MOTION TO DISMISS
Sir Edward Napier,
DESIRES INJUNCTIVE RELIEF;
ON THE BASIS OF THE FOLLOWING PRINCIPLE(S), DOCTRINE(S), EDICT(S) OR ARTICLES OF LAW: The Defendant is currently on trial and may soon be sentenced to death.

Emergency Injunctive relief is requested pending appeal. The rights of man as stated in the Oren Revised Code grant a right to trial, which is also to be extended appeal. Furthermore, Mr. Napier’s right to trial was violated by the Crown in forcing an immediate trial, in direct violation of the Legal Procedure Act, 1772 which states:
1. Books of Evidence:
a. All a party’s evidence must be contained within a single Book of Evidence, submitted to the presiding Justice and exchanged with the opposing party at least one Saint’s Day prior to trial;

4. Disclosure:
b. Upon the submission of a Subpoena or Petition for Summons, a Defendant shall be obliged to submit a Replying Affidavit outlining their response to the alleged offenses at least one Saint’s Day prior to trial; i. At the discretion of a Justice, an unrepresented layman may be excused from this obligation; ii. At least one Saint’s Day prior to trial, both parties shall exchange their Books of Evidence, in accordance with the Provision of Article VI.

 

The trial was immediately held, thus making it impossible for proper disclosure to happen in this case, this violating the right to trial as assented to by His Imperial Majesty. We humbly ask The Supreme Court to grant emergency Injunctive relief to prevent the execution of Mr. Napier in the event of a sentence to death. AND THEREFORE HOPES TO RESTORE JUSTICE IN THE AFOREMENTIONED PROCEDURE.

Ruling on the Request for Injunctive Relief – E. Napier

 

Justice GRAY delivered the opinion of the Court.

 

It is the opinion of the court that Mr. Napier’s request for Injunctive Relief is to be granted. His trial is to be concluded, but if sentenced to death he will be held in custody and allowed a time of a year to file an appeal for the Supreme Court. Mr. Napier is not to be executed prior to this time.
