INTRODUCTION:

Purpose of the Decreta:

This Decreta is authored on the Justice’s own authority to examine the legal and doctrinal claims presented in the open letter of Mr. Owyn Hector Ashford de Savoie [ @Navigator ]. While the document levies serious accusations against the present administration of the Holy Mother Church, it is the duty of this Justice, as appointed by the High Pontiff and consecrated by the authority of the High Court, to assess these claims in accordance with Canon Law, the Scrolls, and legitimate ecclesiastical custom.

Scope of the Decreta:

This opinion addresses the canonical status of certain ecclesiastical officeholders, the legal structure and doctrinal validity of the Curia and High Pontiff, the obligations of Canonist princes in wartime, and the ecclesiastical implications of alleged heresies. It affirms the authority of the Church in its current structure and clarifies its legal and spiritual conduct. This decreta is advisory and non-binding, reflecting the personal legal interpretation of the undersigned author and not the official stance of any judicial authority or ecclesiastical institution.

BACKGROUND:

Context of the Decrata:

1.         Mr. Ashford’s open letter presents a sweeping indictment of the Holy Mother Church, suggesting, inter alia, that certain clerics have unlawfully retained their positions, that war has been waged unjustly, and that dogmatic deviations have rendered the Church herself heretical. The letter rests heavily upon the Codex Iurius Canonici Danielus Pontifex, supplemented by selected references to the Scrolls and other theological texts. It purports to establish that the Church has abandoned her own law, rendering her current officers illegitimate and her cause profane.

2.         As Principal Justice, I find it necessary to examine these claims through the authoritative lens of Canon Law, properly interpreted in light of precedent, intent, and the living tradition of ecclesiastical governance.

Relevant Legal and Factual Information:

3.         The Codex Iurius Canonici Danielus Pontifex serves as the definitive legal framework governing ecclesiastical office, discipline, doctrinal integrity, and jurisdiction within the Church. Its application and enforcement bear directly upon the claims raised in the letter.

4.         The Constitution of the Pontifical States sets forth the structural and jurisdictional boundaries of Church governance, including the scope of temporal and spiritual powers and their overlap where formally recognized by the High Pontiff.

5.         Canon Law delineates specific processes and authorities concerning the excommunication of individuals, the removal from clerical office, and the adjudication of Just War, placing particular emphasis on the unique prerogatives of the High Pontiff.

6.         Allegations relating to the conduct of specific clerics, whether involving dual offices, violations of celibacy, or alliances with heretics, require contextual analysis under the Codex, including the interpretation of canonical language regarding automatic penalties and due process.

7.         No public decree or formal pronouncement has been issued which conclusively addresses the cited irregularities, nor has evidence been produced showing that relevant procedural mechanisms have been fully invoked or exhausted.

Issues Addressed:

8.         The following questions arise for consideration:

First, whether the continued exercise of ecclesiastical office by rulers such as Tar-Anorhil of Númendil is permissible under Canon Law, given the apparent conflict between spiritual and temporal authority.

Second, whether clerics who have fathered children are canonically barred from holding office, and whether their past conduct constitutes automatic forfeiture of their positions.

Third, whether the war presently waged by the Holy League and its associated powers meets the standards of Just War under Canon Law, and whether alliances with non-Canonist entities are in violation of the Codex.

Fourth, whether ecclesiastical censures and excommunications promulgated under Curial authority during the illness or absence of the High Pontiff are legally valid and enforceable.

Fifth, whether the Church, through its officers or institutions, has deviated from the dogma of the Scrolls and the teachings of the Exalted in a manner that would constitute heresy or schism under Canon Law.

LEGAL ANALYSIS:

Preliminary Observations:

9.         This analysis is offered in an advisory capacity and does not carry binding legal force. It is intended to elucidate the canonical and constitutional questions raised in Mr. Ashford’s letter by examining the provisions of the Codex Iurius Canonici, the Constitution of the Pontifical States, and the established ecclesiastical framework. The opinions presented herein are guided by interpretive precedent and the operating authority of the High Court of Justice under the delegation of the High Pontiff.

