legal situations and potential cases. 

IV. THE MUNICIPAL COURT

The Municipal Court is the local judicial authority within a municipality. They may judge cases and hold trials similar to those of the Circuit Court, but they may not stretch beyond the borders of their municipality. These Justices do not require overview or training, but simply the authority from the crown.

These Municipal Judges, also known as Magistrates, are directly appointed by His Imperial Majesty. Their duties do not end with those of a judge, for these members of the judiciary also administer free and fair municipal elections, the selection of a diet representative and the collection of taxes, excises or tariffs on behalf of the Treasury of the Holy Orenian Empire. Additional duties are defined within their respective charters that grant them vested judicial authority,

V. JUDICIAL PROCESS OF TRIALS AND APPEALS

Trials:

To ensure the efficiency of the criminal justice system in respect of trials, said trials must be held at a swifter date than previously. Before a trial is officiated, the presiding justice may decide if the case shall be decided by his own verdict, or by jury. If the presiding justice decides the case shall be handled by himself, the normal judicial process is in effect. There it will simply be a question of a judge, a potential lawyer for the defendant and a prosecutor. To provide a public overview, the verdict shall be posted publicly.

If a jury is presiding along with a justice, the normal judicial process is also in effect, though while the judge still presides and keeps the order, the jury has full power to decide punishment in accordance with the law. A jury must at least consist of 3 non biased imperial citizens and must not exceed the number of 5.

Regardless of jury or not, during a trial the following procedures must be followed; The Prosecution begins by opening the case before the judge. They present the charges and their evidence/witnesses. The defendant then presents their evidence/witnesses for the defence of the accused and makes their statement. The evidence is then overviewed by the presiding justice and the witnesses are called forwards. Each party of the trial (defence and prosecution) gets a limit of two questions per witness. After all witnesses are questioned and processed, the judge then makes the final decision to deliver the verdict. Then either the judge of the jury decides; Guilty, or not guilty.

Appeals:

Appeals are handled by the entirety of the supreme court and are voted upon after a thorough investigation and discussion between the justices. For an appeal to be granted, a simple majority is needed. If the appeal is granted, the verdict is then annulled and the case is once more present within the court and administered directly by a supreme court justice of the Chief Justice’s choice. If the simple majority is not achieved, the verdict stands as given and the appeal is dismissed.

After a verdict is given by a Judge upon a trial, an appeal must be requested within 1 OOC month. If such is not the case, no appeals can be accepted by the Supreme Court unless given approval by a simple majority of the members of the Supreme Court. 

If an appeal is presented to the Supreme Court within the aforementioned time period, yet it is not reviewed for the duration of said time period, the appeal holds its place until it is either dismissed or granted. Though if the appeal is presented within the time period, but it is neither reviewed nor granted within said time period, the Supreme Court’s activities shall be tested and inspected by the Solicitor General.

If the Solicitor General finds a, or multiple members of the Supreme Court lacking proper attendance in legal matters, the Solicitor General then may appeal to the Crown in order to remove said Justices from office.

VI. THE SOLICITOR-GENERAL

The Solicitor-General acts as the head of the Ministry of Justice and enacts the legal will and authority of the Crown. The Solicitor-General is also head of the Prosecution Services of the Ministry of Justice. It is their prerogative to ensure that criminals are prosecuted properly and that their punishments are enacted correctly.

This office also serves as a cabinet position for the Archchancellor and as an advisor on legal and judicial matters for the crown. He or she may also summon criminals to court and prosecute said criminals if sufficient evidence is provided. 

Furthermore, the Solicitor General directly ensures that all aspects of the Imperial legal system are operating efficiently. He or she reviews and suggests applicants for judicial offices from the municipal courts to the supreme courts and may appeal to the crown for their removal when he or she finds them lacking the necessary qualities of fulfilling their duties as justices.

The Imperial Crime Submission Registry is an imperial registry kept and managed by the Ministry of Justice that contains the submissions that Imperial Soldiers, Constabulary Agents, Municipal Sheriffs and Civilians of the Empire file using the same whenever they witness or hear about the commission of a criminal offense or another violation of the law.

While reporting the commission of a crime to an officer in the Ministry of Justice, Headquarters of the Imperial Constabulary, located within the Imperial City of Providence, is the most frequent channel that people use in order to report a crime, the Imperial Crime Submission Registry remains a very useful tool as it allows people to submit the commission of a criminal offense or a violation of the law post-haste, without necessarily being present in the Headquarters, or when no agents are available to write their submissions down at a certain time.

