Algoda 885 Share Posted January 4, 2017 The Reformed Third Grand Kingdom of Urguan: Administrative and Conciliatory Faculties Article One The Obsidian Throne, the Grand King and Regency Provision A: Capacities of the Grand King The Grand King of Urguan is elected by his people as the sole and sovereign ruler of the The Grand Kingdom of Urguan. As such, the Grand King as head of state, is vested with the following powers: The Grand King of Urguan shall be the ultimate authority on all matters regarding the Grand Kingdom of Urguan (or any entities stemming from that kingdom). All decisions regarding the social, political, economic, and military nature of the Grand Kingdom of Urguan shall be approved by the Grand King, and depend on his approval to be enacted in any form. The Grand King of Urguan has the power of the regal veto. The Grand King of Urguan can overturn any actions or decisions made by any other administrative branch of the Grand Kingdom of Urguan. The Grand King’s veto can be overturned if ⅘ of the Senate of Hammers votes to overturn through Senatorial veto. The Grand King may enact any legislative changes to the articles without approval of the senate, all changes must be documented through public mandates. The Grand King is not obliged to heed any petitions or referendums put forth by the people of the Grand Kingdom of Urguan, but should holistically take them into account nonetheless. Only in the event of a referendum detailing the removal of the Grand King from office, shall The Grand King be obliged to heed its outcome. In the event of which, the Senate will take appropriate action to appoint a regency whom oversees the election of a new Grand King. The Grand King of Urguan shall have absolute authority over foreign policy, including but not limited to decisions regarding war, peace, the terms of both, and all matters of diplomacy. The Grand King of Urguan is encouraged to convene with his council over the terms on which war is declared, but retains full power over all foreign policy. The Grand King holds full dominion on whom occupies the Upper Council. He may appoint and dispose of whomever he deems fit to occupy the Upper Council. He holds absolute authority over how the Upper Council operates its individual stratums. The Grand King of Urguan reserves the right to amend the duties of any positions on the Upper Council, and to amend the duties and powers of the Senate of Hammers. Only the ⅘ majority Senatorial veto is unamendable by the Grand King. The Grand King may not create positions supplementary to the trilogy of those on the Upper Council, he may only appoint Courtiers to oversee and aid in the running of its individual stratums. The Grand King is vested with the power to create and appoint courtiers; supplementary positions in which the Grand King can delegate certain duties to aid in his governing of the Grand Kingdom. Whilst mainly advisory, Courtier positions occupy the King’s personal council, and may act through any powers the King has enacted up on them. The Grand King of Urguan reserves the right to order evictions and seizures of property. He also reserves the right to partition land to vassals and to sell the land of the Grand Kingdom of Urguan. The Grand King of Urguan reserves the right to order executions, banishments, and beard-shearings. The Grand King of Urguan also reserves the right to mobilize the Legion at his own will. The Grand King will act as a high Magistrate in judicial proceedings. Provision B: Prohibitions and Restrictions of the Grand King The Grand King of Urguan must be a pure Dwarf. His blood must be wholly that of a Dwarf. The Grand King may never be a half-breed, quarter-breed, eighth-breed, and so on and so forth. None of his ancestors will be anything but pure dwarves. The Grand King may never be of the Ironborn bloodline. The Grand King of Urguan must believe in the Brathmordakin. A candidate for Grand King of Urguan must have been part of dwarven society for a total of at least 20 years / 2 seasons/ 5 stone months. Provision C: Electing the Grand King Elections are held after the death, resignation or removal of the Grand King. Nominations should begin within the stone day of the King's departure, aiming to conclude within a stone week. Candidates are nominated by the incumbent Senate clans. After a period of no less than three stone days from the point of opening, nominations shall close. From that point, another three stone days shall pass before a final vote is taken from each clan. Clans are required to convene with members of their own conglomerate and consider their kinsmen’s positioning on each of the candidates. The majority vote will crown a King, other candidates may not cede their own votes and