PERJURY ACT OF 343 ES

Introduced in the Duma.

 

An act to create the Henrician Oath and the offence of perjury.


 

INTRODUCTION

Since Our Kingdom’s independence in 339 ES, there has been much effort and focus on establishing an independent judiciary capable of distributing justice fairly and efficiently. To this end, the Haurul Caezk makes illegal certain activities that would obstruct and impede the judiciary’s ability to enact justice. Many legal proceedings are based solely on witness testimony, yet there exists no law prohibiting witnesses from lying to the Jovenaar.

 

I. THE HENRICIAN OATH

Before a witness may be called to give their testimony, the presiding Jovenaar over a legal procedure is required to ask the said witness the following oath in order to ensure their commitment to tell the truth. The witness will then affirm the oath accordingly:

 

Oath: “Do you swear before God and Man that your testimony today is the truth, only the truth, and nothing but the truth, under penalty of perjury?”

 

Affirmation: “I so swear.”

 

II. AMENDING HC 305

HC 305: Trial Procedure shall be amended to the following:

305.061: The presiding Jovenaar must administer the Henrician Oath to all witnesses before they may testify. Failure to do so may result in a mistrial.

 

III. AMENDING HC 419

HC 419: On Obstruction of Justice shall be amended to the following:

419.05: The crime of providing false testimony under oath during a trial of the Aulic Court, where the offender knows or can reasonably deduce to be pertinent, shall be a middling offence.
