CASE.

 

The PROSECUTION, THE STATE OF KOYO-KUNI brings charges against DEFENDANT, DAISUKE, for the GREVIOUS BODILY HARM, ATTEMPTED MURDER, ASSAULT AND DISTRUBING THE PEACE.

JUDGE SHUGO: Daisuke. You stand before the mother and her nation, the stratoctaxy and Kamisama. May Eshtaeu bless these halls. 

 

DEFENDENT DAISUKI: Innocent 

 

JUDGE SHUGO: I will now hear the charges against you and you be stalwart in your decision may you plead the same 

 

JUDGE SHUGO:  The state may begin it's case. What are the charges?

 

- BREAK. PROSECUTION COUNCIL SPEAKS WITH JUDGE - 

 

JUDGE SHUGO: oh you bum. (To DEFENDANT COUNCIL BRAE)

 

JUDGE SHUGO: Would thr victims step forward? 

 

- PAUSE. VICTIM YUKIKO STEPS FORWARD - 

 

JUDGE SHUGO: Yukio. Such injuries upon you, would you step before the court and state your story? 

 

VICTIM YUKIKO: I was walking in the woods, with some shrine maidens and Echiba. We were taking your of tiger sanctuary. I got separated from them, wasn't sure where I was going- fell into a mine. I broke my leg. 

 

VICTIM YUKIKO: thankfully, Hikari found me. He helped me treat my leg, but then we heard something in caves. Something screamed 'help'. We thought someone else might have fallen in, so Hikari went on his own to investigate. 

 

VICTIM YUKIKO: that was when I heard hikari's screams. He was yelling that Daisuke was down there- telling me to rubn. But I did not know how to escape the caves on my own. 

 

VICTIM YUKIKO: so I splinted my leg, and ran after the sound of fighting. When I got there, all I hear was Hikari screaming, I learned later from him and others, that Daisuki had ripped his scalp off.  Long story short, we fought. 

 

VICTIM YUKIKO: Hikari managed to drop me his bumsteel katana, and I drew it. The Fire scared Daisuki off. And Hikari and I found our way out together. 

 

JUDGE SHUGO: is that all? 

 

VICTIM YUKIKO: He tried to eat me

 

JUDGE SHUGO:  now that the state has been updated on their clients side of the story would the state like to press fourth charges? 

 

- PAUSE. VICTIM RETURNS TO BENCH - 

 

PROSECUTION COUNCIL BRAE: Yes, your shugo-Ness. The state of koyo-kuni charges Daisuki fellow with the crime of grievous bodily harm, attempted murder, assault and disturbing the peace.

 

JUDGE SHUGO: very well, you may make opening statement 

 

- PAUSE. PROSECUTION COUNCIL BRAE STEPS UP. PRELIMINARY STATEMENTS PAUSE. OPENING STATEMENTS BEGIN - 

 

PROSECUTION COUNCIL BRAE:: ladies and gentlemen of the shinto (shidai). It appears we have in our midst a woman-scarer and scalper. One who intends to do great harm to this state's people and bring dishonor to the land!

 

PROSECUTION COUNCIL BRAE: yes, you see, by targeting the shrine maidens, he seeks to undo the rigorous moral and religious backbone of great society. 

 

PROSECUTION COUNCIL BRAE: who among you will be the next? It could you be you. Or you. Or even the shugo herself. All of them, potential victims of these heinous and barbaric crimes!

 

PROSECUTION COUNCIL BRAE: Ladies and gentlemen of the jury.I trust you will be honest and truthfully in your endeavors to root out evile at its source. For once we dealt with the man-Miker of Du Loc and his terrible cult, so too will burn these wretched head scalper

JUDGE SHUGO: how about you call yukiko to the stand. She already testified and may be questioned. 

 

PROSECUTION COUNCIL BRAE: yes. As I was about to say next, yukiko please take stand. 

 

JUDGE SHUGO: you may question your witness on her story counselor. 

