Laws and Ordinances of the Onyx Enclave of Ker’nor

Theft

 

If accused of theft/larceny or any related crime(s), and convicted by the collective judicial system of The Onyx Enclave of Ker'nor, Perpetrators should expect for: their compliance in returning any and all stolen property to the victim(s) ¹, their immediate removal from any and all government position(s) until proven worthy of returning to said position(s), the branding of the face (cheek) to label them as a thief ².

Assault

 

If caught in the act of assaulting ³ a citizen or honoured guest of Ker'nor society within the jurisdiction of the Onyx Enclave, the witness or guard involved is authorized de jure to apprehend the perpetrator. Upon apprehension, the perpetrator is to be turned over to a higher official who may carry out (within reason) a choice from the following punishments:

Ten(10) to twenty(20) lashes in a public area

A private beating of the perpetrator involved 4

Incarceration for no more than one(1) elven day.

Murder

 

Murder is defined as the taking of another life with malice aforethought by any means. Any individual charged with murder, or attempted murder is to receive no less than the fullest punishments deliverable by the law. After due process, those convicted of murder are to be branded upon the face (forehead) to label them as a killer 2, and have their dominant arm removed at the shoulder 5, both by a presiding official with no background history with the individual (if possible). As a final punishment, the individual is to be sentenced to exile 6, and delivered from the city in stable condition.

Conflict Instigation

 

Instigation of conflict including but not limited to treason, slander, fight-picking, and loitering, is to be treated as a minor crime within/upon lands owned by the Onyx Enclave of Ker’nor. For the first three(3) obsurbed/reported offences, the perpetrator shall be served with verbal warnings of increasing intensity. After the third warning, a fourth is to be issued alongside a beating 4 by officials of the Onyx Enclave, the usual harm restrictions rendered unobserved for the duration of the punishment. At the fifth(5th) violation, the perpetrator is to be outrightly exiled from Onyx Enclave lands with a minimum period of two(2) elven months before appeal with a high ranking official may be had on foreign grounds.

False Gods

 

A ban is hereby placed upon the public and private worshipping of the false moon-goddess Velulaei, and of any eight legged arachnid, within/upon the land of the Onyx Enclave of Ker’nor or by any of her citizens. Those who fail to comply are to be faced with exile immediately. The duration of this exile 6 is indefinite.

Heresy

 

Slander 7, defamation of name, or associated actions directed towards the collective Ancestors, whether in writing, speech, art, or other medium, is to be met with immediate beating 4 by any official. If an official is not present, a citizen of Ker’nor is permitted  to take the law into their own hands so long as they may provide evidence of the perpetrator’s actions if questioned. Limits of beating in this case are restricted to broken bones.

Desecration

 

The Catacombs and Temple are considered holy places to the citizens of the Onyx Enclave of Ker’nor. Desecration, tampering, destruction, or other disruptive activities in either of these areas is a serious offence, and will be met with the maiming 8 of the perpetrator. Given a reasonable time for recovery, exile of the perpetrator will be immediate. The duration of this exile6 is indefinite.

¹:If property has been lost/fenced, the estimated Mina value as determined by the presiding official over the perpetrator's sentencing, is to be paid in full over the course of three(3)elven weeks. Failure to comply as such will result in an immediate incarceration proportional to the debt owed, and liquidation of any/all property an individual holds within The Onyx Enclave of Ker'nor to repay the victim

 

²: Any use of healing magic(s)/salve(s)/surgery or other methods to remove the official brand imparted by an official of The Onyx Enclave of Ker'nor will result in the immediate re application of a similar brand and twenty(20) lashings for evading punishment. Until the time ordained(if extant) by the presiding official, the brand is to remain visible within the walls of Ker'nor; upon expiration of set time, officials may be approached and inquired for purpose of the brand's removal.

 

³: Assault is defined by the Onyx Enclave of Ker’nor as a forced physical interaction between one party and another, leading to bodily, or property damage of the target party.

 

4:Beatings issued by an official may not last more than one(1) hour, and are not to result in damage greater than what was imparted unto the perpetrator’s victim. This is to say that if the victim sustains bruises and flesh wounds, the perpetrator may not receive more than broken bones.

 

5:Removal of a limb is to be reserved for the most heinous of crimes. Each removal is to be done with a curved dagger by a trained individual to maximize/minimize pain, situation dependant. A healer (magical or otherwise) is to be present at the removal to prevent fatal blood loss by/from the restrained individual.

 

6:Exile is defined by the Onyx Enclave of Ker’nor as the baring of one from any and all land owned by the Onyx Enclave, and land claims/allies beneath the aforementioned Onyx Enclave. He exiled is to be given ten(10) loaves of bread and locked outside city gates. From sunrise of the following day, any presence by the exile is to be either outrightly ignored or reported to an official, who will follow protocol accordingly thereafter.