I - Preword

Welcome to “A Guide to Orenian Legal Roleplay”. This’ll be a reference post for anyone that wishes to participate in the legal roleplay which carries a major presence inside of Oren- this is an adventure into a complex and exciting niche of roleplay. 

With that said, it should be noted, legal roleplay is not easy. It’s often complicated with the requirement of multiple methods of argument, heavy aspects of writing and often heated conversations with your rivals! This guide will not give you everything that you need. It will not directly carry you through the entire methods of the legal roleplay; you’ll have to search for those things yourself. What will be provided within this guide is multiple simplified explanations and references to various posts (which you should definitely read yourself) to give you a kickstart as a legal roleplayer!

II - Introduction to Oren

The Holy Orenian Empire, seen from a legal standpoint, is a constitutional monarchy. This means that all political and legal power is provided to the people by the Crown through a select number of constitutional rights. The three main rights within the Empire are; the right to life, the right to liberty & the right to trial. These are good to know within the Courts- utilization of constitutional rights within legal arguments almost always proves efficient. 

You can part legal roleplay into three different branches; the legislative branch (i.e House of Commons), the executive branch (i.e The Ministry of Justice & Imperial State Army) & the judicial branch (i.e The Circuit Court & The Supreme Court). The legislative creates the laws of the Empire, the executive enforces the laws of the Empire & the judicial judges those charges with the laws of the Empire. This creates a fully adaptable and constantly changes legal system which encourages interaction between the various branches.   

You’re most likely to be involved with the executive branch & in interaction with the judicial. Therefore we’ll focus on those two aspects of the Orenian legal system. 

III - The Oren Revised Code

Let us start with the basics; the 77 pages long document known as the Oren Revised Code (I told you legal roleplay wasn’t simple!). Do not let the amount of pages within the Oren Revised Code discourage you, the document is fairly simple to navigate. 

The Oren Revised Code is often referred to by the acronym ‘ORC’, which I’ll be using from this point forward. The ORC contains all of the laws within the Empire and functions as your primary tool within legal roleplay.  Your legal arguments are almost always supposed to be based upon laws of the ORC, so getting familiar with it is important.

The ORC can be divided into six sections, despite there being eight within the actual code. These sections are the following; Lex Criminalis (Criminal Law), Lex Haraccene (Civil Law), Lex Kaedreni (Military Law), Lex Lotharingium (Procedure & Judiciary Law), Lex Aristocratia (Peerage Law) and Lex Arcania (Magick Law). You’ll want to familiarize yourself specifically with criminal, civil, military and procedure & judiciary law as these create the cornerstones of the legal roleplay within Oren.

IV - The Courts of Law, Simplified

The Courts of Law is the place where a majority of your arguments will be made. Oren has two Courts; The Circuit Courts and the Supreme Court. You’ll likely be dealing with the Circuit Courts more than the Supreme Court; but it is important to note the existence of both courts as certain aspects of legal procedure will involve the Supreme Court. 

The Circuit Court will have a judge. This’ll be the person that rules on your case and they’re demanded to take a textualist approach to the ORC. You’ll be presenting before the Courts as either a Defendant or a Plaintiff- to explain these two terms in the simplest method possible; the Defendant is the person that is being accused of a crime and the Plaintiff is the person accusing someone of a crime. 

A lot of communication to the Courts is done by text. Various people have various ways to format these- so we recommend you read a few yourself. Two of the most important documents within the Courts are subpoenas and summons. Subpoenas is a legal summon by a governmental body in relation to breachment of Lex Criminalis. Summons is a legal summon by anyone in relation to breachment of Lex Haraccene. You cannot file a subpoena if you’re not a part of the Ministry of Justice.

Legal Procedure is the backbone of legal roleplay within Oren. All legal roleplay must follow legal procedure to be correctly executed. Failure to follow legal procedure will often result in mistrials and appeals to the Supreme Court. You want to avoid that!

Simplified, legal procedure follows the following; 

    Submission of Subpoena / Summons

    Claiming of Judge

    Responding Affidavit

    Pre-trial hearings

    Court Trial

    Verdict

This is extremely simplified and carries a lot more aspects. These are one of the aspects suggested to read more closely into and fully understand before delving into Court as failure to follow this can mean life or death for your client.

