With the expansion of the population of Berzynstadt and the surrounding areas, The Comital House of Whitewood and the Fair Cabinet are now tasked with the duty to manage the settling of the Greater Silasian Basin and shoreline, as well as to develop sustainable primary and secondary industries.

The division of the land into provinces is for the purposes of more effective administration and as such servants of the Comital House may be appointed to develop the land in a managerial capacity.

THE GREATER SILASIAN BASIN

AND ITS PROVINCES

VE PROVINCIJA OV SILASIA

AND ITS BADGE

The urban province of Silasia encompasses the fortified city of Berzynstadt, the farms of Berzynstadt, the Berzyn meadfields and birch grove, as well as Port Blackwell. The majority of the population of the County of Silasia resides here.

The industries of this province are farming, brewing, lumber, smithing, fishing, trade and book-making.

VE PROVINCIJA OV SILMARKIA

AND ITS BADGE

Silmarkia comprises farmhouses with farming plots and flowerfield, the residents of Silmarkia are typically those of low-Silasian culture, or Silmarkian. Silmarkia is the eastern-most province that travelers from other imperial territories pass through to enter Silasia.

The industries of this province are farming, herb gathering, orchardry, flower farming and other associated industries.

VE PROVINCIJA OV AROVIK

AND ITS BADGE

Arovik is in the intermediary zone that connects the eastern provinces to the western provinces. It is bordered by mountains to the north and lake Tesion to the south. It is named in honour of the second Grand Duchess of Silasia, Arowyn I. Currently the province is underdeveloped though potential industries have been identified.

Industries that are set to be developed in this province are mining, farming, horticulture and aquaculture. Otherwise due its proximity it can be developed into another residential hub.

VE PROVINCIJA OV VALDOSIA

AND ITS BADGE

The second largest, Valdosia, is very open with sloped fields, this allows for independent grazers to herd their sheep on the hills though largely this region is highly underdeveloped. To expand the Silasian lumber industry and turn the Greater Silasian Basin more suitable for Silasians, forestation projects are planned here.

Potential industries in this province could be lumber, mining, grazing.

VE PROVINCIJA OV MOLIOVETSK

AND ITS BADGE

This minor region is categorised by large clay deposits found by the banks of Lake Tesion, resulting in many potters coming here to gather it and transport it back to Berzynstadt to be processed into ceramic goods. However, this transportation is inefficient and the region is to be developed further.

The single industry in Moliovetsk is clay-gathering.

VE PROVINCIJA OV KONIGRAVN

AND ITS BADGE

Konigravn, or King’s Flat in common, is a flat field bordered by hills and a cliff, making it one of the better places in Silasia for agriculture. As such currently it has been mandated that settlers in this province develop high value crops such as cotton and tobacco.

The industries in this region comprise entirely of agricultural production.

VE PROVINCIJA OV KLEMENKRAST

AND ITS BADGE

Clemen’s Corner, named after High Pontiff Clement III, ancestor to House Whitewood, lies divided between a grassy plain at the cliff base, and the eastern shore of Silasia. Klemenkrast lacks transportation infrastructure, making access and development challenging.

Crabbers and saltmakers primarily operate in this province.

VE PROVINCIJA OV BLAKPLOT

AND ITS BADGE

The largest province of Silasia, Blakplot suffers from the same issues as Klemenkrast. Yet its size and geographic position presents significant opportunities. With careful development, it could be transformed into another port or a hub for the naval operations of Silasia.

At present, Blakplot lacks established industries. However, it holds strong potential for growth in fisheries, maritime trade, and coastal defence infrastructure.

The effective governance of land and people is the duty of every lord no matter their station. However this cannot be achieved alone, for a strong and enduring society cannot be built by a single person, but it is achieved by the labour and counsel of many.

Thus, the Comital House of Whitewood offers employees wishing to use their skills for the betterment of their fellows’ community and environment.

POSITIONS

MASTER OF AGRICULTURE - The various farms and natural resources of Silasia need to be administered to ensure abundant supply for times of winter and famine. Responsibilities include tavernkeeping, fishery and port operation, organising the harvest season and stockpiling.

MASTER OF TOMES - The preservation of knowledge, historical, cultural and administrative is essential. Thus the archives of Silasia require to be kept in good condition for the sake of the people’s erudition. Responsibilities include maintaining the library, operation of printing presses, record keeping, etc.

