PROCLAMATION ON THE REVISION OF THE CODEX LACOBIANUS.

CONVENTUS ADRIAE. 

In the year 655 of the Age of Ascension

BY THE SOVEREIGN WILL OF THE DUMA AND UNDER THE LAWFUL MANDATE OF THE HONOURABLE DUKE, THIS MISSIVE IS HEREBY PROCLAIMED IN SERVICE TO A UNITED ADRIAN PEOPLE. GUIDED BY THE VIRTUES OF HONOUR, DUTY, JUSTICE, LIBERTY AND LOYALTY. WE CONVEY THROUGH THIS MATTERS OF GOVERNANCE, STATECRAFT AND LAW THAT SUSTAIN AND STRENGTHEN OUR STEADFAST DUCHY.

THE FIRST TENET

Preamble

1. The Criminal Code dictates what is, and what is not legal, to maintain social order and a civilized society.

2. Anyone who is within Adrian territory or is a citizen of the Duchy of Adria is subject to this Code. The Duke is above this law and may command an order that goes against the Criminal Code as it is seen as for the good of the Duchy.
 

        1. A citizen of Adria is defined by the following terms:

                i. Follower of the Church of the True Faith,

                ii. Declares oneself to be Adrian, or possesses citizenship by birthright;

                iii. Maintains residence within the Duchy of Adria.

        2. In order to be granted Adrian citizenship, a non-natural or foreign-born subject must:

                 i. Reside or have resided within Adrian lands for at least two years;

                ii. Swear to uphold the laws, customs and traditions of Adria and its people;

                iii. Swear an oath of loyalty before the Duke or an appointed representative;

        3. A Nobleman of Adria is defined by the following terms:

                i. Holds an official noble status granted by a past or current Duke of Adria.

                ii. Is the lawful patriarch of said noble household or his blood-born relative.

                iii. Is the lawful spouse of the patriarch or matriarch of the noble household.

3. Amendments to this Code may only be allowed by a unanimous vote by the Duma. 

THE SECOND TENET

The Code

4. The following laws and statutes shall constitute the Code of the Duchy of Adria.

THE THIRD TENET

Authority of Enforcement and Mitigating Circumstances

5. An Adrian Guard is the instrument of law enforcement within the Duchy of Adria. It is appointed by and subject to the authority of the Duke, who retains sovereignty over its structure, appointment and directives. The Ivory Guard is recognized as the present Adrian Guard. 

6. The Adrian Guard is charged with the safeguarding of the borders and peace of Adria and is empowered in the name of the Duchy to pursue, apprehend, and detain those who are suspected of breaking Adrian laws, to be brought before lawful judgement.

7. No citizen or non-citizen, save for duly appointed authorities of the Duchy of Adria, such as the Adrian Guard or persons acting under their direct command, may enact punishments, interfere in lawful arrests, obstruct officers of the Duchy, or impede the enforcement of law and order. Any such interference shall itself constitute an offence.

8. A person acting in aid of the Duchy, the Guard, or other lawful authority shall not be guilty of an offence committed in the course of assisting lawful enforcement, provided such assistance is confirmed by a representative of said authority.

9. A person shall not be guilty of an offence if they have used only such force as is immediately necessary to prevent or stop an unlawful attack against themselves or another person.

10. A person shall not be guilty of an offence if they have used only such force as is immediately necessary to prevent or stop the ongoing unlawful destruction, theft, or seizure of property.

THE FOURTH TENET

Capital Criminal Offences

11. All offences listed under this segment are Capital Criminal Offences punishable by capital punishment: death, forfeiture of property and public humiliation - preferably beeting.

12. High Treason

12.1. A person commits High Treason if they intentionally kill, attempt to kill, maim, wound, unlawfully imprison, or unlawfully restrain a member of the Adrian Nobility.

12.2. A person commits High Treason if they attempt to or conspire to overthrow the lawful government of the Duchy of Adria.

12.3. A person commits High Treason if they levy war against Adria, or knowingly assist an enemy power engaged in conflict against the Duchy of Adria.

12.4. A person commits High Treason if they deliberately incite unrest among Adrians with intent to or for the purpose of undermining national unity or causing rebellion.

