Marriage Law Revision Act of 362 ES

Introduced in the Duma.

 

An act to revise the current laws on marriage.


 

INTRODUCTION

This bill seeks to revise the current laws on marriage, and make proper amendments to maintain the dignity of our society and it’s hierarchies. Additionally, it also seeks to define different types of marriages.

 

I. Necessary Definitions

-        Patrilineal: A marriage in which the spouse and offspring have the name of the husband.

-        Matrilineal: A marriage in which the spouse and offspring have the name of the wife.

-        Morganatic: A marriage between a noble and a non-noble, in which the offspring are not considered nobility, nor part of the noble’s house, nor do they have the right to any of their noble parent’s inheritance.

-        Non-Morganatic: A marriage between a noble and a non-noble, in which the offspring are considered nobility, and part of the noble’s house.

 

II. Amendments

-        Section 703: Marriage shall be changed into the following:

703: Marriage

703.01: Types of Marriages

703.011: A marriage in which the couple take the name of the husband shall be considered patrilineal;

703.012: A marriage in which the couple take the name of the wife shall be considered matrilineal;

703.013: A marriage in which a noble marries a non-noble shall be considered morganatic, with the exception of when the Crown approves it to be non-morganatic;

703.02: Eligibility of Marriage

703.021: A non-human may not marry a human.

703.022: A commoner may only marry into a noble family morganically with the consent of the titled peer of that family;

703.023: A commoner may only marry into a noble family non-morganatically with the consent of the titled peer of that family and the Crown;

703.024: Those related by blood or by law to the second degree may not marry;

703.0241: The second degree is to be considered parents, siblings, children, grandparents, grandchildren, uncles, aunts, nephew, nieces, and half-siblings.

703.025: Marriage between members of nobility must be approved by the titled peer;

703.04: Once the betrothed reach the age of sixteen, they may marry before a member of the clergy and become husband and wife;

703.05: A husband or wife marrying a titled peer shall assume the title of Duke-Consort or Duchess-Consort, Margrave-Consort or Margravine-Consort, Count-Consort or Countess-Consort, or Baron-Consort or Baroness-Consort;

703.06: The marriage of a man and a titled female peer shall be considered matrilineal unless agreed otherwise.
