PREAMBLE FOR THE MARNANTINE PANDECT ON KINGLY REALMS

 

“There exists a social contract between the governed and the government. This is the foundation of our creed. But government, in its many forms, must not only be limited by principles and jurisdictions, but also divided up into determined realms, as per the needs and requirements of the governed. The authority of central government and provincial government must not, by inherent right, be in a state of conflict. With the codification of the rights and duties of such kingly realms, we Josephites may establish, in accordance with our most earnest principles, a solution to this eternal dispute, for the furtherance of the commonwealth of humanity.”

THE ROYAL RIGHTS

 

The kingly realms within the Holy Orenian Empire shall retain, in accordance with the natural law of man and the Josephite Creed, the following rights and privileges.

 

• THE RIGHT TO REPRESENTATION, in reference to the presence of a democratic, empowered and fair representation of the interests of the kingly realms within the legislature of the realm,

• THE RIGHT TO PROTECTION, in reference to the total and absolute protection of the kingly realms from all aggression, both internal and external,

• THE RIGHT TO PROPERTY, in reference to the maintenance of the rights of lawful property owners from molestation,

• THE RIGHT TO TITLE, in reference to the maintenance of the pre-existing kingly title, in accordance with the principles of agnatic succession codified by the Fifth Empire,

• THE RIGHT TO ROYAL LETTERS, in reference to the entitlement, upon those nobles who belong to valid noble families already possessing Imperial-issued writs of ennoblement, the royal letters which entitle them to hold landed nobility rank,

• THE RIGHT TO CONSULTATION, in reference to the consultation of the kingly governments by the Emperor for the compilation, codification, amendment and ratification of the Imperial Constitution, which enumerates the further rights, privileges, duties and jurisdictions of the commonwealth realm,

• THE RIGHT TO CHARTER, in reference to the capacity of kingly governments to create, as needed, their own knightly chivalrous orders.

 

THE ROYAL DUTIES

 

The kingly realms within the Holy Orenian Empire, on their understanding of union and commonwealth for the betterment of man, shall retain the following duties and obligations.

 

• THE DUTY OF TAXATION, in reference to the duty of the kingly realms to contribute, fairly and equally, taxation revenues to the Imperial commonwealth, subject to the approval of the legislature,

• THE DUTY OF UNITARIANISM, in reference to the recognition of the Holy Orenian Empire as a unitary state, for the furtherance of the commonwealth of mankind, with the recognition of the Holy Orenian Emperor as the constitutional embodiment and limited executive of the human race, highest in rank and warranting loyalty and obedience as part of the reciprocal social contract,

• THE DUTY OF ACCESSION, in reference to the recognition of the primacy of Imperial law and policy over provincial law, on the provision that this enacted Imperial law is consistent with the Marnatine Pandect on Kingly Realms,

• THE DUTY OF MOBILIZATION, in reference to the duty of the kingly realms to mobilize their armed forces, as directed by the Holy Orenian Emperor as commander-in-chief, and his delegates, in the event of a declaration of war subject to the approval of the legislature,

• THE DUTY OF MAINTENANCE, in reference to the duty to maintain, with earnest effort and upon its completion and ratification, the Imperial Constitution and the rightful succession of the throne, using all means possible.

 

Let this be propagated upon the day of our Lord GOD, 20th of TOBIAS’ BOUNTY, 1715.
