  6. HERITAGE AND HISTORY The Necessity of Records and Research Edict Issued by the Viceroyal Crown 15th of Maria’s Peace, 91 D.R. [!] A Hyspian scholar drafting a thesis on behalf of the Hyspian Historical Institute. Time is an expanding concept. It progresses but never ceases in its journey. As the path of time is ever endless and infinite, a traveler must diverge from it to rest, perhaps permanently. Yet, even so, time shall continue to move forward. However, the legacy one leaves behind must not be lost upon the road. Rather, it should be recovered, engraved and forever recorded for future generations to learn and discover. Hyspia is more than a nation. It is a culture, a culture which has blossomed for decades and centuries long before the rule of De Pelear, and long before the establishment of La Dorada. La Ciudad de la Plata is one such example. It was considered the last established home of the Hyspian people in Almaris. Before that it was Niseep. And much before that: Osanora, Tierra Natal, and further beyond. All such settlements have their own histories and their own legacies. The origins of the Hyspian people, its establishment as a united culture also deserves such a legacy to be recorded in the annals of history. Thus, it is through this decree that the Hyspian Historical Institute shall form. Its mission shall be to record the traditions of the Hyspian community. It shall be open to all Hyspians scholars and beyond to further record our history, our beliefs, and our culture for the future generations to learn and take advice from as they continue to grow our nation and let it blossom further. This institution, sponsored by the Crown, invites all Hyspians who wish to record and research the rich history of the Hyspian people. Through this institution, Hyspian scholars may publish their many works and pursue their academic intiuitions for the betterment of educating the public of our history. May we honor our past and embrace the future, together. Honrar el pasado. Abrazar el futuro. Viva Hyspia. The importance of the Viceroy is to ensure that justice is accessible to all. ---- The Rights and Duties of the Gran Canciller The rights and duties of the Gran Canciller are as follows: Act on behalf of the Viceroy in his absence; provide legal advice in accordance with the law; preside over trials in the absence of the Viceroy or Justiceiro; advise the Viceroy; uphold the law, ensuring fairness and justice and protection of the Viceroy’s interests. ---- The Rights and Duties of the Justiciero The Rights and duties of the Justiciero are as follows: Preside over trials by ensuring fair conduct in line with the law; interpret and apply the law; issue rulings; control court proceedings by ensuring fairness and impartiality; weigh and evaluate evidence; instruct lower judges; render judgments, sentencing, and remedies; record court proceedings; apply precedent and uphold the Law and the Viceroy’s interests. ---- Manorial Court of the Viceroyalty of Hyspia A manor court with a local judicial and administrative institution held by the Viceroy of Hyspia to settle disputes among the citizens of Hyspia. Decisions of this court are based on local customs and traditions, typically used with the purpose of local justices, land tenure and property matters, collecting dues and fees, administrative functions, enforcing customary law, mediating disputes and documenting trials. The Burden of Proof Burden of Proof is a fundamental principle in the legal system of the Viceroyalty of Hyspia, The Burden of Proof refers to the responsibility of a party in a legal dispute to provide sufficient evidence to establish their case. Different stands of Proof depend on the type of legal proceedings, detailed below. Civil and Criminal Cases apply to the Burden of Proof with different standards. In both criminal and civil cases, the plaintiff bears the burden of proving the defendant's guilt. In criminal cases, the prosecution must prove their case ‘beyond a reasonable doubt.’ This is the highest standard of proof in the legal system and means that the evidence must be so strong that there is no reasonable doubt about the defendant’s guilt. ‘Preponderance of the evidence’ is typically identified as the burden of proof. This means that the prosecutor must show that it is more likely than not that their claims are true. The evidence provided must be clear and convincing, especially so in cases of fraud or civil liberties. In cases of bigger crimes, this form of evidence may fall between the preponderance of the evidence and beyond a reasonable doubt standard, requiring a higher level of proof than standard civil burdens. The Legal Proceedings of Hyspia may employ legal presumptions that can affect the Burden of Proof. These are assumptions made by the court unless proven otherwise. The role of the Justiciero has a significant role in determining which party carries the Burden of Proof and instructing the Viceroy on the applicable standard of proof. The Justiciero’s responsibility is to evaluate the evidence presented and determine whether the Burden of Proof has been met. Consequences of failing to meet the Burden of Proof may be decided in favor of the opposing