I.Rights of citizens

 

I.I  Right to live*:

Every being has the right to live, to be protected against death, be it at the hands of others or of sickness and morality.

It is the duty of the state to defend the well-being of her subjects and visitors within the Principality of Vitenna within her borders, but not limited to her borders**.

 

*= Exceptions to this may be made by the sovereign or lord of justice if the said person, performed criminal acts on the third degree.

 **= May the said person be trialed in another settlement outside the lands of Vitenna for crimes comitted there, this law is still eligible unless permission is given by the sovereign or lord of justice in an official document.

 

I.II Freedom from torment*:

A person within the Vitenna lands has a right to deny and resist any form of abuse, whether it be physical or mental.

Those caught participating in such activities are punished by the degree of infliction upon their victims within the lands of Vitenna, but not limited to her borders**.

 

*= Exceptions to this may be made by the sovereign or lord of justice if the said person, performed criminal acts on the second or highest degree.

**=May the said person be trialed in another settlement outside the lands of Vitenna for crimes comitted there, this law is still eligible unless permission is given by the sovereign or lord of justice in an official document.

 

 

I.III Protection from discrimination:

Citizens and foreigners of Vitenna are protected by the law from discrimination, be it for culture, race, language, colour or political opinion. Those whom are found breaking such an act within the borders of Vitenna shall be tried before the court of Justice.

 

 

I.IV. Freedom of religion:

Those whom reside and/or are visiting the lands have the right to worship and practice their own religion, as long as their beliefs do not obstruct others from practising their own. 

 

I.V Right to trial:

Any person has the right to demand a trial against those they deem to have committed a crime or those accused to breaking the laws,

thus to be judged under the eyes of the laws.

 

 

I.VI No punishment without a just trial:

Those whom are accused of breaking the laws of the Vitenna state shall not be held guilty of any criminal offence under the princely law at the time it has been committed. Nor shall a heavier penalty be imposed than the one that was applicable at the time the offence was committed. 

 

I.VII Right to own weapons*

Every citizen of Vitenna holds the right to hold weapons to protect themselves from others and monsters*

 

*=The right to hold weapons may be taken away temporarily or permanently by order of the sovereign of Vitenna or lord of Justice.

 


 

 II.Degree of crimes and punishments

 

II.I Crimes of the first degree:

Crimes of the first degree are of the least severity, they are considered minor transgressions that are punishable only by pecuniary fines, temporarily lasting removement from the Principality of Vitenna, removal of the right to hold weapons temporarily or permanently or a sentence of jail up to three saint hours.

 

II.II Crimes of the second degree:

Crimes of the second degree are of medium severity, these are punishable by pecuniary fines, temporarily or permanently removement from the Principality of Vitenna, removal of the right to hold weapons temporarily or permanently or a sentence of jail up to three saint hours. In some cases torment may be used as a form of punishment, altough it is uncommon.

 

II.III Crimes of the third degree:

Crimes of the third degree are of the highest severity, these are punishable by the punishments of the first and second degree, but may also result into the removal of the right to life, or total reposssession of assets, titles, peerages and honourable titles.

 

II.IV Crimes of the fourth degree:

Crimes of the fourth degrees are scholar crimes or fraud crimes, these include the evasion of tax, evasion of fines and the evasion of official documents with warning or eviction notices.

These crimes may be punished by the permanently removement from the Principality of Vitenna, or the removal of property, assets and titles.

 


 

III.Crimes against the state

These are acts in which destabilize the order and justice of the state itself.

These crimes are generally aimed at inflicting damage, or undermining the function and role of government or the commonwealth, whether it be from domestic or foreign offences.

 

III.I Bribery

II.I If a person attempts / succeeds to involve themselves in the act of dishonestly persuading another person to act in one’s favour, using a gift of money or other inducement. 

II.II  If the person attempts / succeeds to involve themselves in the act of dishonestly  persuading several persons ( 1-3), a soldier, or foreign officials to act in one's favour, using a gift of money or other inducement.

II.III If the persona attempts/ succeeds to involve themselves in the act of dishonestly persuading government officials, several persons ( 3+), several soldiers ( 2+) or the crown to act in one's favour, using a gift of money or other inducement.

 

III.II Exortion

II.I When an individual purposely threatens another individual to obtain something, through force or threats. 

II.IIWhen an individual purposely threatens several invidivuals ( 1-3 ), foreign officials, or a soldier to obtain something, through force or threats.

II.III When an individual purposely threathens several indivuals ( 3+ ), government officials, several soldiers ( 2+) or the crown to obtain something, through force or threats.

 

III.III Obstruction

II.I The attempts / succeeding to interfere, hinder or obstruct the work of  any individual.

II.II The attempts / succeeding  to interfere, hinder or obstruct the work of government officials within, and outside Vitenna.

II.III When the obstruction withholds justice. This includes lying or providing false information in the face of the law, or unwilling to co-operate in an investigation/trial. 

 

III.IV Propaganda:

II.I When a person spreads rumours, ideas or information meant to weaken or harm individuals within the state.

II.II If the target in concern is a government official or crown. Such an offence can be further elevated to treason if the circumstances are extreme.

 

III.V Smuggling:

II.I When a person unintentionally transports illegal or unauthorized items within the Principality of Vitenna. 

II.II If a person intentionally transports illegal or unauthorized items within the Principality of Vitenna.

II.III If a person intentionally transports illegal or unauthorized items withing the Principality of Vitenna, ment to do harm to others.