12.5. A person who commits or conspires to commit High Treason is subject to capital punishment.

13. Witchcraft

13.1. Anyone who is a witch, warlock or a general practitioner of dark arts, is subject to capital punishment.

14. Murder

14.1. A person commits Murder if they intentionally and unlawfully take the life of another person.

14.2. A person who assists, orders, or facilitates Murder is guilty of Assisted Murder.

14.3. A person commits Manslaughter if they unlawfully cause the death of another person without intent to kill.

15. Kidnapping

15.1. A person commits Kidnapping if they unlawfully capture, detain, or transport another person through force, threat or deception. 

THE FIFTH TENET

Criminal Offences

16. All offences under this segment are subject to punishment specified herein; however, the Judicial Duma and lawful authorities may reasonably increase, reduce, or otherwise adjust them according to the severity, intent, repetition, and circumstances of the offence, unless otherwise mandated by this Code.

17. Perjury

17.1. Anyone who knowingly gives false testimony or speaks untruthfully before a Judicial Duma or an officer of law is guilty of Perjury.

17.2. Those guilty of Perjury are punished by public humiliation and severe beating.

18. Assault

18.1. Anyone who intentionally causes physical harm or attempts to cause physical harm to another is guilty of Assault.

18.2. Those guilty of Assault are punished by an immediate fine or jail.

19. Corruption

19.1. Any officer of law or member of the Ducal Government who abuses granted authority or office for unlawful gain is guilty of Corruption.

19.2. Those guilty of Corruption are punished by a severe fine and stripped of their right to hold office.

20. Property Damage Offences

20.1. Anyone who causes willful damage to the property of another is guilty of Mischief.

20.2. Those guilty of Mischief are punished by a fine or public humiliation if repeated.

20.3. Anyone who causes unintentional damage to the property of another is guilty of Tort.

20.4. Those guilty of Tort are to pay the victim for repair compensation

20.5. Anyone who causes damage to the property of another by fire is guilty of Arson.

20.6. Those guilty of Arson are punished by a fine, public humiliation, jail and in severe cases, death or maiming.

21. Theft

21.1. Anyone who willfully takes property belonging to another without consent is guilty of Theft.

21.2. Those guilty of Theft are punished by public humiliation, branding, fine, and for repeat offenders, death or maiming.

22. Trespassing

22.1. Anyone who enters private property without proper or lawful permission is guilty of Trespassing.

22.2. Those guilty of Trespassing are punished by a fine.

23. Currency offences

23.1. Anyone who uses deception for unlawful monetary gain is guilty of Fraud.

23.2. Those guilty of Fraud are punished by a fine, and in severe cases, exile.

23.3. Anyone who produces false currency is guilty of Counterfeiting.

23.4. Those guilty of Counterfeiting are punished by a fine, and in severe cases, exile.

23.5. Anyone who willfully destroys lawful currency is guilty of Destruction of Currency.

23.6. Those guilty of Destruction of Currency are punished by a fine.

24. Unlawful building

24.1. Anyone who constructs buildings on Ducal territory without permission is guilty of Unlawful Building.

24.2. Those guilty of Unlawful Building are punished by a fine and removal of their structure.

25. Prison break

25.1. Anyone who escapes or attempts to escape incarceration before their lawful removal is guilty of Prison Break.

25.2. Those guilty of Prison Break are punished by an extended sentence.

25.3. Those guilty of Prison Break that commit violence as a part of their crime are punished by maiming the arm that caused harm.

26. Public Order Offences

26.1. Anyone who fails to comply with a lawful order of someone in authority is guilty of Disobedience.

26.2. Those guilty of Disobedience are punished by a fine or jail.

26.3. Anyone who prevents figures of authority from carrying out their duties, accessing evidence or enforcing law and order in the Duchy of Adria are guilty of Obstruction of Justice.

26.4. Those guilty of Obstruction of Justice are punished depending on the severity of their crime.

26.5. Anyone who knowingly and with ill intent falsely accuses another person of committing an offence is guilty of False Accusation.

26.6. Those guilty of False Accusation are punished by the very same punishment prescribed for the offence falsely alleged, increased to twice its severity.

THE SIXTH TENET

Rights of Persons

27. Under this segment, the rights of persons within the Duchy of Adria are defined according to lawful status. These rights define legal protections and privileges under the Code and shall be interpreted in accordance with ducal authority and lawful judgement.

