Kaelys grunts at the Knights who aren't legally considered Knights in the Holy Kingdom of Oren anymore.

Captain Branaford gets out of his seat, walking to Kaelys calming him down and saying "Alphonz is fine, the rest are still fake."

Lyov Ruthern scratches his beard, and turns to his father. He lowers his voice to a whisper.

"When do we make kill of rebel-leader scum?"

 

 

Decterum Marshal Rahl stands to the right of Lord Ailred, his arms crossed as he observes the room. Nodding slightly to his men stationed by the doors and all throughout the room, he seats himself and leans back in the chair.

"Well Huron, sending men to aid a rebel is the same as going under his command. These men you supposedly sent, are just representatives of yourselves, thus making you still a rebel."

Turns his head to Archbishop Jon, he then gets to his knees.

 

"You are a familiar face to me, I've know in in the past. You are a man of great knowledge of when Godfrey was ruling.

I believe ye' were a Royal Chaplain of the Divine Emperor Godfrey, ye' were also a historian and former Judge. Ye' would know me family's history, I am quite sure ye' would know mine as well, great sir.

I would pray, beg to ye' to represent me, as I cannot defend my case by me self. "

 

He would stare up at him, waiting for his response.

The Archbishop looks at Hourn a bet puzzled and amused he gives the man a sorry look as he sighs, for a moment shaking his head slowly, before standing.

 

"For the love that my brother bore your brother Braxis's I shall." he lowers his head making the double cross as he slowly walks near Huron and stands next to him looking at the judges, he gestures to two of his clerics and whispers something to them they bring out two dusty books  from there satchels placing them on a stool in-front of him, the Archbishop flips threw the first book. His finger traces along the lines of writing in the book, before he looks up towards the Judges.

 

"Your honors I have been asked to represent Ser Huron Sliverblade, in this trial by his own words and threw his own freewill and I accept." before he looks down at the book and reads out loud. 

 

"The Second Book of law, the third chapter, He who cannot Conduct his Cause Himself, must give Written Authority to his Attorney or ask for it in-front of a court of law.

 
If any one is unable to conduct his own cause, or is unwilling to do so, he must appoint a representative, by an instrument in writing, under his own hand, confirmed by the seals and signatures of witnesses or by saying so in-front of a court of law and naming his representative. And if any such representative should be guilty of collusion with his adversary, so that he is defeated, he shall pay to his principal, as much of his own property as the latter has lost, or as much as he ought to have obtained. But it shall not be lawful for a slave to conduct any case whatever, through the commission of another, unless on behalf of his master or mistress, or of the Church, or of some poor person, or under the commission of the royal treasury. If, through either the neglect or misconduct of the judge, or through the perjury of a witness, the provisions of this law should not be carried out, then it shall be the duty of the monarch to enforce the same."
 
He looks up once more, "I swear that I shall represent Ser Huron Silverblade honestly." his hand trails to the other book as he flips it open and goes to page twelve and reads. "Huron Sliverblade a Knight of the Holy Order of the Red Dragon, sworn sword of King Godfrey and later Emperor Godfrey, Baron of Das Boot, Brother to the honored Grand Knight Braxis Sliverblade Count of Das Boot, Brother of Gideon Sliverblade, Cousin to the Honored Duke Niclous Silverblade and Grand Knight Uthor Sliverblade Duke of Furnstock. He is no longer a baron though he is still a Ser by the laws of man and God as his Knighthood was not stripped, so I insist that the judges use the proper address that is Ser even if you believe him a traitor we are civilized people and use proper terms of address even for criminals." He leans on his staff for a little while his breath becoming slower.
 
"Now as this is a court of law, a judge or a plaintiff must list the crimes that where done and explain them as the representative of the defendant I would like that to be read to the court so we may argue them"

The Lord Chancellor stands and straightens the ermine shawl of his office before gesturing for the summons document from the court scribe who stood nearby. Edward then unrolls the scroll and begins to speak,

 

"Ahem,

 

We are gathered in this place of justice to witness and apply the calculated reason of the law. We as a court will endeavour to find the most fair and just response to the supposed crimes of the accused."

 

Edward nods politely to the Archbishop John before continuing, 

 

"As within the olde laws of the land written by his divinity Godfrey, the accused is within his legal right to obtain representation in court. If Ser Silverblade accepts your offer as legal counsel, this will be permitted, as is just."