 

DEFENDANT COUNCIL ICHIRO: may defense make statement? 

 

JUDGE SHUGO: I guess. 

 

- SCRATCHED OUT SECTION END. PROCEED WITH OPENING STATEMENTS -

 

DEFENDANT COUNCIL ICHIRO: It is foolish to levy the same charges as would be given to an ordinary shimin. The defense will prove that for the terrible violence that may have happened, there have been a great many failings on behalf of the state. And the burden of guilt lies not on Daisuke, but on his owners. 

 

- PAUSE. END OF OPENING STATEMENTS. TRANSITION PERIOD- 

 

JUDGE SHUGO: does that mean he charges his plea from innocent? 

 

DEFENDANT COUNCIL ICHIRO: Daisuke does not change his plea.

 

JUDGE SHUGO: understood. Quentin. Bring fourth your first witness. 

 

PROSECUTION COUNCIL BRAE: do I not question guilty man first? 

 

JUDGE SHUGO: is he your first witness? If so, yes counselor. 

 

PROSECUTION COUNCIL BRAE: I see. Daisukie, take the stand . 

 

- QUESTIONING BEGINS. PROSECTION BRINGS WITNESS 01 DAISUKI TO STAND -

 

PROSECUTION COUNCIL BRAE: How old are you, Daisuke?

 

DEFENDANT DAISUKE: I am fifty five. 

 

PROSECUTION COUNCIL BRAE: what do you do your labor, or work?

 

DEFENDANT DAISUKE: I am not given work due to my condition. But I undergo experimentation, kaninokyo study

 

PROSECUTION COUNCIL BRAE: your condition, can you elaborate on that for the jury?

 

DEFENDANT DAISUKE: yes. 

 

JUDGE SHUGO: the defendant will clarify that he is undergoing experimentation to cure hid condition. For public understanding. Continue. 

 

DEFENDANT DAISUKE: what was your question counselor?

 

PROSECUTION COUNCIL BRAE: your condition, please, tell the jury what it is. Regardless of the experimentation to cure such condition that the shugo respectfully asked clarification on. 

 

DEFENDANT DAISUKE: I am curse with lycanthropy.

DEFENDANT DAISUKE: on temple grounds, but as of recently, I've consulted the church and their miracles. 

 

PROSECUTION COUNCIL BRAE: does this require you to leave city walls?

 

DEFENDANT DAISUKE: at times, yes. 

 

PROSECUTION COUNCIL BRAE: when was the last time you took such a venture outside the walls?

 

DEFENDANT DAISUKE: the day I transformed?

DEFENDANT DAISUKE: I had met with members of the church, discussing details of other infected and their encounters. Had I not eaten, trying to keep my curse unknown while I was within the bounds of the empire. 

 

PROSECUTION COUNCIL BRAE: and did you not previously state that eating was an affliction beast upon thee as symptom? 

 

DEFENDANT DAISUKE: it keeps the transformed at by, in most cases.

DEFENDANT DAISUKE: there's only ever been one time I had gone in them. 

 

PROSECUTION COUNCIL BRAE: what happened once you arrived in the Caves?

 

DEFENDANT DAISUKE: I rushed in, past Raidens group as they were leaving and I was fighting transformation. I turned, a safe distance from them.

 

PROSECUTION COUNCIL BRAE: please continue.

JUDGE SHUGO: Now, this us a bit unorthodox.  Rest assured, witnesses will be called proper now that everyone is up to speed. Ichiro, would you like to ask him anything?

 

DEFENDANT COUNCIL ICHIRO: Hai

 

- DEFENSE EXAMINATION OF DAISUKI BEGINS -

 

DEFENDANT COUNCIL ICHIRO: Daisuke, do you recall where you entered the caves? 

 

DEFENDANT DAISUKE: somewhere in tiger's sanctuary 

 

DEFENDANT COUNCIL ICHIRO: Hai. And you understood you would loose control of yourself? 

