Trials are not to be carried out under any circumstances, the punishment is to be decided at the digression of the highest ranking officer in the vicinity, unless it is a kingdom crime, which shall be filed as: Murder, Treason, Vandalism, or the cutting of a dwarf’s beard, or similar to any of the previous four, but still the King, and only the King may mandate a trial for those who have committed excessive crime.Ranks described below receive no political standing above the average dwarf, they receive only the powers described and any added on as times goes on. The rank of Legion Head Guard shall be equivalent to a lieutenant.Any following information is still a part of the Guard's Codex. The bulk of the codex shall be the Guard's Law, a guide on Dwarven crime and punishment. The rest of the codex shall be the Guard's Codex Appendix and shall be considered law, as the Guard's Law will be.On Religious and Heretical Crime and PunishmentThe following paragraph is to clear up any concerns the Clergy may have of religious and heretical crimes, and is written by Ellsia Dawnsworn (Destroyer_Bravo).Religious and Heretical crimes shall be dealt with at the leisure of the Clergy, and all religious or heretical crimes, definition of religious and heretical crimes, fines for such religious and heretical crimes, etc. shall be handled by Archbishop Koryk and any successors to the current Archbishop at time of writing. The Legion is not to be involved in any religious or heretical crimes, as it is the business of the Clergy to bring justice to those who infringe on Clergy definition of religious and heretical law. The Legion is not to be forced into assistance of the Clergy unless absolutely necessary and if said heretic is either also a traitor (note not a heretic, as someone must be a traitor beyond the pretence of heretical actions) , murderer, vandal, or has cut a dwarf’s beard, or their own. Punishment is also to be decided by the Clergy, carried out by the Clergy, and not passed to the Legion. Religious and Heretical crime enforcement is to be done at the leisure of the Clergy, and any parties approved by such, and none other, unless the Clergy allows bounty hunters. The Legion should be informed of said heretical crimes and at least be informed of high tier punishments. The Legion should also be informed of known Heretics and inform the Clergy of any found Heretics to bring them to the Clergy.On Terms Of Fines and Dealing With SuchThe following paragraphs are to explain how fines function, and are to be paid in the Kingdom of Urguan when the codex goes into effect, and are written by Ellsia Dawnsworn (Destroyer_Bravo).The fining of individuals in the following crimes is to be carried out immediately at the time of sentencing, and if unpaid at said sentencing period, shall be put on hold for one (1) Dwarven year, with a mandatory addition of two-hundred fifty (250) minas to the previous fine. If this is not paid off within that time period, the additional mina fine shall stack until one thousand (1000) minas is reached, or a total of four (4) Dwarven years, or one (1) Elven month. After such a period of time the debt shall be put on hold, and all possessions of the accused shall be stripped. If this does not accumulate to the mina fine, with the additional lateness fines, then the remainder of the debt shall be worked off in service to the Kingdom of Urguan through either military service or mining services. Work condition shall not be upheld as strictly for those who have found themselves in this position. If the confiscated possessions accumulate to the mina fine, with the additional lateness fines, or exceeds it, the individual or party in which the fine was administered to shall be left alone past this point. The Dwarven Legion will work with the nations of others to receive goods stored there.Total fines will generally not exceed ten thousand (10,000) minas, except when fines accumulate to such, or select crimes. If multiple persons committed a crime, the fine shall be made three-fourths of what it is, but paid by any and all accused persons at any time convieniant, if it does not pass the lateness constraints. Generally, total fines for multiple persons not exceeding the number ten (10) shall not exceed one hundred thousand (100,000) minas. If over ten persons are accused of the same account of the same crime, they shall be considered a guild, regardless of if the accused’s affiliation with each other. Each accused person shall pay full fine in this case, and the group as a whole shall be charged with lateness fines, regardless of they have paid off their own debt. There is no limit to fines after a threshold of ten (10) persons is passed.Stop and FriskThe following paragraph is a guideline to guards and civilians on how to conduct themselves in a stop and frisk, and for guards to proceed properly, written by Nalro Greyhammer (TheNander).