KAETHUL’S CONSTITUTION

As written by Athri'annyer (Whatasithuation)

Every individual is entitled to certain inherent rights and freedoms, including but not limited to life, liberty, and the pursuit of happiness so long as it does not infringe on others well-being. All citizens and visitors are granted equality before the law, regardless of race, gender, religion, or other characteristics.

 


 

On Soulless Constructs and Cursed Children:
For a construct to become a citizen they must register their creator's name with the Overlord or a High Lord to be filed incase of issue.

Cursed Children must go through a darkspawn test with the Overlord or a High Lord so it may be documented to avoid misunderstandings with foreign nations. The effort to receive this documentation should be made by the Cursed Child, lest they be under the age of eighteen.

 


 

State Licenses and Permits: 

A permit or state license costs 100 mina’s, or 1 Golden Ducat (10 Silver Ducats) to acquire and will require an interview. One can obtain a permit through sending a letter to the Overlord, or a High Lord.

  • To sell or give anything that is addictive by nature or has the power to create a dependency must be prescribed by someone with a Doctor's License.
  • To make or sell anything that is addictive by nature, poisonous or has the power to create a dependency requires an Alchemists Permit.
  • Practicing Magic or Alchemy that can alter the state of a being's appearance requires an Alteration Permit.
  • To cash in Sentinel bounties at the tavern bounty board, or to actively hunt within Kaethul’s territory for foreign bounties requires a Bounty License. In special cases a Temporary Bounty License can be provided, such as in the case of a paladin order making a request to hunt a specific darkspawn in a politically tense situation.
  • Soulless Constructs may go through an interview and critical thinking test to obtain a Construct permit where they act as their own entity and are responsible for their own behavior in regards to the law system rather than their creators. 
  • To actively defend someone in the court of law requires a Law License.

 


 

 

Of Legal Age:

The legal age for purchase or consumption of alcohol, tobacco, recreational drugs, and casino chip products rests at the age of 18 for all races. Children who break the law are treated on a case by case basis and always require a trial with their guardians' attendance should they have one. 

 


 

Duels:
Should a disagreement between two parties transcend desire of payment with both parties agreement a duel can be held. Each duel’s rules may be different so long as they are agreed upon by both parties. A formal contract is signed and archived and then the duel must take place within one saints or elven week. Failure to arrive at said duel after the contract has been signed will result in a greater fine. Both parties must be of legal age to participate in a duel.

 



Arrest Procedure: 

The Continuum of Force is used to apprehend the suspect where they are arrested and placed within a cell. Stated victims and witnesses should be interviewed and their account should be written down. The suspect then should be interviewed afterwards on their account. Should the victim wish to press charges, then the suspect can either pay bail to clear said charges, or be temporarily banished until a state trial may be held.

 


 

Warrants: 

Search and entry warrants may be granted by the Overlord, High Justicar, High Arbiter, Royal Arbiters, and Justicar.

 


 

State Trials: 

Both parties are granted unbiased lawyers disconnected to the event in question to present their parties' case and may choose to work with Kaethul’s Sentinels or independent hired investigators to gather more information, or evidence.

Should the Overlord not be present to oversee a trial as judge, they may appoint one outside of the conflict, well educated on matters of Kaethul law with a history of just behavior to stand in their place. Should the suspect not show for their designated trial date and time, they shall be considered guilty and added an additional fine onto their banishment. 

 


 

 

The Aqueducts
This area is too large to actively be patrolled by Sentinels rendering a lawless portion of the land. Travel through at your own risk. The aqueducts exist to filter fresh water for the city, providing clean drinking water through an advanced plant based and enchantment additive filtration system, and equally provide controlled mineral rich irrigation to Kaethul Farmland.

 


 

CRIME AND BAIL

Crimes are generally graded into three categories: felonies, misdemeanours and infractions. Often the criminal intent element affects a crime’s grading
 

INFRACTIONS:
Infractions are the least serious crimes and include minor offenses. Infractions are generally punishable by a fine or alternative sentencing of community service.

 

MISDEMEANOURS:
Misdemeanours are less serious than felonies, either because the intent requirement is of a lower level or because the result is less extreme. They are punishable by a fine, or alternative sentencing like probation, rehabilitation, or community service, or military service etc. 

 

FELONIES:

Felonies are the most serious crimes. They are either supported by a heinous intent, like the intent to kill, or accompanied by an extremely serious result, such as loss of life, grievous injury, or destruction of property. Depending on the jurisdiction and the crime, the sentence could be execution, banishment, a fine, or alternative sentencing such as probation, rehabilitation, and home confinement. Potential consequences of a felony conviction also include the inability to own a weapon, or even participate in certain careers.

 


 

Minas to Ducat Conversion: 100 Minas or 2 Golden Ducats (20 Silver Ducats)

 

Bail can be denied depending on the severity and situation of the crimes by the Overlord, High Justicar, High Arbiter, Royal Arbiters and Justicar.