 

The Chancellor pauses a moment to clear his throat before continuing,

 

"As jurist primus to this court it is my duty to inform the collected court of the accusations against the defendant. 

 

 

I. High Treason - The accused Huron Silverblade I is hereby summoned into court to respond to accusations of high treason against the crown.

 

To clarify, the accused raised levies against the King of Oren, the rightful liege to his oaths by virtue of crown, and against the great state which is Oren. He perpetrated crimes against his fellow countrymen in being complicit with several attacks on the land and people of our great nation.

 

II. Disturbing the peace - The accused Huron Silverblade I is hereby summoned into court to respond to accusations of causing instability in the realm.

 
To clarify, the accused was complicit with and incited violent and rebellious action against the government of Oren without grounds to do so.

 

III. Genocide - The accused Huron Silverblade I is hereby summoned into court to respond to accusations of the attempted genocide of the Orenian people.

To clarify, the accused raised levies which attacked the peaceful citzen-folk of Oren, and the Orenian soldiers who defended them.

 

IV. Attempted usurpation - The accused Huron Silverblade I is hereby summoned into court to respond to accusations of the attempted illegitimate seizure of the crown of Oren.

 
To clarify, the accused raised levies and pledged loyalty to a cause which intended to seat the Tarus dynasty unrightfully on the throne of Oren, and to depose the Carrion Vochna.

 

V. Kidnapping of a Royal - The accused Huron Silverblade I is hereby summoned into court to respond to the accusations of the kidnapping of the former child-King Ostromir II of Oren.

To clarify, the accused was complicit in a plot to kidnap the former King Ostromir II, who was later recovered by the valiant forces of Oren.
 

VI. Collaboration with the Treasonous and Heretical - The accused Huron Silverblade I is hereby summoned into court to respond to the accusations of consorting with treasonous and heretical individuals intent on causing the downfall of the just rule of Oren.

To clarify, the accused was complicit in a plot with dwarven-heretics and de Rosean-heretics to overthrow the just rule of Oren.
 

VII. For illegitimate aims - The accused Huron Silverblade I is hereby summoned into court to respond to accusation of attempting to seat a half-elf heretic on the throne of Oren.

To clarify, the accused pledged his loyalty to a a cause which intended to void the decency of the Orenian throne by seating a half-elf of impure blood on the throne.

John slowly flips a few pages, as his eyes meet the lines in the paper before he looks up turning his head towards Huron speaking quietly they take a moment to speak before John turns to the judges. "Your honor's, Gentlemen and Lady's" he turns to look at the people that are seated then back the Judges. "I shall  speak to each crime stated in order, first the Crime of High Treason." His eyes look down at the book.

"High treason is the crime of disloyalty to one's Crown. Offences constituting high treason include plotting the murder of one's sovereign; committing adultery with the sovereign's consort, with the sovereign's eldest unmarried daughter, or with the wife of the heir to the throne; levying war against one's sovereign and adhering to the sovereign's enemies, giving them aid or comfort; and attempting to undermine the lawfully established line of succession." he says out loud "That is the definition given in our laws of High Treason. Furthermore it is elaborated, First, it is high treason to "compass or imagine the death of our Lord the Monarch, of our Lady his Consort, or of their eldest son and heir." The terms "compass or imagine" indicate the premeditation of a murder; it would not be high treason to accidentally kill the sovereign or any other member of the Royal Family (though someone could be charged with manslaughter or negligent homicide). However it has also been held to include rebelling against or trying to overthrow one's monarch, as experience has shown that this normally involves the monarch's death. The terms of this provision have been held to include only male sovereigns, but also only the spouses of male Sovereigns. It is not sufficient to merely allege that an individual is guilty of high treason because of his thoughts or imaginations; there must be an overt act indicating the plot." he takes a deep breath before he continues.

 

"Ser Huron Sliverblade, has never in his life took it upon his name to swear an Oath to King Heinrik or his predecessor that would mean he does not recognize the legitimacy of there line of succession, Moreover that makes King Heinrik not his Sovereign liege. As he has not sworn fealty to him or his Kingdom or any man under this Kingdom which would make him his de facto overlord. Furthermore Ser Huron Sliverblade has never served the Kingdom of Oren in fact he fought against the Kingdom of Oren in Aeigs, to form the Kingdom of Renatus in its place. Nor does Huron Sliverblade see himself as a citizen of Oren, nor does he associate himself with it he is of old Rentanin noble blood, and a Imperial Noble, as those both do not hold ground. Even if you argue that Renatus was there under Sigumund Carrion, it was not held by a lord he recognized being as he swore oath to House Horen as Kings of Renatus and before them to Tarus of Renatus." his eyes close for a moment, as he leans in on his staff one of his laymen goes and fetches him a glass of water, he sips it slowly before placing it down on the table in-front of him.