 

7:Slander is defined by the city of Ker’nor as any non physical assault on another’s credibility which damages their reputation heavily (be they existing or supernatural). Slander may be launched against an individual, race, organization, nation, or (a collection of) deities.

 

8:Maiming is inherently less brutal than the removal of a limb, yet more serious a punishment than branding. The process entails a trained officer leaving purposeful scars and imperfections upon a target’s body without removing appendages. A healer is recommended for this process, but not required.

 

 

Addendum and Amendments

 

(1.1) Pertaining to Social Deviance:

The Enclave of Ker'nor defines social defiance threefold.
1). Social deviance may be demonstrated through (the dying of) one's hair. This encompasses not only the style one's hair might be worn in, yet further the pigment and tone presented. Unacceptable pigments of hair encompass a wide spectrum, any citizen may question an Vindicator/Sorcerer or above who will provide examples of such things. As a rule of thumb, any color which cannot (by nature) by presented in the hair of a Mali'ker will be considered unnatural. Exceptions are to be made on a case by case basis by Senior Officials.
 
2). Social deviance may be demonstrated through (any) unnecessary display of skin 1. Necessity is to be determined by those of Div'cruan, rank Vindicator/Sorcerer or above. As a rule of thumb, if the section of body being displayed would incur unnecessary attention drawn to it, or makes one (male or female) overly sexualized in appearance, the skin being shown is unlawful.
 
3). Social deviance may be demonstrated through (any) association with guilds, organizations, or gatherings of people(s) of what ever race with dark intentions 2. One who suspects another of such affiliation is to report to a member of the Div'cruan with this information, before legal action be enacted upon the party accused.

1 Skin which displays scars or tattoos containing significance to (or) pertaining to tribal or clan affiliation are allowed under the Onyx
Law and are encouraged to be displayed.
 
2 Dark intentions are defined by the Enclave of Ker'nor as the wishing or en-action of harm upon another, (Non-State-Sponsored) planned or enacted disruption of any organized group, and further any action which may disrupt the belief system or continued peaceful existence of the Enclave of Ker'nor.

Punishments for varying degrees of social deviance (in ascending order of severity)
1). Warning, Shaving of One's Head, Enforcement of a 'helm of shame', Public lashing
2). Warning, Enforcement of State Provided Robes, Public lashing
3). Death by Execution. 
 

 

(2.1) Concerning High-Profile Conflict1
Spoiler
 Under supervision of the Div'cruan 2, conflicting parties are to be tested against one another in a battle of honor to first blood 3. The winner of such a conflict is declared by the Enclave of Ker'nor to be in the right, in terms of the contested situation 4. Those who violate this both cultural and lawful guideline are to be tested at the hand of the law, with punishment resulting in no less than a number of lashes proportional to the severity (of the dishonor) committed by one or more individuals, or parties.

1 High-Profile Conflict is defined by the Enclave of Ker'nor as conflict, (Physical, Logical, or Political) between two parties as either individuals or groups. NB. If groups are in a state of High-Profile Conflict, 1 (one) representative may be elected by the groups presented to participate in conflict resolution activities.
 
2 In this circumstance, Div'cruan of the rank of Vindicator/Sorcerer or above need be present.
 
3 Battle will be carried out with wooden implements sharpened to code by a member of the Div'cruan of rank Vindicator or above, or in the case of a feud between rival clans- Relics belonging to such. Battle will be carried out to first blood, and is to be called to an end immediately thereafter. Failure to do so will result in punishment, and an automatic forfeit of an honorable victory.
 
4 The contested situation may be overturned in favor of the opposing party with a 3/4 vote of a council consisting of the Head of Government, Primarch, Ordinator, and a fourth un-specificed council member. If any one member is involved in the conflict, the rest will hold a vote without the implicated party. If 2 parties of the voting council are involved in High-Profile Conflict, there will be no way to overturn such a decision determined by conflict resolution.
 
The contested situation may at any time be overruled by the standing Head of Government.

Punishments for Violation of protocol in pertinence to High-Profile Conflict:
1). Punishments range on a case by case basis. The least punishment given may be the detaining of a belligerent for a set number of hours decided on jointly by a member of the Archonic force and Lord of Law.
 
(2.2) Concerning Affairs of the Div'cruan
Spoiler
A list of members of The Div'cruan of the Enclave of Ker'nor (defined from rank(s) Aspirant to Ordinator), may be obtained through direct questioning (be it through formal written notice or otherwise) of an individual of rank Hierarch/Magos or above, or viewing of public records. The members of this force: by citizens, mercenaries, and non-citizens alike, are to be treated as an absolute authority in pertinence to cases of:
  • Civil Dispute
  • Marital Conflict
  • Handling of Criminal Activities/Behaviors
  • Nationalization of Property
  • Acquisition of Resources from Surrounding Lands
 
Extenuating circumstances may allow for this absolute authority to be overridden. These cases are exclusively reliant upon the word of the Ordinator, who may grant permits to a group, or individual, which allow the temporary authority of Div'cruan.