28. Rights of Citizens

28.1. A citizen of Adria shall have full standing before the Judicial Duma.

           28.1.1. Citizens may initiate legal proceedings before the Judicial Duma.

           28.1.2. Citizens shall have the right to call for a Judicial Duma.

           28.1.3. Citizens shall be recognized as competent witnesses under the Code.


28.2. A citizen of Adria may engage in civic participation under ducal authority.

           28.2.1. Citizens may participate in advisory votes when called by the Duke.

           28.2.2. Citizens may submit proposals, grievances, and requests for reform.

28.3. A citizen of Adria may be appointed to roles of public trust within the Duchy.

           28.3.1. Citizens may hold civic or administrative office.

           28.3.2. Citizens may serve within recognized state institutions of Adria.

           28.3.3. Citizens may hold office in recognized state institutions.

 

28.4. A citizen of Adria shall be entitled to economic participation within the Duchy.

           28.4.1. Citizens receive priority allocation of stalls in official markets.

           28.4.2. Citizens are exempt from foreign merchant taxes and tariffs.

           28.4.3. Citizens may form guilds and enterprises under state guidance.

28.5. A citizen of Adria shall be entitled to the protection of the Duchy of Adria.

           28.5.1. Citizens receive lawful protection of life, property and status.

           28.5.2. Citizens are entitled to the enforcement of law on their behalf.

29. Rights of Nobility

29.1. A nobleman of Adria shall enjoy all rights afforded to a Citizen of Adria, in addition to the rights and privileges herein specified.

29.2. A nobleman of Adria shall be entitled to recognition of title and respectful address by any, unless they expressly waive such recognition.

29.3. A nobleman of Adria shall be entitled to protection of honor and standing. Insults, defamation, or deliberate public dishonor directed at Adrian nobility may constitute legal grievance. An Adrian nobleman may seek redress through lawful authority or may respond to direct affronts to honor in a manner consistent with custom and proportional force, such as lawful challenge or other means.

29.4. A nobleman of Adria who is head of his own household, be he a patriarch or matriarch, shall be given a vote in the Grand Duma (colloquially referred to by Adrians as its old name, ‘The Dumapalooza’) in matters pertaining to Ducal succession.

30. Rights of non-Citizens

30.1. A non-citizen residing within the territories of the Duchy of Adria shall be entitled to basic protection under the code, including both medical help and safety from unlawful harm. 

30.2. A non-citizen may engage in limited economic activity within the Duchy of Adria, such as trade, labor, and conduct business within Adria subject to lawful taxation, tariffs, and ducal regulation. 

30.2.1. Realms which deny entry, trade, or lawful commerce to Adrian merchants may meet equal reciprocal restrictions in the Duchy of Adria.

30.3. A non-citizen shall not possess the civic, political, or legal rights reserved under this Code to Citizens and Nobility of Adria. 

30.4. A non-citizen holds no inherent standing before the Duma unless formally summoned, charged, or otherwise permitted by lawful authority.

30.5. A non-citizen residing within Adria may pursue citizenship under the laws and customs of the Duchy, provided the non-citizen demonstrates full integration into Adrian society, has lived there for dictated period of time, swears to uphold Adrian traditions and values, and holds no allegiance or obligation to a foreign realm.

THE SEVENTH TENET

The Judicial Duma

31. The Judicial Duma

32. In the event that the Duchy of Adria authorizes the convening of a Judicial Duma, or where the matter is of such severity or complexity that it cannot be resolved by the Adrian Guard, a Judicial Duma may be convened at the discretion of the Duke or the Chancellor.

33. No man shall be brought to trial unless accused by a sworn guardsman of the Duchy, an Adrian nobleman or an Citizen of Adria speaking under oath.

34. No man shall be seized without lawful cause shown, such cause being the crime was witnessed, clear signs of the crime or a sworn accusation naming the accused.

35. The accused shall be informed of the charge and the person by whose authority he is brought before judgement.

35.1. This shall not apply in matters of treason or war where secrecy is required for the safety of the Duchy.

36. In all matters of public or civil law, the burden of proof lies upon the accuser, who must establish guilt by all lawful means.

37. The accused shall be held in lawful custody and shall not be subjected to punishment before judgement is concluded, except where lawful immediate enforcement under Clause 47 is applied.