party. If requested, another trial may be presented or a Trial By Combat may be pleaded, but can be rejected by the Justiciero or Viceroy of Hyspia. Pre-Trial At the beginning of a trial, a case initiation will be instituted upon arrest or filed complaint of the accused. This will conduct a charging of the defendant and will initiate a lawsuit or prosecution. ---- The parties involved have the right to exchange pleadings. These documents outline the allegations and defenses in the case. ---- Both sides will engage in the discovery process, where they gather and exchange evidence. This will involve dispositions, interrogations, requests for documents, or other means of obtaining information. Other means may involve testing of darkspawn and other warrants of arrest from other cities. ---- Parties may file pre-trial motions to address legal issues or seek certain rulings from the court. These motions can include motions to dismiss, motions to limine or motions for summary judgment. ---- Parties often engage in settlement discussions or negotiations to resolve the case without going to trial. Settlement can occur at any time during the pretrial process. ---- Pre-trial conferences can be informal meetings between the presiding judge and the parties involved to discuss the status of the case. The judge may also address procedural matters and evidentiary issues. ---- Motions of Limine are requests that the judge exclude specific evidence from the trial, typically for legal or evidential reasons. ---- Preparing trial exhibits is not mandatory but is preferred for each party to prepare physical evidence, documents, and exhibits they intend to present at trial. These exhibits should be organized and labeled for easy reference during the trial. ---- Parties identify and prepare witnesses they plan to call at trial. Subpoenas may be issued to ensure the attendance of witnesses who may be reluctant to testify voluntarily. ---- Trial briefs will be conducted before the trial to help the presiding judge understand the case better. These will be outlining the legal and factual issues, arguments, and case law relevant to their positions. ---- Any unresolved pre-trial motions may be argued and decided by the Justiciero or Viceroy. Trial Opening Statements The plaintiff or prosecution will begin their opening statement that will be followed by the defense. During opening statements, each side provides an overview of their case and what they intend to prove. Presentation of Evidence The plaintiff of the prosecution presents their case by calling witnesses and introducing evidence. The evidence provided may include documents, exhibits, and witness testimonies. The defense has the opportunity to cross-examine the witness. Direct Examination The speaker presenting their case questions their own witnesses. The goal is to elicit information and testimony that supports their side of the case. Cross-Examination The opposing party’s speaker questions the witnesses called by the other side. The purpose is to challenge the witnesses’ credibility and the evidence presented. Rebuttal and Surrebuttal After the initial presentation of evidence, there may be a rebuttal phase where each side can call additional witnesses to respond to points made by the opposing side. Closing Arguments Once all the evidence has been presented, both parties make closing arguments. These must be summaries of the case and a final opportunity to persuade the judge or jury. The prosecution goes first, followed by the defense. Verdict Once the presiding judge reaches a verdict, a decision will be announced.. The verdict can be “guilty” or “not guilty.” This decision is based on the evidence presented and the law. If not enough substantial evidence is presented, a second trial or a request of a Trial by Combat may be put in motion. Post-Trial Motions After the verdict or decision, either party may file post-trial motions to challenge the outcome. These may include motions for a new trial or motions to set aside the verdict. Appeals Once the trial is over, either the prosecution or the defendant can appeal to the Viceroy, Justiciero, or Gran Canciller to take a second look at the trial. All citizens of Hyspia, and those prosecuted, are granted the privilege to Appeal. Appeals are not a new trial, and no new evidence can be submitted. Submitting Appeal To submit an Appeal for a trial, either the Prosecution or Defendant must submit a formal Letter of Appeal to the Viceroy, stating the reasoning for why an appeal should be heard. Those that submit appeals without proper grounds will be fined 50 mina. Preparing an Appellate Argument Before the actual in person oral Appeal, both the Prosecution and Defendant submit a written argument in which the sides lay out their side of the case. The Oral Argument After submitting the written arguments, the Viceroy, Gran Canciller, or Justiciero will summon both the Prosecution and Defendant to court, where the Appellate argument will begin. Both sides will plead their case. The Opinion of the Court A verdict will not be announced at the time of the oral argument. Rather, the Viceroy, Gran Canciller, and Justiciero will meet and vote on the outcome. The Viceroy or Gran Canciller will then write the formal opinion of the court, which can be published if the Viceroy sees it fit. If the vote is 2-1, the person in the minority of the vote may choose to write a dissenting opinion explaining their reasons for disagreeing. 