Punishment for Interference of Archonic Affairs:
1). Punishments range on a case by case basis. The least punishment given takes the form of a verbal warning, where the most severe is to be limited to exile of an individual.
 
 
(2.3) Concerning Freedom of Speech

The Enclave of Ker'nor as a whole welcomes separate viewpoints to current events along with constructive criticism 1 towards individuals (in leadership position), along with their actions. No citizen is to be denied their freedom to express a socially appropriate 2 opinion, fact, or question in public areas.

1 The Enclave of Ker'nor defines the criticism of individuals to be (appropriate) when the name of aforementioned individual is not being slandered, defamed, or their actions condemned without proper trial carried out under the watch of the Div'cruan. The Ordinator, or higher, may override this stipulation at will for himself, or any citizen of the Enclave.
 
2 The Enclave of Ker'nor defines 'appropriate' in the field of: opinions, facts, questions, statements, and so on as (any) one of the aforementioned list which does not threaten the stability of the Enclave of Ker'nor, nor any other sovereign state supported by the Enclave. Any questions on such a statement may be passed through a member of the Div'cruan of rank Vindicator or above. Confirmation will be provided within the elven day as to whether the aforementioned statement(s) are harmful to Mali'ker interests.

 

(10.1) Edict of Fornication Standardization

The Enclave of Ker'nor currently reserves three stipulations to the relations of what which Mali'ker may hold whilst under the Enclave's protection of law and corporal being.
 
 
1). The Enclave of Ker'nor and associated entities herein define (for the citizens of Ker'nor of Mali'ker descent), baring exceptions1 made by the state, that no Mali'ker is to copulate, or form a union with a member of any non-elven race.
 
2). As per previous events, the Enclave of Ker'nor officially prohibits excessive public displays of affection2 in public areas3 of Enclave lands. Such aforementioned displays of affection are more than welcome in a private setting4.
 
3). The Enclave of Ker'nor reserves the right to deny any State-recognized Mali'ker marriage or acknowledged civil union to another party of varying race until the aforementioned Mali'ker has provided 2(two) children or additional citizens to the state5. At such a point, the Mali'ker in question is free to do as they please6 within reason.

Exceptions to the law are to be ordained only by either the Head of Government, or the Primarch. 
 
2 Excessive displays of affection are defined by the Enclave of Ker'nor to include but are not limited to:
  • Excessive physical contact below the waist
  • 'Kisses' where one or more participants must 'come up for air'
  • Any sexual act
  • Any form of biting, nibbling, licking, etc
 
A member of the Div'cruan of rank Vindicator or above may determine if a display of affection is 'Excessive' in nature.
 
Public areas are defined by the Enclave of Ker'nor as areas not blocked off in any fashion within Enclave lands where one or more passersby may accidentally walk through.
 
4 Private areas are defined by the Enclave of Ker'nor as areas blocked off from public eyes either by door, stone, iron bars, or other means of denying entry.
 
5 An alliterative to providing children to the Enclave of Ker'nor is to coerce or convince two or more Mali'ker of at least half-breed origin to live within Enclave lands and acknowledge themselves as citizens.
 
6 If any half-breed children are generated from a union between a full-blooded Mali'ker and a member of another race, they are to be treated as a half-breed in terms of race, yet a citizen of the Enclave with full Mali'ker rights for the sake of persecution and benefits.

Punishments for violation of the Edict of Fornication Standardization:
Punishments are determined on a case by case basis. Violations of this edict are considered extremely heinous in nature, and are to be treated with the utmost scrutiny.

(10.1.1) Daevion'lyr vs The Ancillary of Ker'nor

Upon basis provided by the trial of Daevion'lyr vs The Ancillary of Ker'nor, an amendment to the Edict of Fortification Standardization(10.1) is hereby made:
 
4). The Enclave of Ker'nor does not recognize unions of Mali' kind where one participant is under the age of 50(Fifty), and the other is more than 30(Thirty) years older. Once over the age of 50(Fifty), Mali'ker have free right (within aforementioned guidelines) as to who they choose as a mate.

Punishments in violation of Amendment 1.1 to the Edict of Fortification Standardization:
4). Punishments for this crime take two forms, either immediate execution of both parties involved, or the forced union and work of both parties involved for no less than 30(thirty) years. Any violation of union or infraction of law by either party for this time will result in the immediate execution of the violator, and the exile of the surviving partner along with any family that may have been accumulated.

Vas notices that these laws seem to be the same as before, and that nothing seems to have changed now. He begins to make fun of the mali'ker that would be complaining about nonexistent changes, finding it comical.