MASTER OF ARMS - Safety of the people is of utmost priority, and the Druzhina, the armed brotherhood of Silasia is the tool by which that safety is guaranteed.

MASTER OF REVELS - It is the duty of the master of revel to ensure the growth of friendship and camaraderie amongst the people; achieved through festivity and delight. The master is responsible for feasts, dances, merrymaking and so on.

TO OTHER TRADES

All able-bodied and sound-minded labourers are welcome to ply their trade, from farmers to powers,  smiths and artisans, to scholars and bards are welcomed. Fair arrangements will be made to all to ensure the prosperity of one’s trade.

I. The Right Honourable, Count of Silasia Arturas Miklos Whitewood, hereafter named the Grantor;

And

II. The enterprise, known as Silasia Siegeworks, represented in person by its heads, Miss Lilibet Amador and Mister Ulric, hereafter named the Lessee.

Both parties, of sound mind and with witnesses present, agree to the following articles.

ARTICLE I - LAND

I.A

The Grantor does hereby lease unto the Lessee a parcel of ground, situated east of the inclined path to Berzynstadt, south of the sheep farms on the sand.

I.B

The lessee shall develop the land into a port in conjunction and with oversight from the grantor.

I.C

A portion of the port and the natural land next to it will be granted to the lessee for their necessary operations, such as but not limited to: engineering, boatmaking, alchemy, herbology, etc. With necessary outbuildings also to the lessee’s trade.

Alongside this construction, a pathway will be made to the Silasian coast that is to remain unimpeded.

I.E

The construction of additional facilities will require approval from the Count.

I.F

While leased, members of the enterprise shall be given the rights and dignities of Silasian citizens.

ARTICLE II - TAX

II.A

In exchange for said land, the Lessee shall yearly pay unto the Grantor a 40 Mina tax.

II.B

The Lessee will also supply the siege equipment or other engineering projects to the Grantor’s Household when reasonably demanded.

ARTICLE III - SUCCESSION 

III.A

The Lessee may pass this lease to a successor only within their enterprise, with the Grantor’s written assent.

III.B

The Grantor’s heirs shall honor this covenant for its full term.

III.C

The Lease shall last for a duration of 20 years.

III.D

The Lease may be terminated upon the failure of meeting the articles and terms established.

The Grantor does hereby lease unto the Lessee a parcel of ground, situated between the inclined path to Berzynstadt, the sheep farms and cliff behind it.

I.B

Said land shall be used solely for the construction and operation of a brewery and the day to day operations of the Kingsley Company, with outbuildings necessary for brewing, drying, storing, and distributing ale, beer, and allied spirits.

I.C
Alongside this construction, a pathway will be made to the Silasian coast that is to remain unimpeded.

I.D

The construction of additional facilities will require approval from the Count.

I.E

While leased, members of the Kingsley company shall be given the rights and dignities of Silasian citizens.

You are my teacher and I am your acolyte.

Teach me your word of truth, and I shall spread it. Guard me against the false phrase of the saulician sycophant.

Your word is the warmth of a bonfire on a chilling night, that protects the soul from the gnawing cold of falsehood. The light that shines the path to salvation.

 

MAIN

For over 50 years the people of Silasia have withstood great turmoil, from Undead to Infernal, from plague to grief. We Rose above it all.

However it is in recent times, it has been revealed the most wrathful machinations emerge not from the hearts of the openly wicked, but from those who clad themselves in false robes.

Let it be known, that the material realm is but fleeting, a stage of existence in which we prove our righteousness to enter the eternal existence within the 7 skies. Attachments to all things temporal prevent us from realising this. Today's tragedies shall become nothing more than markers in time, but only if we avoid being bound by the weight of said tragedy.

As such, it is with great difficulty that I announce the following:

The Grand Duchy of Silasia is hereby formally dissolved as a state, its lands are forfeit.

The nobility of Silasia is relieved of its titles and obligations.

All contracts of land leasing and diplomatic agreements are annulled.

The Most Argent Order of the Titan is disbanded.

The people of Silasia shall be scattered across the realm.

The culture of Silasia shall be held within the hands of the remaining founders of it, to be safeguarded and passed down.

So, from henceforth the blood of Silasian people shall not be spilt by marching orcs, elves, adunians, etc.

There will be Silence in Silasia.