LAW DEFINITIONS
Aggravated Assault: 
Aggravated assault is the most serious form of assault short of actually causing death. A person can be convicted of aggravated assault when their actions lead to another person being wounded, maimed, disfigured, or if they endanger someone's life.
Aiding and Abetting/Accessory: In general, aiding refers to differing degrees of support, and abetting involves encouragement. Serving as an accessory usually involves actions taken to protect the perpetrator after the crime is committed.
Arson: The act or crime of willfully, wrongfully, and unjustifiably setting property on fire
Attempt: The act or an instance of trying to do or accomplish a crime.
Operating Without a State License or Permit: Attempting to kill or arrest within Kaethuls neutral territory without a state approved license. Or sell and distribute goods that require a State Permit.
Bribery: Bribery refers to the offering, giving, soliciting, or receiving of any item of value as a means of influencing the actions of an individual holding a public or legal duty.
Burglary: The crime of entering a structure (such as a house or commercial building) with the intent to commit a felony (such as theft)
Child Abandonment: Abandonment may be physical (parental absence) or emotional (refusal of the parents to provide affection, care, or stimulation).
Child Abuse: Child abuse includes physical, emotional abuse and/or neglect. It also addresses a pattern of abuse and risks of harm.
Conspiracy: A conspiracy, also known as a plot, is a secret plan or agreement between people (called conspirers or conspirators) for an unlawful or harmful purpose, such as murder, treason, or corruption, especially with political motivation, while keeping their agreement secret from the public or from other people affected by it.
Criminal Contempt of Court: Criminal contempt of court refers to disobedience of an order of the court which carries criminal penalties. Common examples of conduct which may result in criminal contempt of court charges include insulting the judge or creating a disturbance at trial.
Dark Magic Enchanted items made through the use of another descendant's well-being is forbidden, as well as harmful practice of dark magic that negatively affects others' health or quality of life. (Soul stealing, Sacrifice, Forceful corruption, etc)
Destruction of Property: Property destruction is defined as damaging personal or public property (e.g., breaking an object into two or more pieces, using an object to break other objects, ripping objects or parts of objects from walls, floors, or furniture, objects, or walls.)
Disorderly Conduct: (1) Engages in fighting or threatening, or in violent behavior. (2) Uses language, an utterance, or gesture, or engages in a display or act that is obscene, physically threatening or menacing, or done in a manner that is likely to inflict injury or incite an immediate breach of the peace.
Embezzlement: Embezzlement occurs when someone steals or misappropriates what they were entrusted to manage or safeguard.
Extortion: Extortion is the wrongful use of actual or threatened force, violence, or intimidation to gain money or property from an individual or entity.
Forgery: The action of forging or producing a copy of a document, signature, banknote, or work of art.
Fraud: “Fraud” is any activity that relies on deception in order to achieve a gain. Fraud becomes a crime when it is a “knowing misrepresentation of the truth or concealment of a material fact to induce another to act to his or her detriment”
Harassment: Harassment is a form of discrimination. It includes any unwanted physical or verbal behaviour that offends or humiliates you. Generally, harassment is a behaviour that persists over time. Serious one-time incidents can also sometimes be considered harassment.
Hate Crimes: A crime, typically one involving violence, that is motivated by prejudice on the basis of ethnicity, religion, sexual orientation, or similar grounds.
Identity Theft: The act of taking on the identity of another for the use of personal gain or without their permission through the use of alchemical or magical means.
Kidnapping: The action of abducting someone and holding them captive.
Manslaughter: Involuntary: Involuntary manslaughter is defined as an individual who has committed an unlawful killing without an intention to cause grievous bodily harm or kill the victim, causing the death by recklessness or gross negligence instead.
Manslaughter: Voluntary: The provocation must be such that it would cause a reasonable person to act impulsively, without having time to cool down.
MIP - Minor In Possession: A minor in possession, or MIP, is a criminal offense that occurs when a person is found to be in possession of alcohol before they are of legal age.
Murder: First Degree: Murder is first degree murder when it is planned and deliberate.
Murder: Second Degree: Second degree murder is homicide that is committed intentionally but is not premeditated or planned.
Perjury: Perjury (also known as foreswearing) is the intentional act of swearing a false oath or falsifying an affirmation to tell the truth, whether spoken or in writing, concerning matters material to an official proceeding.
Probation Violation: Probation violations happen when a probationer fails to follow the rules of their probation.
Robbery: The unlawful taking away of personal property from a person by violence or by threat of violence that causes fear : larceny from the person or immediate presence of another by violence or threat of violence and with intent to steal.

Theft: 
The taking and removing of personal property with intent to deprive the rightful owner of it.
Stalking: Stalking is a pattern of repeated and unwanted attention, harassment, contact, or any other course of conduct directed at a specific person that would cause a reasonable person to feel fear,
Substance Abuse: The overindulgence in or dependence on an addictive substance, especially alcohol or drugs.
Tax (Rent) Evasion: The illegal nonpayment or underpayment of tax (rent). (Without posting in the absence channel in the Kaethul discord) Individuals that fail to pay their due taxes may be investigated by the Sentinels and potential fines may be given.
Terrorism: The unlawful use of violence and intimidation, especially against civilians, in the pursuit of political aims.
Treason: The crime of betraying a nation or a sovereign by acts considered dangerous to security. Ttreason also includes the levying of war against the government and the giving of aid and comfort to the monarch's enemies.
Vandalism: The willful or malicious destruction or defacement of public or private property

Trespassing: Trespassing refers to one who enters the owner's property without permission.

Sermi would scan over the stack of law papers, working to commit each to memory. There was a certain fondness for many of the words that had been wrote for it. Coming from a Canonist nation, the thought that all could be treated equal was /strange/ at times. With a quick flick of her glance to the line outside her forearm, from a recently applied darkspawn test - she wondered what the future held, if not only endless fuel for ambition and coin.