 

DEFENDANT DAISUKE: Hai, in the moment. I searched for a place where I wouldn't hurt people, nor my brother's beloved animals 

 

DEFENDANT COUNCIL ICHIRO: as you traveled through the cave, you came by Rajden and some others, despite this, correct?

 

DEFENDANT DAISUKE: they were at the entrance, yes.

- JUDGE THROWS PAPER AT PROSECTUON COUNSIL'S HEAD - 

 

DEFENDANT COUNCIL ICHIRO: have you been instructed by the state on what to do when you start to feel any pangs or urges as you felt in the caves? 

 

PROSECUTION COUNCIL BRAE: Ena? I have to use that guy?

PROSECUTION COUNCIL BRAE: I call Ena of Clan Kato, blessed may be Oijin's Spawn, to the stand.

 

JUDGE SHUGO: idiot

 

PROSECUTION COUNCIL BRAE: what! 

 

JUDGE SHUGO: order in the court. 

 

VICTIM YUKIKO: He wasn't there!

 

PROSECUTION COUNCIL BRAE: I don't care! I bring him to the stand!

 

JUDGE SHUGO: those in court will behave. 

 

- PROSECTION CALLS WITNESS #2 KATO ENA TO STAND - 

 

PROSECUTION COUNCIL BRAE: Ena, you are loyal citizens of this great nation, are you not? 

 

WITNESS ENA: Hai, I wouldn't be Samurai otherwise.

 

PROSECUTION COUNCIL BRAE: do you know this man?

 

WITNESS ENA: Hai

 

PROSECUTION COUNCIL BRAE: now.. tell me, ena, have you ever witnessed a crime committed against this nation? 

 

WITNESS ENA: Hai 

 

PROSECUTION COUNCIL BRAE: inform the jury of said crime 

 

WITNESS ENA: the crime I witnessed were gaining roof hopping and scoping out our homes for loot!

 

PROSECUTION COUNCIL BRAE: yes, yes, quite terrible, really .. awful, now. Question. Would you say that these crimes committed wholly on the free will and accord of those who commit them?

 

WITNESS ENA: in regards to the history?  Hai. Their free will. They chose to thieve. 

 

PROSECUTION COUNCIL BRAE: heisters, any criminal, really, would you say that people who do evil choose to do so?

 

WITNESS ENA: not necessarily. It depends on crimes and the economic situation surrounding the individual?

 

PROSECUTION COUNCIL BRAE: would you say it would be inappropriate for a jewelry thief to surround himself I'm prized jewels of the shugonate? Would you blame him if he acted upon nature to steal those jewels?

 

WITNESS ENA: hai, I would. 

 

PROSECUTION COUNCIL BRAE: no future questions.

PROSECUTION COUNCIL BRAE: I call yukiko to the stand. Unless it's their turn again.

 

JUDGE SHUGO: Ichiro, do you have questions for Ena? 

 

DEFENDANT COUNCIL ICHIRO: Hai. 

 

PROSECUTION COUNCIL BRAE: yes, yes it is their turn.. of course.. I knew that. 

 

- DEFENSE NOW QUESTIONS WITNESS #2 -

 

DEFENDANT COUNCIL ICHIRO: Kato-Sama, if the jewelry thief were caught, and places under supervision of the state, who then surround him with jewels, do you think it is the thief or state's fault if he steals the jewels?

 

WITNESS ENA: I believe it is the state's fault. My brother is not a shimin. He's property. If the state takes on the supervision of the thief, he's state's ward. Property. 

 

- STRIKED OUT QUESTION - 

DEFENDANT COUNCIL ICHIRO: and you are aware that your brother or perhaps a thief. Did their best to remove themself from temptation and to follow the Instructions give to them.

PROSECUTION COUNCIL BRAE: OBJECTION. 

 

JUDGE SHUGO: grounds? 

 

PROSECUTION COUNCIL BRAE: are they discussing a thief, or Daisuke? If so it is both simultaneously, they should not continue muddying the lines of their argument to distract the jury. 