DUTY AS PROTECTOR

For the past 3 generations of Grand Dukes, the house of Whitewood always prided itself on loyalty and fulfilling obligations. One of these was the protection of the weefolk, as per the title Protector of the Weefolk.

It is our honour to have held this title, and with our obligation met in the Siege of Barnsley, we formally withdraw from this conflict and rescind the title.

Our temporal duties have been met, and now Silasia must answer the call of Canondom. We thank the Halfings for giving us the opportunity to grow Silasia and we hope to maintain friendship after the crusade is over.

With Silasia’s formal withdrawal from the war, we shall maintain our standing pacts and alliances with other nations, and endeavour in the continued pursuit of peace amongst Xanondom.

THE CRUSADE

Silasia answers the call of the church and shall take action for the crusade. However, it is against Silasian creed to turn your blade against those who you fought with.

As such, as part of our contribution to the Robertine Crusade, The Grand Duchy of Silasia shall establish a Hospitalier Order to tend to all injured.

Our faith in Silasia remains strong, and we remain steadfast and pious laymen of the Church of Canondom and only said Church.

REPENTANCE

As part of our Repentance, I, the Grand Duke of Silasia shall volunteer personally in our Hospitalier Order of knights and tend to the injured.

The Silasians still seek official repentance from the Church, and await our request for clergymen and communication to be met, for the Cardinal of our Archdiocese has not been in correspondence with us.

We urge the church to send us a clergyman to grant us our repentance and perform sacred rites.

DIPLOMACY

The Sylvan State has always endeavoured to achieve political aims through the arts of diplomacy. With avenues of communcation having been impeded by the conflict, weseek immediate reconciliation with our brethren and co-inhabitants of the Eastern sovereignties.

We declare cessation of hostile acts towards crusading and allied states, violation of this shall constitute treason - except in the defence of the realm.

Ambassadors are hereby invited from every realm and correspondences shall occur shortly.
 

JUSTICE

With the expulsion of the Mogg clan, we have righted the wrong we committed towards our neighbouring friends.

However, in a proactive move, Silasia shall enforce further justice upon its lands, as further accusations of banditry and being levied at those of the Provincija Strahzem.

Leaders of the Province, and their 2nd in command are hereby summoned to trial (time TBD) for alleged crimes of banditry, invasion, etc.

SCHISM

The Grand Duchy doesn’t in any way shape or form recognise the legitimacy of any schismatics, and attribute such actions to the disgruntled and misguided.

Action in the form of new laws will be taken to prevent the usurpation of clerical authority. Should the schismatics be caught and identified, they will be delivered to the Church for penance.

The body of faith is comprised of the Church which pumps life into the organs of the body, the canonist realms. When the flow is restricted, malaise within the organs spreads. As such we reiterate our desire for a sanctioned clergyman to deliver us the word of god, so that we may continue to function as an organ in the great body of the faithful.

It is the duty of every ruler to administer and develop their land for the sake of the prosperity of the realm. However, due to the plague affecting the central regions of Silasia, the Crown has not been able to attend to the mountainous regions of the realm.

It is to this end, that The Grand Duchy of Silasia creates the Provincija Strahzem (Province of Dreadland).

The Province is granted the following.

ARTICLE I - LAND

The Province of Dreadland shall be chartered at the top of the southernmost peak of the Karuna Mountains (mountain tile 3)

ARTICLE II - TAXES

The Province shall pay an initial 2000 mina settlement fee, and continued yearly taxation of 150 mina to maintain the land.

ARTICLE III - REGIONAL GOVERNANCE

Dreadland shall be governed by a council of its constituent Houses, with the head of the council serving as the representative. The council will be given the right to establish laws as seen fit within the Provincija, for as long as they do not violate the Silasian Codex.

The right to grant nobility, appoint individuals to the gentry and award knighthood rests solely within the Crown, and not within the purview of the council.

The Provincija Strahzem, or Province of Dreadland shall be considered autonomous in all other operations.

ARTICLE IV - MILITARY

The Province shall be granted the right to levy its own forces and such will fall under the Most Argent Order of the Titan, to be commanded by each respective lord of the familial house as a regiment of the M.A.O.T.

ARTICLE V - OATHS

The Provincial Houses and The Provincial Governer shall swear eternal oaths of loyalty to the Grand Duchy and its Grand Duchess.