Examination of the Questions: 

1. On the Canonical Legitimacy of Clerics Holding Temporal Office
10.         The Codex Iurius Canonici, Book VI, Title III, Chapter 3, Section 8, indeed declares that an ecclesiastical official shall not serve as ruler of a state unless such state is a holy land under the control of the Church. This prohibition is rightly noted. However, this statute must be read in pari materia with the Constitution of the Pontifical States, which defines the scope of Church authority and governance.

11.         The Constitution of the Pontifical States affirms that a sovereign may submit his lands under the spiritual protection or administrative cooperation of the Church without wholly divesting sovereignty. In such cases, and when the High Pontiff, in his plenary authority, does not revoke or censure such office, one may presume at minimum a toleration, if not express consent. Where no censure is issued, the rule of law defaults to presumption of regularity.

12.         In the case of His Majesty Tar-Anorhil of Númendil, there is no record of formal revocation of his clerical appointment. While his state is not listed in the Constitution of the Pontifical States as a direct ecclesiastical holding, the absence of censure or revocation by the High Pontiff indicates tacit approval or, at least, the application of prudential dispensation.

13.         Furthermore, ecclesiastical history provides precedent for dual temporal and spiritual offices held by men of exceptional status. Where ambiguity remains, the interpretive authority lies first with the High Pontiff, and secondarily with the High Court.

14.         The claim that an ecclesiastical officeholder may not hold temporal power is overly broad. While the Codex expresses a general restriction on ecclesiastical rulers simultaneously governing states not under Church control, this limitation is neither absolute nor self-executing. In circumstances where the High Pontiff has not issued a corrective directive or removal, and particularly where the officeholder acts in defense of the Church or under implied tolerance, the coexistence of roles may be interpreted as canonically permissible. The principle of pontifical prerogative remains paramount.

2. On Clerical Celibacy and the Alleged Forfeiture of Office

15.         Book II, Title II, Section 6 of the Codex outlines causes for automatic loss of office, including the loss of celibacy. However, the Canon does not define the term "loss of celibacy" with precision. The act of having fathered children does not, in itself, automatically result in clerical deprivation unless the act occurs after ordination and without subsequent dispensation.

16.         It is well established that many appointments to high ecclesiastical office are given to men who have already fathered children but have since entered clerical life. In such cases, their former marital status does not invalidate their ministry, provided they maintain continence thereafter. Without incontrovertible evidence that children were conceived during active clerical tenure and without ecclesiastical remedy, the argument for ipso iure removal does not stand.

17.         Moreover, the Codex stipulates that removal may be effectuated only by decree of a superior, or under other exceptional conditions. In the absence of such a decree or public canonical adjudication, presumption must lie in favor of the continued legitimacy of office.

3. On the Legality of the Current Conflict Under Canon Law

18.         Book VI, Title III, Chapter 5 enumerates the norms for Just War. These include the requirement that war be undertaken only for self-defense or promotion of virtue, that it be declared, that the High Pontiff may judge its causes, and that alliances with heretics or pagans be avoided.

19.         The war presently pursued by the Canonist League is, to the extent of available public information, declared in defense of Church authority, the sanctity of the Exalted’s teachings, and against princes who have persistently resisted ecclesiastical correction. While the letter suggests that King Joren I was not excommunicated for four years, the Church is not thereby rendered impotent to act if persistent intransigence, error, or scandal prevails.

20.         The High Pontiff holds the authority, per Book VI, Title III, Chapter 5, Section 5, to determine whether a prince’s causes in war are just or unjust. In absence of a formal declaration against the war, and given the known association of the opposing factions with previously condemned heretical and schismatic elements, the presumption must lie in favor of the Church’s judgment.

21.         On the matter of alliances with pagan or heretical factions, the relevant provisions must be read contextually. Where such allies are not sought as primary agents but serve as incidental auxiliaries, the sin does not necessarily adhere to the Canonist prince, unless it is shown that such aid was essential and actively sought in preference to Canonist unity.

4. On the Validity of Ecclesiastical Sanctions and the Power of the Curia

22.         The Codex affirms that only the High Pontiff may issue excommunications. However, administrative decrees may be issued in his name, provided they reflect his will. Given the public silence of the High Pontiff due to infirmity, the principle of ecclesiastical economy permits trusted Curial officials to speak on his behalf when necessity demands.

