Resisting Arrest Bill of 357 ES

Introduced in the Duma.

 

An act to make illegal the act of resisting arrest

 


 

INTRODUCTION

This bill will outlaw the action of resisting arrest when placed under by a guard

 

I. Necessary Definitions

  • Resisting Arrest- When an HRA member with proper authority places someone under arrest but that person resists. This can be actively resisting through violence or repeated willful disobedience of the arresting HRA member’s orders. 

  • Additions to section 419: On Obstruction of Justice shall be bolded

 

II. Amendments

  • 419: On Obstruction of Justice

  • 419.01: The crime of failing to disclose knowledge of a wanted fugitive, whom the offender knows or can reasonably deduce to be wanted, shall be a middling offence;

  • 419.02: The crime of failing to disclose any information pertinent to a crime, where the offender knows or can reasonably deduce to be pertinent, shall be an minor offence;

  • 419.03: The crime of harboring or aiding a wanted fugitive, whom the offender knows or can reasonably deduce to be wanted, shall be a middling offence;

  • 419.04: The crime of holding stolen goods, which the offender knows or can reasonably deduce to be stolen, shall be a minor offence.

  • 419.05: The crime of providing false testimony under oath during a trial of the Aulic Court, where the offender knows or can reasonably deduce to be pertinent, shall be a middling offence;

  • 419.06: The crime of resisting arrest shall constitute a middling offence