give them to another candidate. Once a Clan has voted, they may not changed their vote, regardless of whether their own candidate has failed. Provision D: Regarding the Powers of Regency Without a head of state, a Regent is chosen by the senate to act as a temporary head of state. The regent simply holds office to oversee the smooth transition of Kingship. He holds no power other than the following duties entrusted in. A Regent is appointed in the circumstance of the Grand Kingdom having no current head of state. Their sole purpose overseeing of an election, ensuring it is done successfully and quickly. The Regent holds no regal, executive or legislative power. The Regent cannot make alterations to the articles, such is considered an act of illegality. The Regent may only negotiate foreign policy in extreme circumstances, all diplomacy handled by the regent may be voided by the King upon election. The Regent may not use its temporary status as head of state to gain political power within the Grand Kingdom of Urguan. An incumbent Regent may not nominate or be nominated for Grand King. Article Two The Upper Council and its Prohibitions Provision A: Positions of the Upper Council The Upper Council refers to the mandatory heads of the militaristic, judicio-infrastructural and industrial-economic stratums of Dwarven government. Whilst the positions are permanent, those who fill them are at the will of the Grand King of Urguan and are appointed/disposed on his authority. The Grand King may not create upper council roles, but can appoint courtiers to aid and oversee the three heads. Seneschal - The Seneschal shall oversee the income of Mina in to Urguan’s treasury. Matters of stewardship and tax will be given to the Seneschal and his appointed Stewards, the Seneschal will also act as a prosecutor in events of illegality. The exact duties of the Seneschal are as follows: To maintain the resolve of residency and taxation throughout Urguan’s lands. To monitor use of land within the Kingdom, ensuring vassals are fairly taxed. Recording all taxation of Urguan efficiently and clearly. Giving true accounts of Kingdom funds, making financial statements to the King. Enforcing legal evictions in appropriate circumstances. To order arrests with probable cause. To order search and seizures with probable cause. To administrate cease and desist orders with probable cause. To sequestrate private property with probable cause. To deal with any political functions attributed onto him by the Grand King. To oversee trade with other polities. To ensure Urguan’s economy is maintained and in working order. *All actions taken by the seneshal must be filtered by the Regal Approval Yemekars Pick - Yemekars Pick shall be responsible for maintaining the vigor of dwarven industry, managing production and bolstering the Kingdom’s coffers. Whilst maintaining functional and aesthetic infrastructure, the Yemekars Pick is integral to the war effort. The exact duties of the Yemekars pick are as follows: To preside over the Guild Bureau system AND THEREFORE TO Award guild status to groups of ample skill and ample membership. Collect quotas from said guilds Provide proportional government subsidies to effective guilds Provide lodgings for deserving guilds To initiate government programs in order to bolster kingdom stockpiles. Along with the Seneshal, to initiate trade with other entities. To maintain the architectural standard of Urguan by monitoring Kingdom lands for buildings violating regulations. To maintain a steady flow of material wealth income. To preside over technological and industrial advancement. To deal with any economic and infrastructural functions attributed onto him by the Grand King. *All actions taken by the Yemekars pick must be filtered by the Regal Approval Grand Marshal - The Grand Marshal shall be the spearhead of Urguan’s military, maintaining and training an effective fighting force capable of leading incursions during times of war. The Grand Marshal must maintain order throughout the kingdom, police the lands of Urguan, and ensure the safety of its peoples. His exact duties shall be as follows: To maintain order and peace during times of peace in the Kingdom. To appoint and maintain the Legion of Urguan. To advise the Grand King on the nature of waging war. To lead incursions into enemy territory. To govern and organize conquered territories. To create and maintain an active policing force in the Kingdom. To carry out executions. To incarcerate criminals. To deal with any militaristic functions otherwise not specified and attributed onto him by the Grand King. Provision B: Prohibitions and Restrictions of the Upper Council The Upper Council may not create new Upper Council positions. The