 

"I believe I have proved without a shadow of a doubt that Ser Huron Sliverblade should not be charged of High Treason, as a person can not commit treason to a Sovereign he has no obligation or oath too, or if the person is not considered a citizen of that Nation. For that I ask the honorable judges to retract the charge of High Treason, I await your rebuttals and arguments or the dropping of the charge for this first crime before carrying on." 

 

A laymen pulls a seat as John slowly sits down looking at a few documents one of his scribes placed in-front of him.

Edward frowns, takes a sip of water proffered to him by a nearby serving boy, then stands to rebut the Archbishop's arguments,

 

"Yes, yes. Let us see."

 

The Lord Chancellor takes a moment to rifle through a stack of papers on the small dais next to him before speaking once more,

 

"It was suggested by yourself, uncle John, that Ser Huron Silverblade remains a knight of the Kingdom of Oren, was it not? This would imply that his oaths to the Kingdom of Oren as a knight remain legitimate. As we both are familiar, knights hold an oath to the crown. If this is so, his oaths as a knight were intact when he levied men against the crown and allied himself with the known traitorous half-elf, Slade Tarus. This is High Treason.

Further, the throne of Oren was not usurped from the House Horen. It was usurped by Silus Horen with aid from within the privy from his cousin William Horen III. 
The accused held additional oaths as a vassal noble to the House Horen. The Horen claim to the throne was then voluntarily retired by Silus from the House Horen to the House Carrion. There was a legitimate line of succession that was not voided by hostile capture of the crown. A claim otherwise would be flawed, so there would not be solid grounds to suppose that oaths to the Horen crown hold no weight to the Carrion crown, especially when the accused recognized the majesty of the Carrion-held crown, in this piece of evidence from the crown's private records: ((http://www.lordofthecraft.net/topic/99903-the-blood-claim/))

 

The crown also calls upon citizen witness Iorik Edain's testimony to the Lord Marshal, regarding the night of 1st of Deep Cold, 1445 ((The night is documented here: http://www.lordofthecraft.net/topic/100711-the-massacre-of-the-silver-storm/ )) in which the accused Huron Silverblade was witnessed assaulting the Emperor and his men, an act of High Treason.

It is clear that the accused both held valid oaths, and committed legitimate and treasonous acts without having been released from these oaths. This is High Treason."

"No I did not suggest he was a Knight of Oren." he looks to the scribe of the Court and says "Read from your manuscript what I said." the Scribe nodes and says "Archbishop John: Huron Sliverblade a Knight of the Holy Order of the Red Dragon" John nods. "And your Honor there is was no such thing as the Kingdom of Oren, that is something you young-lings made up, against everything that the old ones stood for, The Kingdom Of Oren was to stay buried a stain in human history that name should have stayed dead back in Aegis." 

 

Tilts his head "And no I am unfamiliar that Knights must hold a oath to the Crown, that is the first I hear of such a thing, Ser is a title granted by the Crown, if the Knight then joins a order in service to the Crown he holds a oath but Knights can server lords or become hedge Knights. If you are saying Knights have Oaths to the Crown Does that mean the current head of the Elfs has a oath to the Crown? Darius is a Knight, not any Knight but a decorated one a former Knight Commander of the lions and of the Dragon guard. Knights are Knights for life but it can be stripped from them, but they are not bound to the Crown. Even then every time a new King or Emperor sits the throne all oaths, must be renewed, as a oath is taken to a ruler not his family. 

 

"And Silius Horen did not usurp it from William, William was attacked by Owyn Carrion the so called High Pontiff made King and William surrendered the Crown. Even so that has nothing to do with it, oaths do not carry on from crown to crown. But I shall play along for amusements sake Silius Horen was not next in line Sophia was as Silius Horen is the nephew of Godfrey while Sophia is his daughter.

 

Saying that he held vassal oaths to House Horen is amusing, he held a oath long dead in Auslon to Emperor Godfrey, he did not even swear oath to Horen V, as I already said oaths do not carry on to a heir, they are required to be renewed"
