We, the Ministry of Civil Affairs, do so release, in accordance with the Public Record Act of 1751, Transparent Law Act of 1817 & beneath the authorization of the Crown, this Act of the Imperial Diet. It shall, as assented within the purview of the Crown, henceforth be enacted and executed as laws, as this document shall serve as the official confirmation of ascension of the Crown. And so it shall, as demanded of the Crown, be transcribed within the Orenian Revised Code wherein this Act of the Imperial Diet shall remain until amended.

INTRODUCTION

In the Ruling on the Appeal in Crown v. Napier, the Supreme Court unanimously cited a facet of Napier’s granted appeal being contingent on a textualist flaw within the Double Jeopardy Act. Specifically, the court stated that with the nature of the bill’s wording, appeals on procedure could be used to bypass criminal liability. This bill seeks to clarify the wording on this aforementioned act to prevent further misinterpretations, and to strengthen this legal defense for the Rights of Man. 

 

SECTION I

On Amending the Orenian Revised Code

 

CH - 210.11A currently reads,

210.11A - Where an individual has been tried for a crime in a previous court of law, that individual cannot be tried again for the same crime. 

 

This shall be amended to,

 

210.11A - Where an individual has been tried for a crime in a previous court of law, and has already exhausted appeal to the Supreme Court, that individual cannot be tried again for the same crime. 

210.11A - This bill does not apply if new and compelling evidence has arisen after appeal has been exhausted.