The breaking of such Oaths may result in the revocation of this land.

In the interest of preserving the health and lives of all our citizenry, and to prevent the spread of the plague to our neighbours and allies.

It is with great burden that the Grand Duchy Silasia must enact the following mandates in response to the accursed plague spreading throughout our nation:

CLOSURE OF ALL BORDERS

Effective immediately, the borders of our Grand Duchy are hereby sealed. No traveller, merchant, cohorts, or emissaries shall be granted entry, nor shall any subject of this realm venture beyond. Only clergymen and doctors may enter. Others need special permission from the Grand Duke to enter and will require to be quarantined.

This closure shall remain in effect until such a time as the plague is deemed no longer a threat by royal decree.

CEASING OF FOREIGN AID

All aid to foreign nations shall cease immediately. The treasury shall remain closed and no longer donate mina to the rebuilding of other nations, and the Hospital shall ration its medicine to treat the people.

QUARANTINE

Any individual or household with manifestations of the plague shall be placed under immediate quarantine. Supplies will be delivered under the supervision of the Crown’s officers, and all contact with the outside world shall be restricted.

CULLING

Corrupted trees, and vegetation shall be culled to prevent the spread and persistence of the plague. Granaries and stores affected by the plague shall be burnt down. All remaining supplies will be moved to Swan’s Keep for protection and distribution.

EXTERMINATION

The Most Argent Order of the Titan shall be fully mobilised in order to exterminate the hordes of plague-bearing vermin spreading the disease throughout the forest and determine the source of the plague.

Ordermen will be compensated with double the usual pay for their exposure to the plague.

PROVISIONING

Grain, medicine, and supplies shall be distributed fairly under the guidance of the Most Argent Order of the Titan.

MARTIAL LAW

To maintain order and peace during this time of crisis, martial law is declared. The M.A.O.T is commanded to enforce this Edict as deemed fit.

FAITH

Let every household offer prayers for protection and healing. The local church will provide prayer candles in addition to standard provisions.

The granaries of the Grand Duchy will be open to all to alleviate famine, and it shall send food aid to the misfortunate souls within the remnants of the Kingdom of Aaun. 

The medicinal reserves of the hospital shall be used to treat those injured, and a shipment of surplus medicine to be sent to the population centres surrounding Aaun.

The coffers of the Silasian treasury will be opened, and a donation of 250 mina will be granted to the Church to help with aid and reconstruction efforts.

Article III: Mutual Defense

a) Signatories will act with force to defend the sovereignty and territory of the co-signatory, if such is aggressed upon externally.

b) Signatories will act with force to suppress rebellions and coups formed against the legitimate government of the co-signatory.

Objective Agreements:

Article I: Maritime Access 

a) Signatory States agree to not restrict, in form or substance, the passing of ships belonging to the State of another signatory. Respective captains may present a copy of this treatise, if permission for access is put to question. 

b) Harbor access, the anchoring of ships in the docks of the co-signatory, shall by this treaty be enabled, but only facilitated by the agreement of captains and port owners (ROs) in each individual case.

Economic Agreements:

Article I: Free Trade

a) Signatories will provide a trade stall, to be managed by the economic council of the co-signatory, free of tax for the duration of the Treaty.

The Grand Duchy shall send as a gift, a ship of travel and trade, to be used at the leisure of the Nation of Lurak.

IN RETURN:

All travellers: pilgrims, merchants, visitors, etc, will be allowed unimpeded passage through the territory.

There will be no attempt or discussion regarding the removal or modification of the Canonist wayshrines currently erected in the segment of territory aforementioned. Surveyors of Land from all parties will engage in communication to ensure their sites do not impede necessary actions of the settlement process.

The Rexdom of Lurak, The Princedom of Ilumrin, and the Grand Duchy of Silasia will enter into a non-agression agreement for 30 years. They acknowledge each party as Sovereign States, and will take no action to settle across the here-listed Borders.

Additional terms of the non-agression agreement, as well as other cooperation initiatives may be discussed.

The old duke, once so full of vitality and active just a few months ago, fell into the iron grip of disease. As he layed in his bed, overlooking the lakes of brabant, he coughed, sweated and received medicine. As such he confided in his heir, Arowyn, allowing her to take on the major duties of the management of their nascent realm. “Ea should have avoided those jungles…” he lamented his visit to the southern wood elf neighbours, recalling the moment he got bit by some mosquito.

