The faithful and the Righteous

 

In hopes to bridge the gap between Canon Law and Balian Law The Office of the Magister and the Crown of Balian has seen fit to issue a statement on ecclesiastical penalties the Crown and State will respect.

 

Canon Law regards bringing someone back to righteousness with GOD for their sins and the law of Balian regards bringing someone to justice for their crimes.

On the five Ecclesiastical Penalties used by Canon Law

The Ecclesiastical Penalty of penance: shall be allowed within The Kingdom of Balian as long as it does not come with the cost of life nor bodily harm, such matters must be discussed with the Crown and Magister.

 

The Ecclesiastical Penalty of Personal Interdiction: shall be allowed as it covers Church grounds and services and sacred places of the canonist faith. However it may not ban people from entering other areas that have not been granted to the Church by the Crown, such matters must be discussed with the Crown. Notwithstanding this, the Church is requested to submit a list of subjects of Balian that has been issued the Ecclesiastical Penalty of Personal Interdiction to the crown, to ensure no problems may be caused.

 

The Ecclesiastical Penalty of Provincial Interdiction: will be respected by the Crown, and the church may enact it without any obstacles.

 

The Ecclesiastical Penalty of Excommunication: will be respected by the Crown, and the church may enact it without any obstacles.

 

The Ecclesiastical Penalty of Anathematization: will be respected within the Kingdom for but the safety of the people, the Kingdom and the faithful comes first

On military or armed authority

As per The Royal Codex of Balian Law
 

204.013 - On Unauthorized Military Organizations 

 

204.013A - When an individual intentionally or negligently operates as a part of an organization that meets the definition of a private military organization and is operating under an expired authorization, this shall be an Unauthorized Military Organization an infraction. 

 

204.013B - When an individual intentionally or negligently operates as a part of an organization that meets the definition of a private military organization and has not received proper authorization, this shall be an Unauthorized Military Organization 

a misdemeanor.

 

Thus should the Church of Canon deem it fit to send in armed forces or Holy Orders into Balian and its lands. The Crown requests the church to send a formal letter, expressing the reasoning why and how many men they are sending in and for how long the armed forces or orders in question wish to be staying and operating within the Kingdom. Failure to do so, the armed forces or holy orders will be prohibited from enacting their will on others until such is fulfilled.

 

As in regards of
CHAPTER 1. RECOGNITION OF TEMPORAL OF AUTHORITIES

 

§1. Temporal authorities may have the quality of licity, which spiritually obliges Canonists to obey their orders.

§2. Temporal authorities lacking licity are illicit, that is, having no just or virtuous claim to the exercise of their power.

§3. The faithful are not spiritually obliged to obey illicit temporal authorities.

§4. Temporal authorities are assumed to be licit unless expressly provided.

§5. Only the High Pontiff shall rule on the licity of temporal authorities.

 

From the Codex Iurius Canonici Danielus Pontifex, Second Edition

 

Should the Church armed forces or Holy Orders be allowed within the lands of Balian, they maintain the right to investigate but not detain without consulting the Crown, should the need the for armed conflict arise the Company of Balian shall be called to assist to ensure the ordeal is resolved properly and within the rights and laws of Balian, should this not be done, a meeting with the Pontiff, and Order leader and Crown shall ensue to resolve the issue.