 

JUDGE SHUGO: sustained. Rephrase your question ichiro? Manami, strike that statement. 

 

DEFENDANT COUNCIL ICHIRO: okay, are you aware that your brother did his best to avoid temptation and warned others of danger that would soon be present? 

 

WITNESS ENA:  I believe so. His directions have been minimal, daga he's been told to get away from others when he feels a transformation coming to miniseries threat. 

 

DEFENDANT COUNCIL ICHIRO: arigato, no further questions Kato-Sama.

 

- PAUSE, CLARIFICATION SECTION -

 

PROSECUTION COUNCIL BRAE: A moment, your honor shugo, I would like clarification on the rights of property within the state of Koyo-Kuni. To clarify, noy thr rights of one's property, but the rights of property itself. 

 

JUDGE SHUGO: very well. Usually in truth, we would not have a trial for property. However, Daisuke is my little brother's son. I offer Uncle O above respite knowing we award Daisuke some extra rights. Furthermore, property is property. Daisuke is basically a sentient bio-weapin. 

 

JUDGE SHUGO: Etti, great grandson - apologies. Not son, you humans have babies to fast. Consider him as you would a family heirloom, look like a blessed blade. 

 

PROSECUTION COUNCIL BRAE: does property retain the rights of normal citizen in this context, your shugo-ness. 

 

JUDGE SHUGO: iie 

 

PROSECUTION COUNCIL BRAE: verily. I motion to consider this trial to push towards an instant guilty verdict, for the property has no free-will, and this must be destroyed as fit by state.

 

JUDGE SHUGO:  I am Inclined to no objection to that logic I cannot let my feelings get in the way. Ichiro? 

 

DEFENDANT COUNCIL ICHIRO: if we are suggesting punishment out of order, we would agree to move forward if the punishment was to be serving of one Daisuke's hands, and shaving his head bald from the chin to the top of his head. 

 

DEFENDANT COUNCIL ICHIRO: otherwise, if this deal is not ammendable, we object - Daisuke has additional rights. 

 

- TRIAL CONTINUES, WITNESS #3 IS CALLES TO STAND BY PROSECTION - 

 

PROSECUTION COUNCIL BRAE: .. your honor shugo-ness. 

 

JUDGE SHUGO: Hikari, remove your helmet (hat)

 

- TATSU HIKARI REMOVES HIS HAT, REVEALING A BALD HEAD -

 

PROSECUTION COUNCIL BRAE: nevermind. 

 

JUDGE SHUGO: Hikari, step before the court. Quentin, question this one. 

 

PROSECUTION COUNCIL BRAE: the prosection called, this man, to the stand. 

 

WITNESS HIKARI: Hikari. 

 

PROSECUTION COUNCIL BRAE: Hikari, of course! My apologies, my sensors were brought to disarray momentarily.. do you know this man?

 

WITNESS HIKARI: Hai. I know him. But as am acquaintance, best way to describe it. Hai. 

 

PROSECUTION COUNCIL BRAE: and, how is it you came to know him under the grasp of evildoing,  and being balded. 

 

PROSECUTION COUNCIL BRAE: I mean, scalped. 

 

WITNESS HIKARI: I was present when he was experimented on, and I saw him first turn into a beast, that's how I recognize his form in cave.

PROSECUTION COUNCIL BRAE: a beast? How terrible. And how it is then, that you managed to be abducted by him and then brought hairless - I mean skinless?

DEFENDANT COUNCIL ICHIRO: objection.

DEFENDANT COUNCIL ICHIRO: he assumed Tatsu-san was abducted. This fact had not been established. 

 

JUDGE SHUGO: Sustained. Quentin rephrase. 

 

PROSECUTION COUNCIL BRAE: how is it you were assaulted by Daisuke, and scalped by him? 

 

WITNESS HIKARI: no, I was not abducted, I was in the cave when I found Yukiko, her leg was damaged and I heard another voice. Thought another person was hurt, so I went to cave and when I stood there - he was in pure beast form. He was silent as death. I jumped back put if shock. He took that moment to pin me down, with his weight. He then placed his maw on my cranium and ripped my scalp, I watched him chew my hairline. 