23.         Canon Law recognizes the delegation of administrative authority through Curial structures, including the Prelate of the Priesthood and other judicial officers. When such individuals act according to precedent and in conformity with the norms of their office, their actions are presumed to carry pontifical sanction unless explicitly contradicted. The absence of a visible or recent signature from the High Pontiff does not nullify Curial acts executed within delegated competence.

24.         Unless clear and public contradiction by the High Pontiff is demonstrated, the decrees issued under his name carry lawful effect. Mr. Ashford’s objection thus presumes what it must prove: that the High Pontiff is utterly incapable or unwilling to act. Without such proof, canonical presumption remains with his office and those he has entrusted.

5. On the Charge of Heresy within the Church

25.         The Scroll of Auspice is an inspired text of the Canon, and public denial of its legitimacy would constitute heresy. However, no competent ecclesiastical tribunal has found any prelate or Curial official guilty of such denial. Ambiguity in theological emphasis or interpretative caution does not amount to doctrinal deviation.

26.         Interpretation of sacred texts remains the prerogative of the High Pontiff and his delegates. Charges of heresy require incontrovertible evidence of formal and public rejection of revealed doctrine. No such evidence has been presented against the Church or its Magisterium.

27.         The unity of the Church’s Magisterium, her unbroken tradition of teaching from the Exalted onward, and the legitimacy of her Pontiffs assure the faithful that the gates of falsehood shall not prevail against her.

Broader Implications: 

28.         The arguments presented by Mr. Ashford, if accepted without scrutiny, would not merely challenge the conduct of individual clerics but destabilize the legal authority of the Holy Mother Church itself. To predicate ecclesiastical governance upon rigid literalism divorced from prudential judgment and papal discretion would collapse centuries of legal and doctrinal development. 

29.         The presumption that ecclesiastical offices are vacated by private accusations alone, without formal adjudication or pontifical action, undermines the juridical integrity of the Church and invites chaos.

30.         Further, the assertion that wartime alliances or policy decisions necessarily result in heresy without examination by competent authority sets a dangerous precedent. It effectively subjects the Church to secular accusation without recourse to canonical due process.

31.         Lastly, broad accusations of institutional heresy, without evidentiary rigor or canonical procedure, pose grave risks to the unity of the Church and open the door to schism under the guise of reform.

CONCLUSION:

Summary of Findings:

32.         Upon thorough review, it is the considered opinion of this Decreta that the arguments advanced in the open letter of Mr. Ashford, while substantial in rhetoric, fail to conclusively demonstrate unlawful deviation from the Codex Iurius Canonici or the Constitution of the Pontifical States. The following observations are made:

• The question of dual temporal and spiritual authority requires prudential interpretation and cannot be resolved solely by textual recitation absent pontifical clarification.

• The application of clerical celibacy laws is dependent upon contextual fact and proper canonical procedure, not mere assertion of biological paternity.

• The prosecution of war under Canon Law is subject to the discretion and review of the High Pontiff, and until he declares otherwise, such acts retain presumptive legitimacy.

• The issuance of ecclesiastical censures under Curial auspices, where no express pontifical revocation has occurred, must be treated with procedural deference under the principle of ecclesiastical economy.

• No public or magisterial statement has been issued which repudiates the Scroll of Auspice or denies the authority of the Exalted, and therefore charges of institutional heresy remain unsubstantiated.

Taken collectively, the legal and doctrinal basis for the accusations against the Church and its clergy remain insufficiently grounded in law, and the presumption of regularity in ecclesiastical governance is not overcome

Non-Binding Nature of the Decreta:

33.         This Decreta is offered as a personal contribution to the ongoing discourse concerning canonical interpretation and Church governance. It does not carry binding authority nor reflect a formal ruling of the High Court of Justice. Rather, it is intended to clarify key questions of law and encourage adherence to the constitutional and canonical traditions that underpin the unity and authority of the Church.