VI - Difference between Civil and Criminal Law

The difference between civil and criminal law is extremely simple and doesn’t require much explanation. However, it’s important to know the difference between the two titles to avoid embarrassing confusions and misunderstandings. 

The main difference between civil and criminal law is who can execute it within Court. Criminal law can only be submitted through a subpoena which can only be submitted by the Ministry of Justice. Civil law can be submitted through a summons which can be submitted by anyone! Always double check that you’re not submitting a summons with criminal laws in it.

VII - Becoming a Lawyer

Becoming a lawyer will not be easy. I will not make that claim because legal roleplay is not easy in general. You’ll encounter many scenarios that become annoying OOCly and a lot of writing within the courts are OOC based. It takes a lot of time and a lot of dedication. 

With that said, start making a platform for yourself to establish yourself as a lawyer- the more good people have heard about you will result in more clients. Post forum posts to create awareness around your presence within the courts. Show people your success and knowledge within the courts. Grasp all knowledge you can get from those more experienced. Attend courts to hear the arguments made by other lawyers. 

A lot has to be taken into account. It is a learning process and continues to be. You can always learn from viewing others. On top of that; an excellent learning experience is provided within the Ministry of Justice as a Lawclerk. Legal clinics help newer people get a grasp of the methods used within the courts.

STRUCTURE of the OFFICE of IMPERIAL BAIL AND BOUNTIES

The Solicitor-General

The Solicitor-General is the direct leader of the Office of Imperial Bonds & Bounties. All bonds and bounties must be signed by the signature of the Solicitor-General to be valid. 

Private Bail Bondsman Company

The Private Bail Bondsman Companies are private entities with proper licensing of the Solicitor-General. The Private Bail Bondsman Companies are issued by warrant of the Solicitor-General to hold personnel which may move beyond Imperial borders to catch a person formally charged with a crime or convicted criminal whose punishment has not yet been determined or fully served; these individuals shall be marked as fugitives of the Empire. as well as distribute warrants of the Solicitor-General and collect rewards corresponding with the warrant. Bail Enforcement Agent

The Bail Enforcement Agents are private entities with proper licensing of the Solicitor-General. Bail Enforcement Agents are issued by warrant of the Solicitor-General to move beyond Imperial borders to catch a person formally charged with a crime or convicted criminal whose punishment has not yet been determined or fully served; these individuals shall be marked as fugitives of the Empire. Further information can be found beneath the ‘Licensed Bail Bondsman Act, 1776’.

CATEGORIZATION of IMPERIAL WARRANTS

Category A Fugitives

Category A Fugitives shall be considered armed, able, dangerous and possibly lethal. The Ministry of Justice advises that these individuals are approached and caught with utmost caution. The Ministry of Justice does not recommend any person without former military training to engage in Category A warrants. 

Category B Fugitives

Category B Fugitives shall be considered armed, able and possible threat. The Ministry of Justice advises that these individuals are approached and caught with utmost caution. The Ministry of Justice does not recommend anyone without any form of fighting experience to engage in Category B warrants. 

Category C Fugitives

Category C Fugitives shall be considered unarmed, unable and non-threat. The Ministry of Justice advises that these individuals be caught as effectively as possible. The Ministry of Justice deems all individuals above the age of eighteen able to partake within Category C warrants.

The Ministry of Justice advises all enforcement agents to be mindful of themselves upon partaking within any form of categorized bounties. The inability to follow and note the above categories shall rest solely on the agent or company.   

RULES & REGULATIONS 

I - Any agent or company is not above the legal authority provided by the ‘Licensed Bail Bondsman Act, 1776’.

II - Any owner and members of a Private Bail Bondsman Company must be individually licensed as a Bail Enforcement Agent too.  

III - Any warrant not issued by Solicitor-General shall be deemed invalid and may lead to charges of fraud & embezzlement.  

IV - Any fugitive, no matter category, may not be killed or mained throughout the capturing process. 

IV.I - In the scenario that any fugitive, no matter category, is killed or mained an official investigation of the Bail Enforcement Agent shall be issued by the Ministry of Justice. 

IV.II - In the scenario that any fugitive, no matter category, is killed or mained an official investigation of the Bail Enforcement Agent shall immediately have his license suspended until further notice.