Upper Council may not implement any measures without Regal Approval. The Upper Council may not overthrow or attempt to overthrow the King. They may not undermine the King’s power. The Upper Council is strictly prohibited from acting outside their bounds by disobeying the Grand King in any way that might threaten his absolute sovereignty over the Grand Kingdom of Urguan. No member of the Upper Council may encroach upon the authority of the Grand King of Urguan. Such encroachment includes: Making and implementing decisions without a Regal Approval. Violating the Regal Veto without a 4/5ths majority in the Senate of Hammers. Acting in a way that compromises the King’s sovereignty. All members of the Upper Council shall be discharged once the King that has appointed them has left office. ****All autonomous or semi-autonomous actions of the Upper Council, from simple arrests to court cases, MUST FIRST OBTAIN A REGAL APPROVAL.This carries the connotation that no actions can be taken by members of the Upper council without asking the king. Article Three The Senate of Hammers and Senatorial Selection Provision A: Powers of the Senate Consisting of representatives from the Kingdom’s five most prominent Clans, the Senate shall be the King’s direct council from the peoples of Urguan. Whilst the Senate holds the power of veto, it is a predominantly an advisory panel. The Senate of Hammers shall have the right of exercising a senatorial veto with a ⅘ majority. The Senate of Hammer may initiate an advisory referendum with a ⅖ majority. With ⅘ majority, the Senate of Hammers can initiate a binding referendum to remove the Grand King. A successful ousting requires above 60% of the Kingdom’s vote. The Senate of Hammers reserves the right to appoint a Regent in the event the Kingdom is void of a head of state. The Senate of Hammers must congregate at least once a stone month to convene with the King. Provision B: Prohibitions and Restrictions of the Senate of Hammers The Senate of Hammers may not vote to increase its power over the Grand Kingdom of Urguan. The Senate of Hammers is simply advisory, it holds absolutely no executive, judiciary or legislative power. Any suggested legislative changes must be presented to the King, and only enacted under his approval. The Senate of Hammers may not vote to to dispose of a King without a referendum. The Senate of Hammers may not be used as a tool to disintegrate the Grand Kingdom of Urguan. Provision C: Citizenship and Senatorial Selection The Senate is comprised of five Clans, each with a single representative. In order to fairly distribute these positions to the most active and prominent clans, every Dwed is encouraged to apply for citizenship. Of the pool of legal citizens, the five Clans with the most documented members shall be the incumbent Senators. Citizenship will be accepted at all times. Every two stone weeks, registered members will be counted and Senator positions established. To be considered an active member of a Clan, a Citizen should for, at least 3 stone hours per week, show activity within the Kingdom’s capital. Senatorial positions are determined through activity not status, they are temperamental. No Clans can establish permanent features within the Senate. Additional Points * There shall be Ambassadors of the Grand Kingdom of Urguan. These ambassadors shall be appointed by the Grand King of Urguan. These ambassadors shall be qualified members of Dwarven society that have been part of Dwarven society for a minimum of 52 years/ ~8 seasons/ One stone year. These Ambassadors shall be subsidized by the GRAND KINGDOM OF URGUAN These Ambassadors shall serve as diplomatic proxies to the GRAND KINGDOM OF URGUAN by relaying messages received from the King These Ambassadors shall lack the power to make decisions on behalf of Urguan These Ambassadors shall lack the power to improvise negotiations not specifically ordered of them by the GRAND KINGDOM OF URGUAN ** Da Kirkja Dverga shall be an autonomous entity outside the grips of mortal government. Its holdings shall never be taxed. Prophets for the Kirkja Dverga shall maintain legal immunity. Any official with the Kingdom and otherwise sovereign entities, lose their autonomy if convicted of wrongdoing through regal decision and the correct judicial proceedings. Therefore, the King may legally condemn and, in the eyes of Urguan, remove any figurehead, leader or official. **On the Definition of Probable Cause Probable cause shall be defined as a series of two or more tangible, verifiable facts that prove a criminal suspicion. In the case of politics, the suspicion is defined as one of lack of efficiency or violation of the Articles of Urguan and the charter of power described above.
