sophiaa 778 Share Posted October 12, 2019 The Estates of Morsgrad Issued Year of 1737, by Eleanor PREAMBLE The Estates of Morsgrad comprised of the tribal clans, the Houses of Burghs, and the mercantilist Burghers, each bringing their own interests to the House of Estates in order to further their respective interests. The Estates of Morsgrad shall serve to give voice to the common folk of the Ducal State. Therein the Estates shall be empowered to compose law which shall be passed unto reality with the consent of the Hearth Council and the Ducal Throne. Herein the requirements to be recognized under one of these three categories, and thusly ascend to the Ducal Throne shall be codified. Furthermore, their powers, privileges and obligations shall CLAN REQUIREMENTS I. PRESENCE A. A recognized clan of The Ducal State must have a clear presence within the Duchy. A requirement of four living blood members or bondsmen who reside within the city is the minimum number to be recognized. B. The Clans must also contribute to the holdings of the Ducal Throne, and adopt either a specialization in an art or trade, or a material export. II. HISTORY A. Those families with a historical link to the nation or with historical status will be granted clan status. A reward for prolonged loyalty and for the cultural weight of the clan. B. Must be acknowledged as an ethnic cousin of the nation as defined in the Nordlaw. C. The Clan may not hold any feudal obligations outside of the Ducal State. III. SEAT A. The family must retain exclusive legal ownership of a property, holdfast, hall or Burgh within the confines of the Ducal state B. The seat must not be held on loans, mortgages or in arrears on its taxes. IV. DENOMINATION A. The Patriarch or Matriarch of the clan must be a practicing Fatherist B. Atheists, Pagans and Agnosts are not able to hold seat on the House of Estates V. MEMBERSHIP IN THE ESTATES A. Upon completing the above, a writ will be issued by the Ducal throne granting the appellant a writ of invitation. Granting official status to the family and inviting them to take a seat upon the House of Estates. VI. OBLIGATION A. Attendance of either Chieftain or A proxy upon the Assembly of the Estates once per year B. Providing tithe of men or material to the Ducal State during times of war HOUSE REQUIREMENT I. PRESENCE A. A recognized recognized House of the Ducal State of Morsgrad must have all of its blooded members recognized as citizens of the State by virtue of blood or by writ from the Ducal Throne or by the Hearth Council. II. HISTORY A. The House must be comprised of unblemished bloodlines, half breeds are barred from holding seat upon the assembly. B. The House must be in good moral standing, cannot have a history of wytchery, of banditry, or sinful excess, or of treachery. C. The House cannot hold any feudal allegiances outside the Ducal State III. SEAT A. The family must retain exclusive legal ownership of a property, holdfast, hall or Burgh within the confines of the Ducal state B. The seat must not be held on loans, mortgages or in arrears on its taxes. IV. DENOMINATION A. The Patrician of the House, or its equivalent head must be a Practicing Fatherist or a Practicing member of Northern Rite Canonism. B. Atheists, Pagans, and Agnosts are not able to hold seat on the House of Estates V – MEMBERSHIP IN THE ESTATES A. Attendance of either Patrician or A proxy upon the Assembly of the Estates once per year B. Providing tithe of men or material to the Ducal State during times of war BURGHERS I. PRESENCE A. A recognized Burgher must be a legal citizen of the Ducal State. Granted citizenship by virtue of blood, or by act of the Ducal Throne or Hearth Council. B. The Burgher must make his mercantile ability known to the Ducal Throne by payment of Five Hundred Marks to the Treasury Office. II. HISTORY A. The Burgher must have a history of mercantilism and be currently exercising his trade within the confines of the Ducal State. B. The House must be in good moral standing, cannot have a history of wytchery, of banditry, or sinful excess, or of treachery. III. SEAT A. The Burgher must dwell within the Granburgh and retain exclusive ownership of the property therein. B. The seat must not be held on loans, mortgages or in arrears on its taxes. IV. DENOMINATION A. The Burgher must be a practicing Fatherist or a practicing member of Northern Rite Canonism. B. Atheists, Pagans, and Agnosts are not able to hold seat on the House of Estates V. Make appointments to the low council IV. Allocate state funds V. Adjust state tax PRIVILEGES OF THE ESTATES, the Estates Individual are Privileged to I. Unhindered Access to the House II. Speak once on each issue in the House III. Vote on each issue in the House IV. Floor issues to the Agenda V. Send a proxy to the House VI. Abstain from Voting