Civil Unions Act, 1760

The Civil Union Marriage Recognition Act, in authorization of this statute, shall empower the Circuit Courts of the Holy Orenian Empire to officiate civil unions for non-human races.


 

INTRODUCTION

This legislation shall empower the several Circuit Courts of the Holy Orenian Empire to perform and officiate civil unions, which by the force of law, be equated to that of marriage as consecrated by ecclesiastical rite for non-human individuals. 


 

SECTION I:

On defining civil unions 

 

  1. Civil unions shall be defined as the enjoining of non-human male and female individuals into the institution of marriage as recognized by the Holy Orenian Empire.

    1. Both the bride and the groom must be of the same race. 

  2. Civil unions legally recognized by a court of law in the Holy Orenian Empire shall, by right, be recognized that their children be lawfully entitled to their property and inheritance. 

  3. Civil unions are dissolved upon the case of legal separation and or death of either spouse.



 

SECTION II:

On defining the procedure and rite of the courts of law to officiate civil unions

 

  1. Civil unions shall be performed by the Circuit Courts of the Holy Orenian Empire, presided by a magistrate confirmed by the Imperial Senate.

  2. All articles of section 301.03 ‘On Marriage’ of the Oren Revised Code shall apply to civil unions, with the exceptions of articles 301.032, 301.038-0310, and 301.0312. 

  3. The creation of civil unions shall be performed by the Circuit Courts of the Holy Orenian Empire, presided by a magistrate confirmed by the Imperial Senate and in the presence of the couple to be united.

  4. It shall be the right of the Emperor, his privy, and the Circuit Court which created the union, to render the nullity of union should this be deemed necessary.


 

SECTION III:

On amending filiation laws

 

  1. Section 302.01 ‘On Filiation’ of the Oren Revised Code shall be amended as follows:

  2. 302.01 - On Filiation

302.011 - Filiation is assumed when the child is born to parents in a marriage or civil union, and is assumed to be absent otherwise. A child with a recognised filial relation to their father is deemed “legitimate”. Children born outside wedlock are deemed “illegitimate”.

302.012 - Filiation determines surnames.

302.013 - Filiation is determined by the paternal line.

302.014 - It is the obligation of the father to care for his children.

302.015 - Any person of significant interest may declare filiation or lack thereof. This prerogative is perpetually maintained and reserved by the Crown and subsequent courts of law thereof.

302.016 - Illegitimate children enjoy no legal entitlement to inheritance.


 

SECTION IV:

On the maintenance of records pertaining to civil unions

 

  1. A registry is to be established and maintain a list of marriages officiated under the provision of civil unions in the Circuit Courts of the Holy Orenian State.

  2. The Department of Civil Affairs shall maintain the official record of all civil unions officiated by the Circuit Courts of the Holy Orenian Empire.
