The Haensetian Criminal Code

Drafted on the 8th of the Amber Cold, 1669

 

The laws encoded in this text are binding to all denizens of the Kingdom of Haense, both commonfolk and nobility alike. Similarly, any person or creature found violating a section of the Haensetian Criminal Code (hereby known simply as the HCC), whilst in the Kingdom of Haense, will be subject to punishment as laid out in the HCC regardless of their international affiliation.

 

The authority to deal out punishment lies in the hands of the King of Haense, the Lord Justicar, and any authorized agents of the aforementioned. In this codex, the term “The Crown” shall be used when referencing either of the aforementioned. The powers of these authorized agents shall be laid out in broader terms in later editions of the HCC. The HCC is subject to amendments, following a ⅔ majority vote in favour of the amendment(s) in the Aulic Council of Haense.

Crimes Against Property

  1. Unlawful Construction
    1. Any person or creature who, without lawful permits for construction, builds a structure of any sort, on any land owned by the Crown or by a lawful denizen, is guilty of Unlawful Construction
    2. Punishment: The minimum punishment for this offence is a fine of two hundred (200) minas, for a first offence. For subsequent offences, the authorized agent is given discretion in regards to the amount of the fine.
  2. Unlawful Deconstruction
    1. Any person or creature who, without lawful permits for deconstruction, removes a structure of any sort, on any land owned by the Crown or by a lawful denizen, is guilty of Unlawful Deconstruction
    2. Punishment: The minimum punishment for this offence is a fine of five hundred (500) minas, for a first offence. For subsequent offences, the authorized agent is given discretion in regards to the amount of the fine.
  3. Destruction of Property
    1. Any person or creature who, without permission from the owner, damages or removes any structure or item, on any land owned by the Crown or by a lawful denizen, is guilty of Destruction of Property
    2. Punishment: The minimum punishment for this offence is a fine of seven hundred (700) minas, for a first offence. For subsequent offences, the authorized agent is given discretion in regards to the amount of the fine.
  4. Arson
    1. Any person or creature who sets fire to any building or structure, within the Kingdom of Haense, regardless of how much damage is done, is guilty of Arson.
    2. Punishment: The minimum punishment for Arson is fifteen (15) lashings and a fine of six hundred (600) minas. The maximum punishment shall not be greater than thirty (30) lashings, and one thousand (1000) minas.
  5. Theft
    1. Any person or creature who takes into their possession, any item, which lawfully belongs to another person or creature, is guilty of Theft.
    2. Punishment: The minimum punishment for Theft is twenty-five (25) lashings. The maximum punishment shall be no more than forty (40) lashings.
  6. Burglary
    1. Any person or creature who:
      1. Enters a structure, lawfully or unlawfully, with the intent to commit a crime
      2. Breaks into a structure with the intent to commit a crime, is guilty of burglary
    2. Punishment: The minimum punishment for burglary is twenty-five (25) lashings.
  7. Poaching
    1. Any person or creature who captures or hunts any creature, in lands owned by the Crown or by a lawful denizen of Haense, without permission from the owner of said land, is guilty of poaching
    2. Punishment: The minimum punishment for poaching is fifteen (15) lashes. Additionally, the convicted person or creature must produce the poached creature, or provide monetary compensation.
  8. Trespassing
    1. Any person or creature who enters a person’s lawful property, without permission, is guilty of trespassing
    2. Punishment: A fine of two hundred (200) minas.

 


Crimes Against Persons

  1. Defamation
    1. Any person or creature who says or writes anything, untrue in nature, that harms the reputation of another person or creature, is guilty of defamation
    2. Punishment: A fine of three hundred (300) minas, and a public apology for defaming the victim.
  2. Fraud
    1. Any person or creature who:
      1. Pretends to be another person for the purpose of deception
      2. Is deliberately deceitful to secure anything, unlawfully
    2. Is guilty of Fraud
    3. Punishment: A minimum fine of four hundred (400) minas.
  3. Robbery
    1. Any person or creature who uses violence or threat of violence, to commit theft against another person or creature, is guilty of Robbery
    2. Punishment: The minimum punishment for Robbery is thirty (30) lashings and a fine of three hundred (300) minas.
  4. Assault
    1. Any person or creature who attacks another person or creature, is guilty of assault
    2. Punishment: A minimum punishment of thirty (30) lashings.
  5. Aggravated Assault
    1. Any person or creature who attacks another person or creature, whilst using a weapon, is guilty of aggravated assault
    2. Punishment: The dominant hand of the convicted shall be removed, and they shall be fined six hundred (600) minas
  6. Kidnapping
    1. Any person or creature who takes another person/creature away, illegally or by force, is guilty of kidnapping
    2. Punishment: Blinding.
  7. Attempted Murder
    1. Any person or creature who prepares to commit an unlawful killing but fails to do so, is guilty of attempted murder.
    2. Punishment: The penalty for attempted murder shall be death. Method of execution is at the discretion of the King or Justicar.
  8. Murder
    1. Any person or creature who unlawfully takes the life of another person or creature, is guilty of murder
    2. Punishment: The penalty for murder shall be death. Method of execution is at the discretion of the King or Justicar.
  9. Manslaughter
    1. Any person or creature who takes the life of another, whether it be through an accident or other circumstance not amounting to murder, shall be found guilty of manslaughter
    2. Punishment: The minimum penalty for manslaughter is thirty (30) lashings. Discretion is granted to the authorized agent whether or not to maim the accused. Capital punishment is not permitted for this charge.