5. The Verdict The Court of appeals, in their opinion, may: -Uphold, or affirm the decision of the Viceroy. -Reverse, or overturn the decision of the Viceroy. -Remand, or retry the case. 6. Closing. Once the Court of Appeals gives their verdict through their vote, the decision is final. Another Appeal cannot be made, and the decision of the Court of Appeals cannot be overruled. Sentencing A sentencing phase will occur where the Justiciero or Viceroy will determine the appropriate punishment. Type of Punishments will be the following determined based on the Justiciero or Viceroy. Corporal Punishment Capital Punishment Exile and Outlawry Mutilation Fines and Forfeiture Public Humiliation Imprisonment Trial By Combat Trial by Combat are only subjected if a trial has no proper verdict of the first trial. This may be requested in order to avoid a second trial; a judge or the Viceroy has a right to reject this request based on their own jurisdiction. Combatants will be a Champion chosen by the Viceroy or the prosecutor and the accused. A divine judgment based on the belief that GODAN would favor the innocent or just party and grand them victory in battle. A trial conducted in the presence of clergy and legal authorities, who would oversee the proceedings. Outcome will determine the guilt or innocence of the accused. If a combatant is incapacitated or yields, it is considered a judgment in favor of the opposing party. If both combatants are severely injured or killed, the case may be considered inconclusive and alternative legal methods may be employed. 16. LA DORADA Our Golden Home Issued by the Viceroyal Crown Second of Godfrey's Triumph, S.A. 150 El Estado Dorado [!] La Ciudad de La Dorada, portrayed under a setting sky. “What does it mean to be a Hyspian?” Is it the pride in our language? Or is it our shared preferences in the beauty of warm climates and vibrant colors? What unites us? Is it our shared canonist faith? Or our love for passionate music, poetry, and theater? The culture of Hyspia has been established since its origins. It has been built upon, expanded, and practiced to the extent of which the term “Hyspian” signifies more than just a culture, but a nationality. Whether it be the celebration of Dia de Los Muertos or an event of La Torea, Hyspia never ceases to create a lively atmosphere; one where men, women and children can enjoy the spirited yet lively music and theater, the passionate sermons of their canonist faith, and the encouragement of pride not for themselves but for the collective community as a whole. To be Hyspian means to be Persistent. To be Hyspian means to be Passionate. To be Hyspian means to be Proud. “That is what it means to be a Hyspian.” For years we have been separated, scattered, and quelled throughout the corners of this continent. However, it is our collective faith and identity that has kept our culture intact. Our persistence is what kept our dream of an independent home alive. Now, we can be united once more as we settle upon our new homeland. United in our cause for common identity. Upon this day, the grand city of Hyspia has reached its completion. It brings the Crown of Hyspia great pleasure to share the growth and progress of our state. With dedication, dutiful planning, and execution of the Grand City. Our people have named our bastion of Hyspian civilization “La Dorada”, a different take on "El Dorado". La Dorada, a name to honor the motherland as the “Golden City”. Our home truly is golden. Its luster shall never fade. The culture of our golden Hyspia shall forever be polished and expanded. Together, as we unite, protection shall be guaranteed. Now we can live together under the safety of our own people. Free from all oppression. With the naming of our city and the unification of our people, the Crown proclaims that prosperous years will now follow for all Hyspians. We shall welcome all with open arms. May DIOS guide our people as they find their way to the homeland. VIVA HYSPIA Signed, HIS HIGHNESS, Cesar II de Pelear, Viceroy of Hyspia, Duke of Pacazu, Baron of Arenisca and Del’mar, Lord of La Dorada, Lord of Niseep, Gereon's Hold, and Ciudad de Plata, Protector of the Hyspian People and Patriarch of House de Pelear HER HIGHNESS, Karyna Rezalin de Pelear, Vicereine of Hyspia, Duchess-Consort of Pacazu, Baroness-Consort of Arenisca, Lady of La Dorada, Lady of Niseep, Gereon's Hold, and Ciudad de Plata, Protector of the Hyspian People and Matriarch of House de Pelear HER HIGHNESS, Ramona de Pelear, Crown Princesa of Hyspia, Duchess of Paraíso