FINAL REMARKS:

34.         While this analysis is rooted in the current legal texts and interpretive traditions, it is acknowledged that evolving circumstances or pontifical declarations may reshape the applicable framework. It is in the spirit of fidelity to truth and ecclesiastical order that this Decreta is published, in hope that it contributes to a clearer understanding of the duties and limits inherent in the Church’s law.

Subject Matter:

Whether the Pontifical Prosecution can lawfully pursue charges under Canon Law based on civil Directives of the Pontifical States; and whether those Directives can be applied retroactively to alleged acts of excessive force by Atticus Keen and his jurisdiction.

THE COURT:

Having regard to the written proceedings, the Court delivers the following judgment:

BACKGROUND:

1.         In response to events within the Pontifical Territories involving the alleged exertion of excessive force against elven individuals, the Pontifical Prosecution initiated proceedings before this Court against Atticus Keen and members under his regional jurisdiction. Subsequently, the party of Atticus Keen submitted a motion to dismiss the case. The Court has duly reviewed and considered said motion and has reached its determination.

LEGAL ANALYSIS:

Preliminary Observations:

2.         The primary issues before this Court pertain to: (i) the scope of the Pontifical Prosecution’s authority; (ii) the applicability of the Directives of the Pontifical States under the framework of Canon Law; and (iii) the conformity of the charges with established ecclesiastical legal principles.

3.         The Pontifical Prosecution’s claims rest upon two primary arguments: (a) alleged violations of the Directives of the Pontifical States; and (b) obligations of governance, particularly with respect to the conduct of Atticus Keen. The defense has argued that these Directives are civil in nature and lie outside the jurisdictional remit of Canon Law, further contending that their retroactive application in the present case is impermissible.

4.         This Court is tasked with determining: (1) whether the Directives of the Pontifical States constitute a legitimate basis for charges under Canon Law; and (2) whether the Pontifical Prosecution has adhered to requisite procedural and substantive legal standards in bringing forth this case.

Examination of Claims / Questions: 

a. Are the Directives of the Pontifical States enforceable under the Code of Canon Law?
5.         This Court has carefully reviewed the jurisdictional and substantive nature of the Directives of the Pontifical States and finds as follows: These Directives are subsidiary laws promulgated under the Constitution of the Pontifical States, with the specific intent to regulate civil matters within the Territories of the Holy See. They are distinct from, and do not derive their authority from, the Code of Canon Law, which governs ecclesiastical and spiritual matters.

6.         As such, these Directives cannot form a lawful basis for prosecution under the jurisdiction of ecclesiastical courts. The Pontifical Prosecution, as an ecclesiastical authority, is bound to the enforcement of Canon Law and is precluded from exercising jurisdiction over matters governed solely by civil directives. Consequently, the charges predicated upon these Directives are deemed invalid.

b. Can the Directives be applied ex post facto in this case?
7.         This Court refers to the principle enshrined in the Codex of Ecclesiastical Laws, Book I: Application of Laws, Title I: Foundations of Law, Paragraph 2, which unequivocally provides: “Laws provide for the future only, unless expressly provided.” This principle explicitly prohibits the retroactive application of laws absent express authorization.

8.         The Directives invoked by the Pontifical Prosecution were promulgated subsequent to the alleged incidents. Any attempt to apply them retroactively would contravene foundational principles of ecclesiastical law. Accordingly, this Court concludes that the Directives cannot lawfully be applied ex post facto.

c. What is the appropriate recourse for claims regarding Atticus Keen’s alleged negligence in fulfilling feudal obligations?

9.       Claims alleging negligence in the fulfillment of feudal obligations fall squarely within the jurisdiction of the civil law governing the Pontifical States. The Constitution of the Pontifical States provides a framework for addressing such claims through civil litigation. The Premier of the Pontifical States, or their authorized representative, retains the authority to initiate such proceedings under applicable civil laws.

10.       While the Pontifical Prosecutors may serve as legal counsel in these civil proceedings, their role must be confined to representation and must not extend to prosecutorial functions. This delineation ensures the distinction between civil and ecclesiastical authority is maintained.

d.  Are there grounds for prosecuting the alleged offenses under Canon Law?