OBLIGATIONS OF THE ESTATES, the Estates Individual are Obliged to I. Be present at every Estate Assembly II. Act in the interest of their familial or mercantile body and in the interest of the Ducal State. III. Maintain the decorum of the House IV. Be obedient in every respect to the Ducal Throne RESTRICTIONS OF THE ESTATES, the Estate General are Restricted from I. Legislating in regards to succession of the realm II. Holding a session of the assembly without the consent of the Ducal Throne III. Making any laws to the end of restricting the Ducal Throne II. POWERS, PRIVILEGES, AND OBLIGATIONS OF THE DUCAL THRONE POWERS OF THE DUCAL THRONE, the Ducal Throne is Empowered to I. Remove any member of the seated members of the Estates permanently from the Assembly. II. Veto any issue floored before the Estates. III. Win any issue he provides his affirmation to regardless of vote count IV. Do anything he wishes within the confines of Fatherist law PRIVILEGES OF THE DUCAL THRONE, the Ducal Throne is Privileged to I. Be the exclusive user of the Ducal Throne within the Assembly. II. Do anything he wishes within the confines of Fatherist law OBLIGATIONS OF THE DUCAL THRONE, the Ducal Throne is Obliged to I. Hold assembly at least once a year II. Provide a space for the Assembly to occur III. Furnish a Chamberlain to chair the Assembly IV. Ensure the security of the Assembly that it may occur RESTRICTIONS OF THE DUCAL THRONE, the Ducal Throne is Restricted from I. Nothing falling within the confines of Fatherist law III. POWERS, PRIVILEGES, AND OBLIGATIONS OF THE HEARTH POWERS OF THE HEARTH, the representative of the Hearth is Empowered to I. Exercise a veto over any issue in the Assembly that is contrary to Fatherist law PRIVILEGES OF THE HEARTH, the representative of the Hearth is Privileged to I. Unhindered Access to the House II. Speak once on each issue in the House III. Vote on each issue in the House IV. Floor issues to the Agenda V. Send a proxy to the House VI. Abstain from Voting OBLIGATIONS OF THE HEARTH, the representative of the Hearth is is Obliged to I. Be present at every Estate Assembly II. Act in the interest of the Faith III. Open and close the session with a prayer IV. Provide guidance on matters of faith and morality RESTRICTIONS OF THE HEARTH, the rep. of the Hearth is Restricted from I. Voting on matters unrelated to Morality, Holy Law, or Faith II. Veto any issue affirmed by the Duke III. Use their Veto to supplant the Veto of the Duke IV. Use their Veto to deny an issue floored by the Duke or on behalf of the Duke by a Ducal agent. ON RECENT AFFAIRS Concerning The Departed Regarding recent turmoil within the Ducal State, those parties that do not make themselves present at the 4th Assembly of the Estates will be presumed to have voluntarily surrendered their status as members of the Estates. As a result all privileges rendered to those parties will be voided. Concerning The Second Election of First Freeman As Bodin’s term has now expired we shall elect a new First Freeman to represent the interests of the clanless citizens of the Ducal State. It is worth noting that only those individuals neither blooded in or bonded to an acknowledged clan may submit themselves for the position or vote for the available candidates. To become a candidate and to vote, one must be a citizen of the Ducal State. To that end those unsure of their status with the Ducal State should confirm with the most immediately available officer of the Stewardry. My Prayers for all our citizens on the eve of battle, your humble servant Godric, ESTATE PROCEDURES AND ETIQUETTE Opening the Estates I. The Incumbent Overlord of Montburgh will enter the Chamber last after everyone has taken their seats and assume his seat, opening the session in the name of the Father. II. The Chamberlain of the Seal will take attendance, noting those seated estates who are absent, represented by proxy, or present to the Estate Scribe. If a seated estate is absent without a proxy sent, a warning shall be announced and the meeting continuing on. III. The Chamberlain of the Seal will then recite the Agenda, guiding the Estates through as quickly as possible, while maintaining order within the Chamber. IV. All will have their turn to speak on a matter, and the Chamberlain will always open the floor at the end of the agenda for additions by the holding seats. Behavior and Etiquette I. Those holding seats are expected to act with the manners of a well grown man during Chamber sessions, and shall be given warnings for acting out of line and inappropriately. II. If an issue has escalated to the point of endangering someone's safety or that it has delayed the precessions for far too long, guards shall be ordered to remove the holder of the seat from the Chamber so the meeting may continue without disruption.
