With the recent publication of the Edict of Obergrad, overseeing the reform of the Aulic Court to a form where it shall consist of the Boyars of the Royal Duma and the Crown-appointed Jovenaar (henceforth referred to either as simply ‘the Aulic Court’, or as ‘the Jovenaars’ for simplicity - A Boyar of the Royal Duma is a Jovenaar through virtue of being a Boyar of the Royal Duma, thus any mention of Jovenaar in this document shall include them), this Royal Decree is intended to come alongside it, and establish guidelines to the Aulic Court on the matter of administering appropriate criminal punishments.

 

This Decree shall outline what the Crown views to be an appropriate punishment for the various crimes within the Jura i Krima, though it does simultaneously acknowledge that the circumstances may call for a punishment that falls outside of this purview, in accordance with Ch V.IV. of the Jura i Kongzem.
 

This Decree shall be binding for the Aulic Court until such a time where it is explicitly rendered invalid, or until such a time whereupon it becomes obsolete.

 

ON APPROPRIATE CRIMINAL PUNISHMENTS

 

These guidelines must be prefaced with Ch V.IV. of the Jura i Kongzem, which reads as follows: “The Aulic Court shall punish the guilty in proportion to their age, capability, and wrong they have done.” It is the duty of the Aulic Court to carefully consider these before they issue verdicts, even to the extent where it may lead the Aulic Court to stray from the punishments outlined in this Decree.

 

REGARDING THE RULE OF LAW

I. Let he who is found guilty of Obstruction be punished through:

I.a. A fine of five-hundred mina, if of a mild nature, or;

I.b. The removal of the hand used to obstruct justice.

 

II. Let he who is found guilty of Corruption be punished through:

II.a. The immediate revocation of their rank or office, if of a mild nature, or;

II.b. The immediate revocation of their rank or office, and a fine of five-hundred mina, if of a moderate nature, or;

II.c. Death, if of an extreme nature.

 

REGARDING BLASPHEMY AND HEINOUS ACTS AGAINST GOD

I. Let he who is found guilty of Heresy be punished through:

I.a. Service under a Priest of the Church of the Canon, if of a mild nature, or;

I.b. Banishment, if of a moderate nature, or;

I.c. Death, if of an extreme nature.

 

II. Let he who is found guilty of Sacrilege be punished through:

II.a. Service under a Priest of the Church of the Canon, if of a mild nature, or;

II.b. Banishment, if of a moderate nature, or;

II.c. Death, if of an extreme nature.

 

III. Let he who is found guilty of Fornication be punished through:

III.a. Service under a Priest of the Church of the Canon, or;

III.b. Service under a Priest of the Church of the Canon, and a fine of two-hundred and fifty mina paid to the Mother, if the aforementioned Fornication resulted in the birth of a bastard.

 

IV. Let he who is found guilty of Incest be punished through immediate Disownment from their respective families and Banishment.

 

V. Let he who is found guilty of Miscegenation be punished through,

V.a. Service under a Priest of the Church of the Canon, or;

V.b. Service under a Priest of the Church of the Canon, and a fine of one-hundred mina paid to the Mother, if the aforementioned Miscegenation resulted in the birth of a bastard, or;

V.c. Banishment.

 

VI. Let me who is found guilty of Cannibalism be punished through Death.

 

REGARDING THE USAGE OF MAGICK, SORCERY AND WITCHCRAFT

I. Let he who is found guilty of Dark Witchcraft be punished through Death.

 

II. Let he who is found guilty of Abomination be punished through Death.

 

REGARDING ACTS OF TREASON AND INVASION

I. Let he who is found guilty of Treason, as well as Aiding and Abetting Treason, be punished through Death.

 

II. Let he who is found guilty of Espionage be punished through

II.a. Removal of the tongue and Banishment, if of a mild nature, or;

II.b. Death.

 

III. Let he who is found guilty of Sedition be punished through

III.a. Removal of the tongue and Banishment, if of a mild nature, or;

III.b. Death.