  17. EL REGIMIENTO DE HYSPIA The Viceroy's Own Volunteers Issued by the Viceroyal Crown 2nd of Owyn’s Light, 150 S.A. Prelude [!] The Hyspian Regiment preparing for battle The question of a nation’s survival and the defense of its homeland must be answered by its ability to protect itself. That ability is resonant in its people. Countless tales enumerate the brave Hyspians of yore who have laid down their lives in defense of their culture. The Hyspian Regiment is a product of that historical passion for the Hyspian cause. That passion shall be honed and refined to preserve and protect the freedom of Hyspia’s Crown and her people. After many years of reliance on the Crown of Haenseti-Ruska for the protection of her people, it has now become imperative for Hyspia to take up her own arms once again. Therefore, it is by decree of the Viceroyal Crown to introduce a reformation and reorganization of the armed forces into an unyielding structure; to be used as a model for the rest of Hyspia’s continued existence. The Duties of the Regiment [!] A Hyspian Soldier preparing for patrol The duties of a soldier of the Crown are numerous. The main duties affirmed are: to protect the people, bring honor to the Crown, and to achieve personal glory on and off the battlefield. Soldiers are expected to act in a manner that reflects the Regiment’s moral code, whilst never violating the basic moralities that a soldier may hold. Every man and woman that serves in the military is expected to keep a strong ethical code and follow orders only when they are morally sound. With martial prestige as a soldier comes martial responsibility. The regiment requires its soldiers to participate in intense training to ensure only the most disciplined and skilled are representing the nation. Every soldier is trained to follow orders in combat and any violation of this could result in loss of pay, or even loss of rank depending on the severity of the situation. Actions such as supporting an enemy of Hyspia, or an enemy of Canonism as a whole will result in an immediate court martial, loss of pay and rank, and possible blacklist from the Regiment if found guilty. Oath and Traditions [!]A depiction of an oathing ceremony The Regiment relies on three tenets of faith and loyalty to demonstrate exemplary comradery amongst its members. All soldiers must abide by the three core tenets. “Respect thy faith and thy dignity. An insult to a Hyspian is an insult to all. Follow thy Oath and never stray afar.” To be Oathed is a centuries old tradition in which each member is tested upon their personal becoming. To truly be an asset and of sound prestige within the Regiment, each recruited member must face a fully grown bull in the ring. In the event however that they have proven themselves through heroism or displayed their steadfast loyalty in the protection of Hyspia, they may be exempted. Once an initiated guardsmen has taken on the bull they are then moved on to the duel. Only the upper ranks of the Regiment may conduct the oath. With this in mind the initiate in testing will be expected to duel an upper ranking member of the army. To win or lose is less valuable than the true purpose of this test: to see where the skill sets of the recruit lies. A true testing and show of strength however may lead to a quicker promotion. It is at the will of the Viceroyarch or the Colonel to decide such. The Oath “I, _____, do solemny swear to uphold the honor, integrity, and stability of the Hyspian Crown. I shall uphold the Laws of Hyspia, uphold the three main tenets, perform my duties to the best of my ability, and I shall protect the Viceroyal Family and all Citizens of Hyspia.” Releasement of Position, and Traitorous Actions [!] A depiction of the execution of a traitor At the top of the relinquishment of position is retirement. Once a member of the Regiment has reached a point where they no longer intend to be of service to the nation’s ranks, be that of age, different interest, or new achievements directly conflicting the enlistment of the soldier. They may formally request to be retired from their position in the Hyspian Regiment. However, there are times where the expulsion of a member is necessary. Note that not all leaving of ranks and brotherhood should be an ordeal leading to execution or exile. In a few cases, however dire, one may be requested of honorable medical discharge. Such honorable discharges are few and restricted. An example of a medical discharge may be accredited to permanent disablement. Though that not being the only reason one may be honorably discharged, it is left to the higher ranking officials to decide. Nevertheless, members of the military who retire or are honorably discharged shall always be respected and celebrated for their faithful contributions and steadfast loyalty to Hyspia. Opposite to an honorable discharge is a dishonorable discharge, in which one shows infidelity, thievery, or illegal actions. A fairly simple one as the former member of the Regiment is expected to be tossed away into a grim cell for a set time as the judge or Viceroyarch sees fit. The latter scenario, however, is far less of a punishment in comparison to a member who has been labeled a traitor. Such examples are: one who has fled the ranks, or worse gone to a foreign ranks in an attempt to sabotage the Regiment. The only suitable punishment for such would be a public execution. The Ranks and Roles [!] Painted in traditional order of ranking leaders The Regiment is divided into vertical cohorts. The titles and responsibilities of each rank have been engraved in Hyspian martial