 

- PUBLIC DISTURBANCES OF DAISUKE HAVING HAIR BALL -

 

JUDGE SHUGO:  ORDER!!!

 

PROSECUTION COUNCIL BRAE: I see. How unfortunate.  Are you shrine maiden?

 

WITNESS HIKARI: I am no maiden, but I had medkit on me, I still carry it. 

 

PROSECUTION COUNCIL BRAE: a feminine trait, nonetheless, of course.. now, would you consider yourself a direct victim of this man's beastial inclination? 

 

WITNESS HIKARI: rephrase please

 

PROSECUTION COUNCIL BRAE: are you a victim of Daisuke?

 

WITNESS HIKARI: Hai, I would say, but i want it on record I personally don't want him to get any extreme harm, as the state has helped me recovery, no permanent damage. But I have one wish to consider his sentence, if I may speak.

 

PROSECUTION COUNCIL BRAE: I gave ni further questions myself, your shugo-ness.

 

- QUESTION END. NO DEFENSE QUESTIONING OF WITNESS - 

 

JUDGE SHUGO: I've heard enough. I will allow crowd to vote, and I will not wait for everyone. I will have one minute between votes, raise your hand if you agree with a verdict. 

 

PROSECUTION COUNCIL BRAE: shugo?

 

JUDGE SHUGO: ah?

 

PROSECUTION COUNCIL BRAE: wait. Nevermind. 

 

JUDGE SHUGO: all in favor of finding Daisuke, raise your hand.

 

PROSECUTION COUNCIL BRAE: wait. What about CLOSING statements? 

 

JUDGE SHUGO:  do you need one? Fine. 

 

PROSECUTION COUNCIL BRAE: thank you, your holiness.. 

 

- CLOSING STATEMENTS BEGIN. - 

 

PROSECUTION COUNCIL BRAE: We have been brought the attention of this threat, this unemployed, unhinged, and nigh homeless anthropologist, lingering in our midst, seeking to take our skulls, and Conduct phonological studies upon us! He has no self control.. and is abeit, completely lacking free will and accord, and as established by this court, and by witnesses of this court and crime. Remember what you vote for. This thing attacked shrine maidens and other loyal citizens, knowingly putting himself in precarious situations despite knowing of his cursed affliction to be an anthropologist.  

 

PROSECUTION COUNCIL BRAE: Ladies and gentle-oni, I assure you that if you vote guilty, the jusg hand of justice will prevail. And keep further incidents like this from happening. 

 

PROSECUTION COUNCIL BRAE: the PROSECUTION rests your honor. 

 

DEFENDANT COUNCIL ICHIRO: this is a simple case, Daisuke is property. Property does not have the right to trial. But here we are. The stage has failed both Daisuke. And it's people. Not amply protecting them from one another. That is all. 

 

JUDGE SHUGO: I will ask now. As a reminder, I am the law, and I will have last say. I would, however, like to hear what my people think. And so, raise your hand if you find Daisuke is guilty. 

 

- VOTING, FOUR VOTES - 

 

JUDGE SHUGO: and all who find him innocent? 

 

- VOTING, FIVE VOTES - 

 

JUDGE SHUGO:  this trial has made me reconsider whether the Kami of justice yet lives. Regaurdless, you have had more innocent votes than guilty ones. I will strike the punishment of your hand being cut off. 

 

DEFENDANT DAISUKE: my intents were never to hurt either party. But I will see that they are paid back for my transgressions. 

 

JUDGE SHUGO:  you are found guilty with leniency. I charge you with the pu ishment of mail pattern baldness. Furthermore, you will need a wrangler. 

 

JUDGE SHUGO:  court adjourned. 

 

Trial result, Daisuke is found innocent, however as moral punishment Daisuke received a shaven head and botched haircut by the state so Hikari Tatsu did not suffer alone.