 

IV. Let he who is found guilty of Insurrection be punished through Death.

 

V. Let he who is found guilty of Mutiny be punished through Death.

 

VI. Let he who is found guilty of Desertion be punished through Banishment.

 

VII. Let he who is found guilty of Invasion be punished through Death.

 

VIII. Let he who is found guilty of Poisoning be punished through:

VIII.a. Confiscation, and a fine of one-thousand mina, if of a mild nature, or;

VIII.b. Banishment, if of a moderate nature, or;

VIII.c. Death, if of an extreme nature.

 

REGARDING COUNTERFEITERS, FORGERY AND FRAUD

I. Let he who is found guilty of Forgery be punished through:

I.a. A fine of five-hundred mina, if of a mild nature, or;

I.b. A fine of one-thousand mina, if of a moderate nature, or;

I.c. A fine of two-thousand mina, if of an extreme nature.

 

II. Let he who is found guilty of Forgery by Counterfeiting be punished through a fine equal to the value of the counterfeited goods or currency, if they had not been counterfeit.

 

III. Let he who is found guilty of Impersonation be punished through:

III.a. A fine of two-hundred and fifty mina, paid to the impersonated, if the impersonated is a commoner, or;

III.b. A fine of five-hundred mina, paid to the impersonated, if the impersonated is a noble, or;

III.c. Death, if the impersonated is a Peer of the Realm, sits upon the Aulic Council, is a Royal, or is the Crown.

 

IV. Let he who is found guilty of Racketeering be punished through the immediate settlement of their debts.

 

V. Let he who is found guilty of Obstruction of Correspondence be punished through the immediate return of the correspondence, and a fine of one-hundred mina to both sender and recipient.

 

REGARDING MURDER, MANSLAUGHTER, ASSAULT, ABDUCTION AND ENSLAVEMENT

I. Let he who is found guilty of Murder be punished through Death.

 

II. Let he who is found guilty of Manslaughter be punished through:

II.a. A fine of one-thousand mina, paid to the victims family, if of a mild nature, or;

II.b. Death.

 

III. Let he who is found guilty of Assault be punished through:

III.a. A fine of five-hundred mina, paid to the victim, if of a mild nature, or;

III.b. Removal of the hand that wielded the weapon, and a fine of five-hundred mina, paid to the victim, if of a moderate nature, or;

III.c. Death, if of an extreme nature.

 

IV. Let he who is found guilty of Abduction be punished through Death.

 

V. Let he who is found guilty of Enslavement be punished through Death.

 

REGARDING THEFT, TRESPASS, AND GENERAL MENACE

I. Let he who is found guilty of Theft be punished through:

I.a. Return of the stolen belongings and coin, if the guilty is a commoner, and the value of the stolen belongings or coin is less than fifty mina, or;

I.b. Branding and return of the stolen belongings and coin, if the guilty is a commoner, and the value of the stolen belongings or coin is more than fifty mina, or;

I.c. Branding and return of the stolen belongings and coin, if the guilty is a noble, or;

I.d. Removal of the hand that stole, if the value of the stolen belongings and coin exceeds five-hundred mina.

 

II. Let he who is found guilty of Banditry be punished through Death.

 

III. Let he who is found guilty of Trespass be punished through:

III.a. A fine of one-hundred mina, split between those trespassed upon and the Crown, if the trespassed area was a lodging or house, or;

III.b. A fine of five-hundred mina, split between those trespassed upon and the Crown, if the trespassed area was a keep, or;

III.c. Death, if the trespassed area is the Royal Palace.

 

IV. Let he who is found guilty of Vandalism be punished through a fine of five-hundred mina, split between those vandalised and the Crown.

 

V. Let he who is found guilty of Defamation be punished through:

V.a. A fine of five-hundred mina, paid to the defamed, if of a milder nature, or;

V.b. Removal of the tongue.

 

VI. Let he who is found guilty of Harassment be punished through:

VI.a. A fine of five-hundred mina, paid to the harassed, or;

VI.b. Banishment, if of an extreme nature.

 

VII. Let he who is found guilty of Degeneracy be punished through:

VII.a. A fine of two-hundred and fifty mina, or;

VII.b. Service under a Priest of the Chuch of the Canon, if of an extreme nature.