In his few moments of lucidity from fever, he gave his input on the affairs of the realm when his daughter was stumped.

One day, when Sterling was feeling better, a nervous handmaid handed him a copy of a letter “The orcs huh? Lothair wrote WHAT!? The Pontiff replied…” His condition got worse, sending him into a coughing fit.

“W-water! Q-” cough “Quill!”

The skittish servant ran off, fetching him a quill. Through a shaky hand and sweaty brow did the duke write several letters, public and private.

As it has come to be known, through various missives, the orcs have declared war upon our allies, the Vikelans.

This is a secular war, as our alliance with the vikela has been made to promote peace between our realms, as well as allow us to establish a canonist foothold, through the establishment of a church, however this detail is irrelevant in the reason for the conflict.

As your duke, and even moreso as a knight of the realm,  it is both my duty and honour to protect my citizens and canonists. I am bound by the oaths of knight errantry, which I shall follow till the day I draw my last breath, in sickness and in health.

XIII Thou shalt persevere to end in any enterprise begun.

As my signature is present on the covenant signed with Vikela, I am bound to continue this enterprise.

II Thou shalt constitute thyself the defender of All Canondom, regardless of rite, and shall never take up arms against the Church.

And so it is, that I must defend the good and faithful in Brabant.

To honour both these tenets that I live, and eventually shall die by, I decree the following.

I, and the ruling house of Whitewood, shall rally our personal house levy in defence of Vikela, for we honour our word to our allies. And we uphold our noblesse oblige to defend our people, and as lord I wish the minize the spilling of canonist blood in this conflict.

SWAN’S KEEP

As many citizens would have noticed, the old Swan’s keep has been entirely demolished and redeveloped into a proper bastion for the people. We are delighted to open its gates, and for everyone to come, and see it.

The original Swan’s Keep was a small defensive fortress built for a modest family. As the Sylvan Duchy of Brabant expanded, the keep became the heart of the growing duchy. Its walls are painted with cultural art, inviting the people and travellers to marvel at it.

A small silver coin that is 0.4 inches in diameter, with a ridged edge. A lotus flower, encircled by a birch wreath is engraved on the head side of the coin. The tail side of the coin has the value ½ minted on it. This coin is equal to 5 mina.

1 Moneta

A silver coin that is 0.8 inches in diameter, with a ridged edge. The head side of the coin portrays an engraving of a valiant Brabantine Knight on horseback. The tail side of the coin has the value 1 minted on it. This coin is equal to 10 mina.

2 Moneta

A silver coin that is 1 inch in diameter, with a ridged edge. The head of the coin portrays a lake with a tower in the middle. If one were to press their finger upon the coin they would feel the waves on the coin. The tail side has a swan with outstretched wings, and around its neck is a flower crown. On the chest of the swan is the value of 2 minted upon it. This coin is equal to 20 mina.

10 Moneta

A silver coin that is 1.3 inch in diameter, with a ridged edge. The head of the coin portrays a profile view of Duke, Ser Sterling I. The tail of the coin portrays a knight stabbing a demon that has the value of 10 minted upon it. This coin is equal to 100 mina.

SCROLL OF PROCEDURE

The citizens of Brabant are good and honest people, the judiciary must reflect such traits. One must hold oneself to a standard of transparency and goodness for the dignity of those who find themselves under the scrutiny of our law. To this end, the contents of this document shall elaborate on the judicial procedure of the judiciary for both civil and criminal courts, define the legal punishments, and other important judicial procedures. 

Section 1- Verdict Ex Curia

Section 1.1- Verdict upon Arrest

1. Upon no question of guilt, the need for a trial is voided, and the arrested criminal may immediately receive judgment by a Judge. 

2. This should be approved by the Chief Justice or Duke before occurring, but if necessary, it can be skipped over. 

3. Upon question of guilt, a court must be convened. 

Section 1.1

Verdict of Bounty

1. If the subject of the bounty is wanted alive, then a verdict or court will be granted upon their return.

2. If the subject is wanted dead, the death will be verified and legal procedures for death will take place, once the body is delivered to the state. 