11.       The Court affirms that Atticus Keen and other relevant individuals may be subject to prosecution if their actions are shown to contravene provisions of the Code of Canon Law. However, the Pontifical Prosecution bears the burden of demonstrating the applicability of specific Canon Law provisions to substantiate such charges. Future proceedings must adhere rigorously to the jurisdictional and procedural requirements established under Canon Law.

OPERATIVE PART:

12.         Having reviewed the evidence, testimony, and applicable provisions of Canon law, the Court issue its ruling on the questions presented.

As regards the motion to dismiss

13.         The motion to dismiss is hereby granted in full. The Court finds that the charges brought by the Pontifical Prosecution lack a valid legal basis under the Code of Canon Law. Accordingly, the case Church of the Canon v. Keen, et al. is declared null and void.

As regards the jurisdiction of directives

14.         The Court holds that the Directives of the Pontifical States are civil laws governed by the Constitution of the Pontifical States and fall outside the jurisdiction of Canon Law. As such, they cannot serve as a basis for ecclesiastical prosecution.

As regards the prohibition of ex post facto application

15.         The retroactive application of the Directives is impermissible, as it contravenes the principles enshrined in the Codex of Ecclesiastical Laws. Such application is explicitly prohibited.

As regards civil litigation recourse

16.         Allegations of negligence in fulfilling feudal duties may be pursued through civil litigation initiated by the Premier of the Pontifical States or their authorized representatives. Pontifical Prosecutors may act as legal counsel but must refrain from performing prosecutorial functions in such matters.

As regards future prosecutions under Canon Law 

17.         The Pontifical Prosecution retains the authority to pursue charges against Atticus Keen or other relevant individuals if substantiated under applicable provisions of the Code of Canon Law. All such charges must conform to ecclesiastical legal principles and procedural mandates.

As regards procedural rule amendments

18.         To ensure clarity and uniformity in future proceedings, the Court directs that Chapter II of the Praecepta Procedendi shall be amended to formalize the procedures governing the submission, opposition, and adjudication of motions before this Court.

1.         In response to the call by Atticus Keen, Princeps of Ivoria, for intervention by the former Office of the Auditor, this High Court of Justice has stepped forward to fulfill its sacred duty. As the Office of the Auditor has since been disbanded and its functions reestablished under the purview of this Court; the Court now assumes full authority to address the grievances and discord between the parties herein named.

2.         By the sacred authority vested in the High Court of Justice of the Church of the Canon, and in reverence to the Creator’s divine will, we issue this combined decree to restore peace among the faithful and summon both parties to answer before this holy court.

3.         The Creator’s justice calls for unity, and His Church must act to resolve the grievous conflict between Atticus Keen, Princeps of Ivoria, and Lorelei Alstion-Enswerp, Countess of Enswerp. Therefore, this Court declares an immediate cessation of hostilities and commands your appearance to address and resolve this strife in accordance with Canonist law.

ISSUANCE OF SUMMONS

4.         You are hereby summoned to appear before the High Court of Justice on a date discussed amongst the relevant parties, and this Court, to address the grievances that have fueled this discord.

5.         The proceedings will take place in the Holy Chamber of Adjudication within the Grand Basilica of the Apostolic City, a site consecrated for the Creator’s justice.

6.         Both parties are expected to conduct themselves with dignity and reverence. Any display of hostility or contempt within this sacred court will not be tolerated and will be met with immediate sanction.

ISSUANCE OF CEASEFIRE

7.         From this moment forward, all acts of war, violence, and aggression between the House of Keen and the County of Enswerp are to cease without delay. Any party found violating this issuance will be judged not only in the courts of men but also before the eyes of the Creator Himself.

8.         Both parties are strictly prohibited from undertaking any actions that might inflame tensions, including but not limited to: (1) Armed engagements; (2) sieges or blockades; (3) threats, provocations or publishing public material; (4) and, harm or intimidation of civilians. 

9.         Let it be known that this decree is not a suggestion but a sacred mandate. The Creator’s justice shall not be mocked, and His peace must prevail. We call upon both parties to lay down their arms and turn their hearts toward reconciliation, lest they incur the wrath of the Creator and the judgment of His Church.