 

Crimes Against the State

  1. Conspiracy to Commit Treason
    1. Any person or creature who attempts to:
      1. uses force or violence for the purpose of overthrowing a governing agent or governing body of Haense
      2. Reveal state secrets of any sort to a non-Haensetian entity
    2. … is guilty of conspiracy to commit treason
    3. Punishment: Capital punishment
  2.  Sedition
    1. Any person or creature who acts or speaks in a way that incites others to take up arms against a governing body is guilty of sedition
    2. Punishment: Capital punishment
  3. Treason
    1. Any person or creature who:
      1. Uses force or violence for the purpose of overthrowing a governing agent or governing body of Haense
      2. Reveals state secrets of any sort to a non-Haensetian entity
    2. ...is guilty of treason
    3. Punishment: Capital punishment
  4.  High Treason
    1. Any person or creature who:
      1. Kills or attempts to kill the ruling monarch of Haense
      2. Kills or attempts to kill a member of the royal family of Haense
      3. Assists an enemy at war with Haense
      4. Actively supports war against Haense
    2. ...is guilty of high treason
    3. Punishment: Capital punishment
  5.  Espionage
    1. Any person or creature who, on behalf of a foreign entity, attempts to undermine the Kingdom of Haense in any way, is guilty of espionage
    2. Punishment: Capital punishment
  6.  Absconding/ Resisting Arrest
    1. Any person or creature who attempts to resist lawful detainment by an authorized agent of the Crown is guilty of resisting arrest.
    2. Punishment: Minimum of fifteen (15) lashes and a fine of eight hundred (800) minas.
  7.  Obstruction of Justice
    1. Any person or creature who interferes with the duty of an authorized agent of the Crown is guilty of obstruction of justice
    2. Punishment: A minimum fine of five hundred (500) minas shall be imposed.
  8.  Tax Evasion
    1. Any person or creature who purposely fails to submit taxes to the Stewardship of Haense is guilty of tax evasion
    2. Punishment: A minimum fine of four hundred (400) minas shall be imposed, in addition to the immediate payment of the missing taxes.
  9.  Bribery
    1. Any person or creature who attempts to sway the mind or actions of a public official, through the promise of compensation, is guilty of bribery.
    2. Punishment: The dominant hand of the briber shall be removed.
  10.  Impersonation of an Agent of the State
    1. Any person or creature who unlawfully claims to be acting on behalf of the state, is guilty of impersonation of an agent of the state
    2. Punishment: A minimum punishment of twenty (20) lashes, and a fine of three hundred (300) minas.

 

Crimes Against God

  1.  Heresy
    1. Any person or creature whose religious views contradict those of The One True Faith is guilty of heresy
    2. Punishment: The punishment for heresy is fifteen (15) lashings, and forced conversion. Should the convicted refuse to convert, their forehead shall be branded with a large letter “H”, for heretic.
  2.  Blasphemy
    1. Any person or creature who acts or speaks in offense of GOD, is guilty of blasphemy
    2. Punishment: Removal of the tongue.
  3. Apostasy
    1. Any person or creature who abandons their faith in GOD is guilty of apostasy.
    2. Punishment: Minimum of fifteen (15) lashes, and forced reconversion. Should the convicted refuse to accept GOD once more, their forehead shall be branded with a large letter “H”, for heretic.
  4.  Devilry
    1. Any person or creature who:
      1. Takes part in wicked activities
      2. Practises dark magic, or possess any item of dark magic
      3. Seeks to corrupt the religious beliefs of a man of GOD
    2. ...is guilty of devilry
    3. Punishment: Burned at the stake.
  5. Impersonating a Clergyman
    1. Any person or creature who claims to be a member of the clergy, when in actuality they are not, is guilty of impersonating a clergyman.
    2. Punishment: Thirty (30) lashings
       

 

Crimes Against Society

  1.  Disturbing the Peace
    1. Any person or creature who engages in conduct that goes against the tenets of society, including (but not limited to) fighting or producing excessive amounts of noise, is guilty of disturbing the peace
    2. Punishment: A fine of one hundred (100) minas
  2.  Rioting
    1. Any person or creature who partakes in a violent public disturbance, in which the participants act as a mob, is guilty of rioting
    2. Punishment: A fine of four hundred (400) minas. Leaders of a riot may be charged under Section 19, Sedition
  3.  Vigilantism
    1. Any person or creature who “punishes” those who break the law, yet are not authorized agents of the Crown, is guilty of vigilantism
    2. Punishment: A minimum fine of five hundred (500) minas, and a maximum fine of thirty (30) lashings.
       

 

Crimes Against Morality

    1. Any person or creature who partakes in the consumption of another person or creature of their race, is guilty of cannibalism
    2. Punishment: Capital punishment.
  2.  Conspiring with Ungodly orders
    1. Any person or creature who:
      1. Joins a group of non-living beings
      2. Assists a group of non-living beings in any way, shape or form,
      3. Joins or assists a group of otherworldly beings
    2. ...is guilty of conspiring with ungodly orders
    3. Punishment: Capital punishment
  3.  Witchcraft
    1. Any person or creature who
      1. Possess items associated with the occult
      2. Uses items associated with the occult
      3. Promotes the tenets of occult entities
    2. … is guilty of witchcraft
    3. Punishment: Burning at the stake
  4. Adultery
    1. Any person or creature who performs sexual acts with another person/creature who is not their spouse, is guilty of adultery
    2. Punishment: Public shaming at the stockades. Discretion for further punishment is given to authorized agents.
  5. Indecency
    1. Any person or creature who
      1. Dresses indecently
      2. Performs an indecent gesture
      3. Acts indecently
    2. ...is guilty of indecency
    3. Punishment: A fine of one hundred (100) minas