Section 2- Court Procedure

Section 2.1

The Call for Court

1. Per the Scroll of Law (refer to section 2, subsections 2-3), any person who attempts, conspires or commits “high crimes” such as treason, murder, poaching, heresy, etc. be subject to immediate prosecution. 

      a. For a crime to be deemed a “high crime”, the Judge must declare it so, after consideration.

1.1. Let any person who commits assault, theft, harassment, or vandalism only be charged if the victim of said crime or the one who accuses such an individual seeks to file charges against the accused.

2. The Judge will review the need of a case and approve or deny it based on legitimacy and need.

3. If approved, the Chief Justice will nominate a Judge to oversee the trial and letters will be sent to all parties involved to summon them to court.

Section 2.2

On Legal Procedure

1. All shall rise a moment for the Judge to officially begin court.

2. The Judge, after calling order of the defendant and prosecution/plaintiff, will then announce that:

“The trial of ([Defendant] v. [Plaintiff])} is now in session. How does the defendant choose to plea?”

3. 1. The defendant may choose to plead that they are either Guilty or Not Guilty. Should the defendant choose a plea of Guilty, then summary punishment may be issued without any further trial by the presiding judge in line with the guidelines espoused in the Scroll of Law. 

      a. If there is an agreement between the prosecution and the defendant for a guilty plea bargain, the judge will move immediately to verdict. 

      b. No judge of Brabant is required to honor a guilty plea bargain but may choose to do so if it does not violate their responsibility of a fair and just court. 

3.2. In the case of a civil court, the two parties are allowed to meet before the Court and settle things out of court but must announce such a deal to the Judge or Chief Justice. 

4. The plaintiff will make an opening statement, summarizing their arguments. The defendant will follow after with their opening statement. Both statements should take a maximum of 15 saints minutes. 

5. The prosecution will make their first claim at which then the defense may make a claim of their own and/or refute the claim that the prosecution has made.

      a. All claims must be rooted in evidence or logic that achieves an argument. This must only take a maximum of 15 saint minutes. 

      b. Since judges are not required to have extensive knowledge of all fields of study, they are allowed to ask questions of trusted state members, expert witnesses, and if need be the prosecution or defense so that they can come to a capable understanding of the case at hand 

      c. A judge can call state members to come in as expert witnesses if the judge has a reasonable doubt of the expert witnesses brought in by the court. 

       d. Refer to Procedure of Witnesses for the definition of an expert witness. 

6. From there the plaintiff will respond and then the defense may rebutt and so on and so forth. Both parties will be allowed to make claims and counterclaims until the Judge deems the end of the argumentation and moves to closing statements.

      a. Any Objections by each side are to be allowed under any circumstances during and before court, but not after the verdict has been passed or during opening or closing arguments.

7.The Judge will finally render a judgment after hearing both closing statements which shall then be executed by the state. Judges must refer to the Scroll of Law on what it takes for them to reach a clear verdict in the case of civil and criminal cases. 

8. The judge will then say “It is under this Legal Court that I find the defendant to be [Guilty / Not Guilty] in the matter of [Name] v. [Name].”

8.1 If a specific crime in the Scroll of Law cannot be substantiated, the Judge will recognize that the accused is innocent until guilty in accordance with section 2, subsection 3, article 1 of the Scroll of Law. 

8.2 If it can be, however, the punishment is up to the presiding judge, so long as it is in line with the Scroll of Law and the legal punishments as defined in Section of this document. 

9. Finally, if a verdict was issued, the Judge will make their decision. If they assign guilt or deemed the accused to be guilty, they must elaborate on why they chose guilty and what punishment they felt was best. 

10. Finally, the Judge adjourns the court, and the trial will end.

11. All trials should be documented for future reference by a scribe.

Procedures of Physical Evidence:

1.All bloody, liquid, or solid objects deemed of evidence to the trial must be put into an oversized and leak-proof cloth bag to avoid creating a mess in the trial. 

2. All letters/manuscripts/documents and other paper-related evidence that isn’t soiled or found to dirty a crime scene will be allowed to be presented as they are. 

3. Both parties must have access and ability to see the evidence but may not tamper with it anyway. 

Procedure of Witnesses/Testimonials 

Types of Witnesses:
Fact witnesses are witnesses who have knowledge and testify about what happened. A fact witness is someone who can speak about what they witnessed for the case at hand or in criminal cases can also be the victims at hand.

Insider/character witnesses have a direct connection with the accused or other witnesses and speak more to the accused or witness's character or personality and may or may not be Fact witnesses also. 