FINAL REMARKS

10.         This combined decree is issued in the name of the Creator, whose justice and peace must prevail. The eyes of the Church and the faithful are upon you. Heed this call, for failure to comply will bring the gravest spiritual and temporal consequences, including excommunication, denunciation, and the loss of Canonist protections.

11.         Let it be known that the Creator’s Church seeks not vengeance, but resolution and harmony among His children. Lay down your arms, prepare your hearts, and stand before this Court to fulfill your duty to the Creator and His divine law.

12.         May the Creator’s light guide you toward truth, peace, and reconciliation.

Having regard to the written proceedings and the oral proceedings, the Court delivers the following judgment of:

BACKGROUND:

1.         The case is submitted to the Court following allegations of unfaithfulness of flesh and spirit, in adultery, made by the Princeps of Ivöria, Atticus Keen, against the Countess of Enswerp, Lorelei Alstion-Enswerp. 

2.         Following these accusations, the Princeps of Ivöria laid siege to the County of Enswerp’s Cliffhaven keep, and following a call for ceasefire and the ruling of Case HCA-001/04, the Princeps’ levy laid down their arms accordingly. 

3.         As per the aforementioned Case’s resolution, all evidence was presented to the Pontifical Prosecution for analysis and the eventual petition to the High Court, the Holy Court of Inquisition accepting to hear the case.

LEGAL ANALYSIS:

Preliminary Observations:

4.         The prosecution initially presented similar arguments to those found during Case HCA-001/04, claiming that the exhibited evidence put doubt on the Countess’ integrity of character and spiritual health, by testimony of her close family members; as well as Goran Wick’s integrity, by calling into attention his familial reputation in Númendil and abroad.

5.         Furthermore, Bishop Alaric Altamarino argues the close and unusual relationship fostered between the Countess and Goran Wick, in outlying circumstantial instances that might imply the illegality of their relationship, by account of various eye witnesses.

6.         The defense, in turn, seeks to counteract what it argues to be baseless defamation that undermines the integrity of the Prosecution, and presents counterpoints by witness testimonies that speak against the denigration of both the Countess and Goran Wick’s character, and insist on the improbability of their relationship being in nature adulterous.

7.         The Prosecution presents, by witness accounts, the state of the relationship between the Countess and late Count, Roan Alstion-Enswerp, in the years preceding his death of illness. The Prosecution contends that the Countess was acting in violation of her marital vows in seeking to first divorce and then annul her marriage, during the deteriorating health of the Count, in an unfaithful spirit to the matrimonial vows between husband and wife, which avow to keep loyal to one another ‘in health as in sickness’.

OPERATIVE PART:

8.         Having reviewed the evidence, testimony, and applicable provisions of Canon law, the Court issues its ruling on the two questions presented.

9.         Firstly, the Court deems the defendant Countess not guilty of the charge of Adultery, Crime against Virtue, due to lack of substantial evidence.

10.         Secondly, the Court deems the defendant Countess guilty of the charge of Unfaithfulness in Spirit, but not in Flesh; as exhibited in her failure to uphold her marital vows in face of her husband’s diminishing health, and supported by her low standing among her own family. 

11.         Thirdly, the Court finds the relevant party of Goran Wick to be innocent of the charge of Adultery, Crime against Virtue, for the same reason cited above.

12.         For the penance of the Countess' Unfaithfulness in Spirit, the Court rules upon Countess Lorelei Alstion-Enswerp:

1. To fund and partake in the construction of a Church of Saint Julia of Paradisus as patron, at a location of the Bishop's convenience;
2. To fund and partake in the placement of roadside altars along all the roads of the Pontifical Territories,
   1. With at least one in patronage to Saints Joren and Tara;
3. To sponsor at least one of her children into Churchly service through priestly or monastic vows.
4. To seek at the earliest a confession before an ordained priest.

13.         In addition, the Court - by Pontifical approval - shall prohibit the development of a relationship between the Countess and Goran Wick, and shall thereby forbid their potential matrimony under the Holy Mother Church.

15.         This ruling is final and binding upon all parties, as required by the Constitution of the Pontifical Territories, Article IV.