traditions since the unification of the Hyspian people. In honor of the Hyspian culture, the ranks reflect the rich history of Hyspia’s martial prowess. General The honorary title belongs to the Viceroyarch of Hyspia. Traditionally serving as the head of the military and commander of the troops. The military is at the Viceroyarch’s command. Colonel The highest authority in the practical chain of command, second in official rank to only the Viceroy. The main job of this position is to ensure the Regiment’s combat readiness and continued function at all times. Lieutenant The second in command of the Regiment. Whoever holds this position shall be in charge of ensuring the proper training of soldiers and overseeing events, taking charge only when necessary. Cabo The main corps of event hosts, Cabo are soldiers who have proven themselves capable enough to lead events such as training, patrols, and day to day duties such as rallying troops to respond to situations. Gaucho A fully oathed soldier of the crown. Proven themselves worthy in a multitude of combat and non combat situations. The main corps of veteran soldiers will be this rank. Soldado Freshly recruited soldiers of the crown, these men and women have yet to prove themselves, but are on the path. They have the crown's authority, but still need the proper training in order to be a true soldier. Milicia Citizen soldiers, an auxiliary corps rallying to defend the nation if called upon. No formal training necessary. Enlistment [!] Painted depiction of fresh recruits on a patrol Prior to enlistment, one must satisfy the minimum prerequisites required for admission: I. One must be at least thirteen summers old. II. One must be a Hyspian citizen. III. One must be of able mind and body. If all prerequisites are satisfied then the candidate may be admitted into the Regiment at the Colonel or Viceroyarch’s discretion. To defend one’s home and nation is a right that all Hyspians shall hold. The Regiment shall be the main force of resistance against all oppressive forces that seek to bring woe to our nation. May DIOS keep Hyspia and her people, ever steadfast and determined in their right to exist. Viva Hyspia! Signed, HIS HIGHNESS, Cesar II de Pelear, Viceroy of Hyspia, Duke of Pacazu, Baron of Arenisca and Del’mar, Lord of Ladorada, Lord of Niseep, Gereon's Hold, and Ciudad de Plata, Protector of the Hyspian People, Patriarch of House de Pelear HER HIGHNESS, Ramona de Pelear, Crown Princesa of Hyspia, Duchess of Paraiso HIS EXCELLENCY, Señor Jose Fuentes, The Colonel of Hyspia, Commander of the Third Regiment

  19. AN OFFER OF REFUGE Issued by the Viceroyalty of Hyspia From the sands of the south to the snows of the north, War has ignited throughout the lands we call home. Brothers slay each other, Fathers disown Sons, Children are torn from parents, and the Holy Mother Church's pleas remain largely ignored. The Canonist domains of Oren, Haense, and Balian have decided that their differences are no longer solvable through finding common ground, and once again have turned to slaying their fellow Canonist bretheren. As our domain itself is one of the Faith, and one that seeks to avoid bloodshed with fellow Canonists, our Vicroyal Crown aches as we hear of the tumultuous situation of this Coalition War unfold. It is thereby expected that our Viceroyal Crown declares full neutrality in this ongoing war of nations. Our Viceroyal Army shall not set foot on fellow Canonist soil to cause harm to our brethren, nor shall we wish to defy the Pontiff's pleas for peace. Instead, We offer this to all Canonist Denizens of Almaris affected by this brutal war; refuge. The Viceroyalty shall allow any and all Canonists fleeing from the war to shelter within our borders until the end of the conflict, so long as they do not disrespect our local laws. All refugees shall be given food and water, and will be allowed to purchase a residence within our Capital of Niseep should they wish to do so. Let it be known that any refugees who are of the Canonist faith and intend to follow our local laws shall be under the protection of the Viceroyalty. However, we shall reiterate that the Viceroyalty is a neutral party in this conflict, and we shall not shelter known criminals or refuse to extradite them should proper evidence be brought to our Viceroyal Crown for examination. We shall not allow any foreign armies or groups of soldiers to station themselves within our borders with the sole exception of Holy Knights or other Church-sanctioned forces, and should any belligerent army attack our domain it shall be seen as a declaration of war. We urge the Canonist rulers involved in this Coalition war to once again consider peace, and to come to a common ground so that the lives of our fellow Canonist kin may be spared. To His Holiness Tylos III, our Viceroyal crown commends your attempts to make peace between the warring Canonist domains, and shall remain faithful to the Holy Mother Church. Should our Viceroyal services be required, we encourage contact between the Holy Mother Church and our Viceroyal Crown. Signed, His Highness, Cesar Monet-de Pelear, Viceroy of Hyspia, Lord of Niseep and Gereon’s Hold Cesar Monet-De Pelear