Expert witnesses testify about matters within the field of their expertise that relates to the case, i.e doctors for a point about medical injuries or wounds. 

If either side presents a witness or testimonial, that side will be allowed to ask as many questions until the Judge deems it unnecessary. Both sides must tell the other of the witness they intend to bring to court.

After that, the other side may ask questions to examine or cross-examine the witness, until that side rests or the judge deems it unnecessary.

Procedures of Demonstration:
Sometimes, it can be useful to demonstrate a point or an argument and so sometimes a demonstration is allowed to take place. There is no need for either party to disclose when, how, or what type of demonstration they wish to use, only that they just make the judge aware 5 minutes prior to when they do it by either coming up to the judge during trial and approaching his bench or in private recess. 

Section 3-Legal Punishments 

The punishments listed below are not tied to any specific crime and are simply the procedure that must take place if a Judge chooses a guilty verdict and a punishment to fit it. No judge can give a punishment outside of the Legal Punishments below but will have the authority to choose how each punishment may be enacted but is not to create new ones or inventive ones of his own. 

Section 3.1

Punishment by Fine

1.A fine may be given out by a judge on the spot or during his verdict. 

2.All fines must be executed by the state, ensuring proper dues to the state

3.If unable to pay the fine, a person will receive jail time or be forced to pay such fine in different manners not limited to seizure of personal property or mandatory labor, or payment of items of a physical nature. 

Section 3.2

Punishment of a Physical Nature 

1. If a crime warrants such punishment of a physical nature that induces bodily harm, such as lashing, stoning, etc , a doctor must be at hand to administer healthcare to the accused afterwards.

Section 3.3

Punishment by Exile

1. If a person is punished with exile, they will be given a Saint’s Day to remove their belongings from the city before they are placed in exile.

2. Following this a sketch should be made of the person. This sketch and their name will be posted in the gatehouse, for any guard to see should the person try to return.

3. Should they return before their exile is over, they will be subject to death or jail time for life. 

4. Exilement can be appealed

      a. If this is the case, the person punished should send a letter to The Magister, who will then review the case and determine the course of action from there. 

      b. If another court is needed to be held, then another court will take place and work on similar grounds to mistrial. 

      c. A letter shall be sent to the exiled individual once their period of exile is over, notifying them that they are free to return should they please.

Section 3.4

Punishment by Execution

1. Should a person be sentenced to death, their death will be dealt with humanely.

2. The punished may call for their last rites, as afforded to them by the canonist church, should they be a canonist.

3. Executions are to be performed by knights of the Order of the Titan, with a clergyman to oversee the execution.

Section 3.5

Punishment of Repeat Offenders

1. Any criminal who has before been found guilty of doing the same crime repeatedly (typically for 3–4 counts), will have their punishment increased from the original verdicts of their previous trials. 

2. Criminals who have done different but more than 1 offense of crime to the state will be left under a Judge’s purview on how to follow forward. 

Section 4

Legal Procedures of the Judiciary 

Section 4.1

 On Prisoners of War

1. Should an enemy be captured in war, their fate may be decided by the Order of the Titan with a trial being overlooked due to the circumstances.

2. Should there be a disagreement about how to handle this situation, the view of the Judge or Duke will supersede the military officials.

Section 4.2

Procedure on Crimes done by the Order of the Titan

1. If a member of the Order of the Titan commits an offense that is not a high crime, their case may be handled by the Head of the Order.

2. If a member of Order of the Titan commits an offense that is a higher crime like assault, mutilation, murder or treason, they will receive a Judicial investigation and a subsequent trial.

         a. Arrest and jail time until arraignment are to be decided by the Order or the Judiciary.

3. Any cruel or unusual punishments carried about an order of the Titan member can also be investigated judicially and receive trial. 

Section 4.4

Procedure of Marriage

1. The state recognizes a citizen's right to marry as stated in section 4, section 1, article 4 of the Scroll of Law. 

2. Once the marriage has taken place, it shall be recognized and into recorded. 

Section 4.5

Procedure of Mistrial

1. The Scroll of Law guarantees that a mistrial will be held if the original trial contained a significant failure of the legal defense of the accused in accordance with section 2, subsection 3 and Section 4, Subsection 2, Subdivision 3 of the Scroll of Law. 