First, whether the aggressive actions of the Princeps of Ivoria, Atticus Keen, were justified in response to the alleged crime of adultery committed by the Countess of Enswerp, Lorelei Alstion-Esnwerp; and second, whether individual subjects of law, specifically laypersons, hold the right to prosecute others for crimes pertaining to virtue and violations of Canon law.

Having regard to the written and oral proceedings, the Court delivers the following judgement:

BACKGROUND:

1.         The case arose from allegations made by the Princeps of Ivoria, Atticus Keen, against the Countess of Enswerp, Lorelei Alstion-Enswerp. The Princeps accused the Countess of engaging in an adulterous relationship with one Goran Wick during the final days of her husband’s life. The Princeps claimed that this alleged misconduct undermined the dignity and stability of the nobility and its institutions. 

2.         In response to these accusations, the Princeps took unilateral and hostile action by laying siege to the County of Enswerp. This act of aggression, combined with public denunciations exchanged between the parties, heightened tensions and disrupted regional peace. 

3.         In the light of the escalating conflict and the public nature of the accusations, the Princeps of Ivoria sought recourse by formally petitioning the High Court of Justice for intervention. Recognising the gravity of the dispute and the potential for further destabilisation, the High Court promptly issued a ceasefire order and summoned both parties to appear before it.

LEGAL ANALYSIS: 

Preliminary Observations:

4.         The Court notes that the claims advanced by the Princeps of Ivoria, acting on behalf of the House of Keen, centre on allegations of misconduct and dereliction of duty on the part of the Countess of Enswerp. The Princeps asserts that the Countess engaged in conduct contrary to Canon law by entering into an adulterous relationship with one Goran Wick while her husband, Count Roan, was allegedly still alive. 

5.         Specific allegations include granting Wick access to her private residence and cohabiting with him during this period. Further, the Princeps contend that the Countess has demonstrated a pattern of familial neglect and administrative failure, including the abandonment of her children and complicity with Wick. 

6.         In light of these assertions, the Princeps argues that such conduct constitutes a breach of Canonist principles and renders the Countess unfit to govern the County of Enswerp. He submits that the title should be transferred to John Alstion, her brother, citing his demonstrated piety and adherence to Canonist virtues as evidence of his suitability for leadership. 

7.         The Countess, in her response, categorically denies the allegations brought against her and challenges the motives of her accusers. She maintains that the claims are baseless fabrications orchestrated by her siblings and the Princeps, to unlawfully usurp her title. 

8.         The Countess asserts that her association with Wick was strictly platonic, describing him as a temporary guest during construction delays on his property. She frames herself as a bereaved widow in mourning for her late husband, and she contends that the accusations of infidelity lack substantiation. 

9.         Furthermore, the Countess alleges the actions of the Princeps, including the orchestration of a siege on her lands, were politically motivated acts of aggression disguised under the pretext of religious and moral indignation. She asserts that these actions resulted in significant harm to her people, including the loss of civilian lives and widespread terror. The Countess maintains that her leadership was conferred upon her legitimately under the auspices of the Church, and that her title remains valid. 

10.         The Court observes that the allegations and counterclaims presented raise issues not only of personal conduct but also of governance, regional stability, and adherence to ecclesiastical principles. The parties’ respective arguments appear to centre on competing narratives of moral and legal legitimacy, with the Princeps invoking Canon law and familial integrity to challenge the Countess’ rule, while the Countess frames the dispute as a politically motivated campaign aimed at discrediting her rightful leadership. 

11.         In assessing the admissibility and merits of the claims, the Court shall examine the evidence presented, the procedural compliance of the parties, and the broader implications of any findings on the governance of the County of Enswerp and the maintenance of ecclesiastical and legal order. It is imperative to consider whether the alleged actions of the Countess constitute breaches of law sufficient to warrant the intervention sought, as well as the proportionality and legitimacy of the measures undertaken by the Princeps. 

Examination of Claims: 

12.         Based on the evidence, testimony, and information presented before the Court, two key questions arise for consideration in its ruling. 

First, whether the siege of the County of Enswerp by the Princeps of Ivoria was justified and lawful. 

