A Declaration from The Magisterium 

15th of Sigismiund's End, in the Year of our Lord, 2 Balian's Age.

 

 

The Office of the Magister would like to make a statement on the creation of the Magisterium, the legal department of The Grand Duchy of Balian.

The Magisterium will be overseen by the Magister, the highest legal authority in the realm.

- They will be the Chief Prosecutor, Investigator and Judge in Balian and may delegate any case  as they see fit.

- They will oversee legal matters and keep order and deal with any high level cases personally.

- They will work with the Brotherhood of Balian to ensure they do not abuse their power and enforce punishments appropriately.

- They will receive all legal fines, which will be subsequently given to the Procurator for them to place in the treasury.

 

The Magisterium will consist of two roles, the Kritai and Tribonian Quaestors.

- The Kritai would be the judges of the land, overseeing any court cases.

 

-The Kritai will ensure their punishments are carried out effectively by the Brotherhood of Balian.

-They may also have the right to fine people for low level crimes should an NCO of the Brotherhood of Balian not be present.

-They will be overseen by a Supreme Kritai, who will be appointed by the Magister, themself, their role will be to ensure Kritai are completing their jobs.

 

 

-The Tribonian Quaestors will be the Investigators and Prosecutors of the land, investigating crimes and subsequently prosecuting them in court when needed.

 

-They can fence off areas for one saint’s day should they believe it necessary.

-They are afforded the right to detain and question any suspects in a case.

-They may also question any witnesses including character witnesses.

-Search warrants are needed for any searches in any building that is not public space, which can only be given by the Magister.

-While prosecuting, they may bring up any and all evidence they believe to be pertinent.

 

The Brotherhood of Balian will receive the ability to place up to 500 mina fines to anyone who commits a low level crime.

- Only NCOs and above can place fines on people.

- Any Brotherhood of Balian member who commits a high level crime or abuses their power will be investigated and prosecuted by the Magisterium.

 

Peers who are accused of a crime will be investigated by the Magisterium as would anyone else.

-If evidence is found, their trial will be overseen by The Duke or The Magister, as the highest authority and highest legal authority in the land.

 

The laws of Balian are to be written within the next two Saint’s years by The Magister and Ducal Chambers.

-Until it is released, all cases will use the Orenian Revised Code as a substitute.