 

III.V Tax / Fine evasion:

II.IV When a person intentionally does not pay their tax or fine and previous warnings has been given

II.IV If a person intentionally ignores official warnings and eviction notices

 


 

IV.Crimes against the person

These crimes break the rights of a person in Vitenna or are a crime against the person. These are crimes which a person directly harms another, whether intentionally or unintentionally, and can be violent or nonviolent.

Each criminal act is categorized into levels of severity, marked as crimes by degree. 

 

IV.I Murder:

II.I If the individual breaks or attempts to break the right to live, unintentionally or without prior consideration of one person.

II.II If the individual breaks  or attempts to break  the right to live, intentionally of one person, or of several persons unintentionally or without prior consideration of several persons ( 2+ ).

II.III If the individual breaks  or attempts to break the right to live of a government offical,crown or guard intentionally or unintentionally, or several persons from the commonwealth intentionally (2+). 

 

IV.II Assault:

II.I If the individual breaks or  attempts to break the right of freedom from torment, unintentionally  without prior consideration of one person.

II.II If the individual breaks or the right of freedom from torment, intentionally of one person, or of several persons unintentionally without prior consideration of several persons ( 2+ )

II.III If the individual breaks or  attempts to break  the right of freedom from torment, intentionally or unintentionally of a government official, crown or guard, or several persons of the commonwealth ( 2+ )

 

IV.III Discrimination:

II.I If the individual breaks or attempts to break the protection of discrimination of one individual.

II.II If the individual breaks or attempts to break the protection of discrimination of several individuals ( 1-3) , or of a government official.

II.III If the individual breaks or attempts to break the protection of discrimination of several individuals ( 3+ ), or of several government officials/crown.

 

IV.IV Obstruction of religion:

II.I If the individual obstructs or attempts to obstruct the rituals or prayers of a single individual

II.II If the individual obstructs or attempts to obstruct the rituals or prayers of several individuals ( 1-3 ), or of someone of the clergy.

II.III If the individual obstructs or attempts to obstruct the rituals or prayers of several individuals ( 3+), or of someone of the clergy, or if the indivual performs or attempts to perform hate crimes against a certain religion or its follower.

 

IV.V Theft:

II.I When a person steals another’s possessions(s) without intent and without prior consideration. 

II.II. If a person steals or attempts to steal someone’s possessions(s) intentionally, and with prior criminal consideration.

II.III If a person steals or  attempts to steal the possesions of several people ( 2+) , or of the crown with prior criminal consideration.

 

IV.VI Kidnapping:

II.I If a person restrains or abducts another, without resulting in physical, emotional, mental or sexual harm.

II.II When the act of abduction causes the victim physical, mental or sexual harm.

II.III Under the condition that there are multiple victims, regardless of their state of health.

 

IV.VII Impersonation

II.I The act of assuming the identity of another, without devious intent. 

II.III When the assumed identity is that of a government official, the crown or a person of any form of military standing with or without devious intent, or the act of assuming the idenity of someone from the commonwealth with devious intent. This can also be elevated to treason.

 


 

V.Crimes against Property

Offences relating to the damaging of assets belonging to others or the crown. The Dual State of Vitenna enforces responsibility upon those that commit such a crime and ensures the protection of assets by considering them an extension of a person. 

 

V.I Arson

II.I The targeted destruction of any person’s property through the use of fire, if done unintentionally and without proper consideration.

II.II The targeted destruction of several person's property through the use of fire ( 1-3 ), intentionally or unintentionally.

II.III The targeted destruction of several person's property ( 3+), the property of The Dual State of Vitenna or the crown through the use of fire  intentionally or  unintentionally.

 

V.II Vandalism

II.I The act of damaging, defacing or destroying  a person’s property unintentionally and without previous consideration.

II.II The act of damaging, defacing or destroying a person’s property with criminal intent.

II.III The act of damaging defacing or destroying several persons property ( 2+ ) , The Dual State of Vitenna's property or the crown's property intentionally or unintentionally.

II.IV The act of damaging or changing the exterior of your property without permission of the honourable, high stewards approval in a written document.

 

V.III Trespassing

II.I The act of violating private property, when a person enters the property of another without prior permission from the owner.

II.II When trepassing happend on property owned by the Dual State of Vitenna, houses of guards, houses of government officials. This includes walls and other such features that are inherently valuable in securing the defence of the principality such as, but not limited to rooftops.

II.III If the trespassed grounds are that of the crown.

 


 

VI.Crimes against the crown or dual state governance of Vitenna

Criminal acts which directly violate the authority or trust of the sovereign. These laws enforce the responsibilities held by all individuals in society, regardless of class, to ensure their loyalty to the Crown and therefore the subjects of the Principality. The orders of severity for crimes against the crown are relatively much higher than any other form of crime. This is matched accordingly with far tougher punishments, which will be decided only by the Sovereign.

 

VI.I Treason

II.I Under the circumstances that a person breaks the trust of the crown or the dual state governance of Vitenna, through the breaking of an oath, or other such grievous misdeeds that betrays their allegiance to the state and crown such as, but not limited to signed documents.

II.II When a person extends as far as to threaten the crown or dual state governance of Vitenna in any manner. Acts of aggression and rebellion, including improper claimancy for the crown are deemed as threats. This includes plots to remove the head of state, or the act of aggressively pursuing to tarnish the crown and its bearer, in lieu of destabilising the integrity of the state.

II.III The sum of all previous factors in culmination of several folds.
