As many of you already know there was a recent "server ad" sent out to players from LotC. There is nothing wrong with that, advertising is a completely legal thing. What worries me is, if the ad was sent to most of our players, then how did said server  obtain our emails. So that got me thinking, what if the /owners/ had downloaded them from the server. Once again there is no problem with them downloading our information so long as they don't use it for anything but personal viewing.

Use License
Permission is granted to download or copy any of the materials on The Lord Of The Craft’s web site for personal viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Use the materials for any commercial purpose, or for any public display (commercial or non-commercial)
  • Attempt to decompile or reverse engineer any software contained on The Lord Of The Craft’s web site
  • Remove any copyright or other proprietary notations from the materials
  • Transfer the materials to another person or “mirror” the materials on any other server

This license shall automatically terminate if you violate any of these restrictions and may be terminated by The Lord Of The Craft at any time. Upon termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

I feel as if at least two of these have been broken, "Use of the materials for any commercial purpose, or for any public display (commercial or non-commercial)," and "Transfer the materials to another person or "mirror" the materials on any server." The material being our emails.

Privacy Policy
Your privacy is very important to us. Accordingly, we have developed this policy in order for you to understand how we collect, use, communicate, disclose and make use of personal information. The following outlines our privacy policy:

  • Any personal information we collect is done by lawful and fair means and, where appropriate, with the knowledge or consent of the individual concerned
  • Forum profile information (including email addresses) is stored on our servers for as long as you have a forum account
  • Paypal and payment records are stored for the purpose of good record-keeping and planning (no credit card info is provided to us through Paypal)
  • We will protect personal information by reasonable security safeguards against loss or theft, as well as unauthorized access, disclosure, copying, use or modification
  • We will make readily available to customers information about our policies and practices relating to the management of personal information
  • We are committed to conducting our business in accordance with these principles in order to ensure that the confidentiality of personal information is protected and maintained

In this section of our "Terms of Conditions," you will see that LotC states that "We will protect personal information by reasonable security safeguards against loss or theft, as well as unauthorized access, disclosure, copying, use or modification." I trust LotC and believe that they are doing a wonderful job. A question I have is then how did said server obtain our information. They must of broken our "Terms of Condtions."

 

 

Our rights are being infringed upon! I personally don't care and would like to ask /you/ if you would like me to continue.

You're making a huge deal over nothing, honestly. Vaq+Avalier massed e-mail a bunch of LoTC e-mails. 

 

If something malicious happens, then you can all panic. Until then...

They aren't technically a part of LoTC anymore. Not sure if that gives them leeway in using a collection of e-mails but... shrug.

Let's hope people don't start posting parts of the Terms of Service in their status like those Facebook attention beggars.

It does not, especially if its using information gained from LoTC and used to advertise another server. Its like a Microsoft executive leaving and using the information he had at Microsoft to advertise his owner company, which is a legal no-no.

If Dungeon Realms was a commercial enterprise, it would be at the very least severely frowned upon - but it isn't, so this isn't so much of a big deal. 

 

I don't mind if they have my email, I only use it to activate accounts for things... Spam for the Spam god!

Although this isn't a massive problem, I can see your point. As long as these 'mass emails' don't regard for us to pay, it's more of just spam. But, yes, the fact this breaks terms of service is bad

 Yes, I feel the same way. The only thing that I do not appreciate is that fact that my rights have been infringed upon.

Players have no place to be worrying about things like this.  Let the administration deal with this, and get back to roleplaying.

Players have every right to worry about this

Do they manage LoTC?  No.  Can they do anything about this?  No.  The administration does, if they even want to do anything.