2. Any irregularities of court that could cause a person to have been deemed guilty of doing instead of innocent are also grounds for a mistrial. 

           a. Failure of fact witnesses to arrive, erroneous or false information by expert witnesses, incorrect evidence or false evidence that could have changed the verdict or opinion of the court count as irregularities. 

3. A regular court will then take place to investigate the crimes and if the accused is deemed innocent they will be made innocent of all the crimes that he was charged with and the state will award appropriate compensation. 

4. If the individual was executed, they will be posthumously declared innocent of all crimes. 

Section 4.6

Procedure of the False Witness 

1. If a fact, insider/character, or expert witness is found to be lying, it shall be at the discretion of the judge of what they shall proceed but a charge of obstruction will be charged. 

1.1 A judge may call for a verdict upon arrest, if there is no question or beyond reasonable belief any longer that the witness was lying or in any way obstructing justice. 

1.2 If there exists any reasonable doubt, then a separate trial for the accused witness shall be held to determine if that accused will be charged with an obstruction of justice. 

Conclusion 

Within this document, it has contained upon itself the procedures of verdict, the establishment of punishments, and the important judicial procedures that must take place for a healthy and necessary judiciary. This document can and will be allowed to have additions and deletions, as long as both the Chief Justice and the Duke have given assent to such changes. Furthermore, all changes in the scroll of law that will directly change this document must also then be modified accordingly.

PREAMBLE 

The office of the Judiciary shall be the administration that tasks itself with the interpretation of the law, registering of lawyers, and the prosecution of accused persons within the law courts of Brabant . This office requires an understanding of the law and an education of state, law, and government and in so doing, the greatest asset of anyone wishing to join this office shall be one’s merit and willingness to learn regardless of class or race. This office shall hold itself to a meritorious standard. Furthermore, the earning of positions shall be decided based upon the merit and the upright behavior conducive towards proper and good actions while in service.  

OFFICERS OF THE JUDICIARY

The Chief Justice

The Chief Justice of the Judiciary shall be the second highest authority of the Brabant law, second only to that of the Duke himself. His responsibilities are that of the state and the proper functions of the office of the Judiciary. This includes the training of judges and prosecutors, handling of misconduct of judges and prosecutors, and signing off on bounties and warrants of arrest. The Chief Justice shall report directly to the Duke himself. 

Judges

 A Judge’s job will be to convene a civil or criminal court when it is necessary. All judges shall report to the Chief Justice.  As judges, their job will be to use and interpret the law to apply to the case that has been convened before his court and rule in that court regarding the guilt or dispute between two or more parties. They shall to their utmost act unbiased as judges and act in proper and good faith for the sake of both parties in any trial. No judge may use or abuse his position of power for any personal or financial gain. Any proof that a judge has acted in bad faith or in breach of conduct can lead to disciplinary decisions left under the purview of the head lawmen and the Marquis himself .

Lawyers / Prosecutors 

Lawyers or prosecutors shall act as the legal force upon which the state shall seek to accuse and determine guilt of the accused in the criminal courts of Brabant. All prosecutors in the office of the Judiciary shall report to the Chief Justice. Prosecutors can not act as judges during the case and must have had training in order to successfully become appointed to this esteemed position. While all judges are allowed to be prosecutors, not all prosecutors are allowed to be judges due to the higher standard and meritorious rigor involved to be a judge in this office.  

Associates 

 Associates are the first steps into entry into the office. An associate shall be trained into knowing and understanding the laws of Brabant and shall also be taught of the legal courts that reside within it. Once an associate has demonstrated a certain level of understanding deemed adequate to progress as a prosecutor, they shall then be promoted to prosecutors. Associates who by their own will, dedication, and proven mastery of the law by their superior may also be promoted to judge. 

POSTAMBLE 

The Chief Justice, Judges, Lawyers/Prosecutors, and Associates shall compose the Judiciary of the Duchy of Brabant, all sworn in by the Oath of Officers, as per the Scroll of Oaths. They must work tirelessly to pursue the correct and proper justice for the realm and through their work may they punish criminals and solve the disputes of the realm. And through their service, may Brabant have within itself a fair and well-working justice system that seeks fairness to all under the law and promotes the God-given rights of all its citizens.

House Whitewood and its brave leader Sterling Percy have suffered the death of some of its own in the campaign of the Silver Crusade.