[Guard]: "Against the wall. Harassment must be obvious in order to be a criminal charge. False accounts of harassment shall NOT be tolerated. Using the charge of harassment as a way to falsely arrest an individual or group is unlawful, and will result in the criminal charge of fraud, plus the sentence of harassment placed upon you.Methods1. Party A continuously beats Party B for no legitimate self-defence reason2. Party A insults Party B to such an extreme extent that it is unacceptable3. Party A beats Party B with no legitimate self-defence reason, and verbally insults Party B to such an extreme extent that it is unacceptable.4. Party A threatens Party B into handing over the property.2. Party A strikes Party B knocking him out and claiming the object.3. Party A strikes Party B intending to kill and claims the object.4. Party A strikes Party B accidentally killing him/her and claims the object.Punishment: Return of stolen objects and five hundred mina fine.Exceptions: No exceptions for this crime can be noted or filed at this time. LarcenyThe act of theft committed through claiming the property without Party B knowing. Technically this is an "Against Property" crime, but is filed under theft for simplicity, and similarities with mugging. No confiscation of arrested party's property shall be tolerated, unless a fine is failed to be paid in full. In such a case the arrested party is to be informed of said property confiscation to avoid larceny accusations.Methods: Party A intentionally claims the object theirs without Party B knowingPunishment: Same as mugging.Exceptions: No exceptions for this crime can be noted or filed at this time. Any exceptions for this crime shall be noted here if decided on by the Lord’s Council and King. Such exceptions are unlikely to occur for a crime of this nature.Bail: Unavailable for Low Tier CrimeExtortionDescription: Extortion is the act of Party A charging Party B “protection money” for integrity of property, business, or otherwise. If extortion escalates to arson, vandalism, murder, or any such things, it shall be classified as such instead of extortion, but the extortion will be noted in punishment. Guards are not to extort criminals or they shall be treated as criminals themselves.Methods:1. Party A threatening to destroy or otherwise sabotage Party B’s business if a fine is not paid to Party B2. Such exceptions are unlikely to occur for a crime of this nature.Punishment:Five hundred mina fine, plus reimbursement of any funds gained from said account of extortion, if provableBail: Unavailable for Low Tier CrimeMedium TierBatteryDescription: The act of battery is the act of aggression through physical conflict and it is a common sight in Dwarven society due to the pride borne by each individual Dwarf. It is not uncommon that one word can initiate the likes of a brawl without the mentioning or following of the terms regarding a proper honor duel. The prelude to this crime is commonly a simple insult, assault or continuous harassment between two parties and thus it is important to prevent these scenarios from progressing into murder. This should also encompass riot starting and the like. You're allowed to attack civilians as a Legionnaire to quell a riot. Bottles of flaming liquid being thrown means weapons free.Methods:1. Party A striking Party B for a form of verbal revenge.2. Party A striking Party B due to being Stark Raving Mad.Exceptions:1. Honor duel has been initiated.2. Party A is retaliating to Party B’s assault.3. Party A is retaliating to Party B’s battery.4. KidnappingDescription: The act of abducting the likes of an individual by another party for many criminal reasons. This crime is often committed as a response or a form of initiating further criminal activity and must be dealt with immediately to insure the safety of the captive party. Kidnapping is only to be done with designated criminals and the Marshall's permission.Methods:1. Party A claim Party B through assault.2. Party A claims Party B through battery.3. Party A claims Party B through extortion.Exceptions:1. Legion operation to claim hostages in interest of the Kingdom and with permission by the King2. A young criminal’s arrest and removal from a guardian3. ManslaughterDescription: The act of manslaughter is the killing of an individual under these specific pretenses:An honor duel, not to the death, that ends in the opponent deadA killing of another individual under provocationAn involuntary murder by any forced magic, extortion, or otherwiseManslaughter carries a lighter sentence than murder, but barely so, as it is the highest-punishment medium tier crime. Forced torture of another individual will never be manslaughter.