Second, whether an individual subject of law holds the authority to prosecute another under the provision of Canon law. 

As regards the first question

13.         In assessing the lawfulness of the siege conducted by the Princeps of Ivoria, the Court has examined two critical elements: the provisions governing war and conflict within the Canonist doctrines, and the justification advanced by the Princeps. 

14.         The Court references the Codex of Ecclesiastical Laws, Book VI: The Preserving Function of the Church, Title III: Temporal Authorities, Chapter 5: Just War, Article 10. This provision dictates that war or acts of war must be waged as a “last resort” and for the “promotion of virtue.” These criteria establish the framework by which the legitimacy of acts of war must be evaluated. 

15.         The Princeps of Ivoria has asserted that the siege was justified as an act to promote virtue, specifically citing accusations of adultery against the Countess of Enswerp. While the Court acknowledges that adultery is classified as a crime against virtue under Book V: The Purifying Function of the Church, Title II: The Topics of Canon Law, Chapter 1: Crimes Against Virtue, Article 2, it finds that the determination and enforcement of such breaches cannot be unilaterally decided by an individual, including the Princeps. 

16.         Jurisdiction over breaches of virtue lies exclusively with this Court, as established in the Establishment of the High Court of Justice, 2004, Chapter 1, Article 1, which articulates that this Court is the supreme authority concerning the interpretation and application of Canon law. This provision centralises authority to adjudicate breaches of virtue, ensuring that all cases are addressed impartially and within the framework of Canon law. 

17.         Accordingly, the Court concludes that the unilateral siege conducted by the Princeps of Ivoria was unlawful under such doctrines. 

As regards the second question

18.         The Court also considers whether individual subjects of law, including laypersons of the Church or citizens of the Pontifical Territories, have the authority to prosecute breaches of virtue.  

19.         The Court reaffirms that the adjudication of breaches of virtues is within its exclusive jurisdiction. While individuals may submit claims or accusations for the Church to prosecute, they do not have the authority to prosecute, issue judgements or enforce penalties unilaterally. 

20.         Based on this principle, the Court finds that an individual subject of law may not act as a prosecutor or take action against another for alleged breaches of virtue unless the matter has been duly adjudicated by this Court in accordance with Canon law. 

Assessment of Evidence: 

21.         In relation to the above, the Court finds the submitted evidence inadmissible, affirming its ruling that no individual subject of law may unilaterally prosecute another, issue their own verdict, and subsequently act upon it. However, the Court directs the applicant to submit the evidence to the Pontifical Prosecutors, who shall bring forward the case concerning the Countess of Enswerp through the appropriate legal channels.

As regards the first question

23.         The Court finds that the siege conducted by the Princeps of Ivoria is unlawful under Canon law. The Codex of Ecclesiastical Laws stipulates in Book VI, Title III, Chapter 5, Article 10, that acts of war must only be waged as a “last resort” and for the “promotion of virtue.” Furthermore, the authority to adjudicate and enforce breaches of virtue lies solely with this Court, as established in the Establishment of the High Court of Justice, 2004, Chapter 1, Article 1. The unilateral actions of the Princeps, bypassing the lawful processes of Canonist justice, constitute an overreach of authority and a violation of these principles. 

As regards the second question

24.         The Court reaffirms that individual subjects of law, including laypersons, may not unilaterally prosecute others for alleged breaches of virtue. Such matters must be submitted to Pontifical Prosecutors, who are entrusted with the authority to prosecute in accordance with Canon law. While individuals may present evidence or allegations, they do not possess the right to issue judgements or take punitive actions independently. 

Directive to the Princeps of Ivoria

25.         The Court orders the Princeps of Ivoria to immediately conclude the siege of the County of Enswerp and cease all acts of aggression. Any further actions of this nature will be considered a violation of Canon law and subject to additional penalties. 

26.         The Court further directs the applicant to submit the evidence regarding the Countess of Enswerp to the Pontifical Prosecutors. The case shall be prosecuted through proper legal channels, ensuring adherence to the laws and principles upheld by the Church. 

27.         This ruling is final and binding upon all parties, as required by the Constitution of the Pontifical Territories, Article IV.