38. The accused may gather witnesses or oath-helpers and prepare their defence.

39. The Trial shall be presided over by the Judicial Duma or a judge lawfully appointed in its stead, when such tribunal has been convened by ducal authority.

41. The accused shall be entitled to sufficient food, water, and humane treatment to endure proceedings, and shall be protected from private vengeance or unlawful harm.

42. The accused may speak in defence, answer charges, or remain silent.

43. The accuser and accused shall be heard in turn.

44. No man shall be tried twice for the same offence, unless new treason, new blood, or new victims are revealed.

45. Upon judgment, the sentence shall be pronounced publicly and in accordance with the Code, lawful custom, or ducal command. The commended shall hear the sentence spoken aloud, and if to be executed, may receive last rites or prayer if of the True Faith, and shall be informed of the manner of punishment prior to execution.

46. Upon lawful execution of sentence, the matter shall be considered closed in law, and no further punishment or vengeance shall be taken for the same offence. 

47. Where a crime is directly witnessed by an Adrian Guardsman and guilt is beyond reasonable dispute, the Guardsman may enact immediate punishment in accordance with the lawful sentencing guidelines of the Code without the requirement of a Judicial Duma.

48. As is the right of the citizens, a Citizen of Adria may request the convening of a Judicial Duma if they believe themselves to be wrongfully accused. Such a request shall not suspend lawful enforcement or punishment already carried out by the Adrian Guard and may be reverted only if innocence is proven.

49. When a call for a Judicial Duma is made, the accused may be held in custody until the duke, or the Chancellor reviews the matter and determines whether a Judicial Duma shall be convened. If denied, enforcement and punishment shall proceed without delay.

50. A Judicial Duma shall not be convened for the purpose of delaying, avoiding, or obstructing lawful arrest, punishment or enforcement of the Code. That itself constitutes an offence of ‘Perjury’.

THE EIGHTH TENET

Civil Law
 

51. Citizens of Adria may bring civil actions against one another concerning matters of property, contract, injury, or other private dispute recognized under the Code.

52. Any contract or agreement entered into between Citizens of Adria shall only be recognized in law if it bears the mark and seal of a sworn official of the Duchy.

53. Contracts not formally witnessed or stamped shall hold no standing before the Judicial Duma or any lawful authority.

54. A sworn official shall not refuse reasonable certification of lawful agreements without cause shown.

55. Citizens of Adria are expected to act in good faith in all civil agreements and disputes, thus fraud, deception, or intentional misrepresentation in civil matters shall be treated as an offence under the Code.

56. Non-Citizens may be named as parties in civil disputes only where they have entered a lawful agreement with a Citizen of Adria, or where harm has occurred within Adrian territory.

57. Non-Citizens are not able to initiate civil proceedings except where expressly permitted by ducal authority.

THE NINTH TENET

Order and the Duke’s Peace

58. All territories, roads, bridges, fords, market spaces, and public gathering areas within the Duchy of Adria shall be held under the Peace of the Duke. 

59.  Any act of banditry, violence, robbery, coercion, or unlawful disruption committed within such places shall constitute as an offence against the Duke’s Peace.

60. Any act which causes widespread fear, disorder, panic, or disruption among the people of Adria shall constitute an offence against the Duke’s Peace.

61. Any act which seeks to undermine, erode, or destabilize Adrian identity, customs, or civic cohesion, or which incites hostility toward the same in a manner that disturbs public order within the Duchy, shall constitute an offence against the Duke’s Peace.

62. Any act which seeks to undermine, destabilize, or subvert the Church of the True Faith, or which attempts to force, coerce, or unlawfully induce conversion away from the True Faith, shall constitute as an offence against the Duke’s Peace.

63. It is the duty of all Citizens of Adria, the Adrian Guard and all sworn officials of the Duchy to do all within their reasonable capacity to preserve, uphold, and maintain the Duke’s Peace and prevent its breach.

64. Where the Duke’s Peace is broken in grave form, judgment shall be rendered with full weight of the Duchy’s authority, and punishment shall be carried out in a manner that leaves no doubt as to the consequences of such acts. Mercy, where granted, shall be an act of sovereign grace alone, and not a matter of entitlement or expectation.

The Baron looked down upon a copy of the document, pursing his lips as he read across the various laws. Most of them had been common sense within Adria prior, but some, some gave him pause. A singular finger fell to tap the surface of his smooth wooden desk.
