    WHEREAS, the so-called ”Nottingham Company” has a history of disturbing the peace, destroying the public order, banditry, extortion, bribery, and other criminal mischief and violations.

     

    WHEREAS, the so-called ”Nottingham Company” was declared a terrorist organization, dissolved, and banished from the Imperial State by our predecessors.

     

    WHEREAS, it is the duty of the Secretary of State for the Interior “to manage policing, law enforcement and the safekeeping of the Emperor’s peace within the Crown’s direct dominions.” (ORC 601.064)

     

    BE IT ENACTED, that the so-called ”Nottingham Company” is reaffirmed as a terrorist organisation, dissolved, and banished from the Crown’s direct dominions, with concurrence from the Crown of Haense.

     

    BE IT ENACTED, that active membership of, as well as counsel and aid to, the so-called ”Nottingham Company” shall be considered an an act of treason (see ORC 204.01), punishable with death by hanging.

    EDICT OF SUCCESSION

     


     

    1st of Tobias’ Bounty, 1759

     

    Whereas in it is the desire of His Imperial Majesty to at last settle the succession of the throne upon his rightful heirs. For this purpose, His Imperial Majesty has enacted the Edict of Succession of 1759. 

     

    With the birth of a healthy son to the union of the Princess Imperial and the Duke of Helena, let all doubt as to the rightful line of succession be dispelled. The Princess Imperial shall be confirmed by law as His Imperial Majesty’s heir of the body. The Duke of Helena, as befits the station of His Imperial Majesty’s son-by-law, shall hence be afforded the full privileges of a member of the Imperial household. 

     

    PROVISION I: On the succession

     

    1. That Her Imperial Highness the Princess Imperial, in accordance with all laws of natural primogeniture and inheritance, is affirmed in all ways as His Imperial Majesty’s heir and successor.
    2. That the succession of the throne of the Holy Orenian Empire, and all its dominions and subsidiaries, be due to HIH The Princess Imperial as regnant Holy Orenian Empress, and from thereafter, her legitimate descendants.
    3. That the succession of the throne be henceforth confined to HIH The Princess Imperial’s legitimate descendants under the basis of a system of male-preference primogeniture, failing that, to HIH Princess Lorena and her legitimate descendants, also under the basis of a system of male-preference primogeniture.  
    4. That the terms of succession enacted by this first provision of this decree be rendered null should His Imperial Majesty Peter III thereafter this resolution produce a legitimate male heir of the body. 

     

    PROVISION II: On the House of Novellen

     

    1. That the descendants of the union of HIH The Princess Imperial and Joseph Clement de Sarkozy are known as the House of Novellen, in reference to Novellen Palace. 
    2. That the arms for the House of Novellen are established as the Eye of Providence atop the Aurelian cross quartered with the crowned white eagle of the House de Sarkozy. 

     

    PROVISION III: On stylings

That thereafter the proclamation of this decree, by virtue of his marital union to HIH The Princess Imperial, Joseph Clement de Sarkozy be entitled to the style of Prince of the Holy Orenian Empire and the styling of His Imperial Highness, and that he be extended all such privileges of a member of the Imperial family, and that his rank as Duke of Helena be affirmed for all time.
    2. That, in the event of the succession of HIH The Princess Imperial to the throne of the Holy Orenian Empire as Holy Orenian Empress, her husband HIH The Duke of Helena shall be styled Holy Orenian Emperor by virtue of the principle of jure uxoris, and that these arrangements designate them co-rulers.

    The IMPERIAL ASSOCIATION OF SAINT PONTIFF EVERARD IV, or the ASSOCIATION OF SOLICITORS, HISTORIANS, AND PHILOSOPHERS, is the governing body of lawyers, educators, and authors throughout the Holy Orenian Empire, given responsibility in certifying solicitors, attorneys, and professors of history and law. All members of the association are recognized by the traditional ‘SSE’ after their names, a relic of the ancient Society of Saint Everard from which the association claims descent from.     The educated daily reader of our nation’s papers may with some regret recount what vitriol has occupied the headlines as of late, chief among these being T-- H----- O- ELE------, published by T-- YOU-- CAN------ O- OR-- FOUN------. Any good constitutionalist revolts from the libelous accusations made of our Senators, our Constitution, and our Crown made therein.

     

    It is the opinion of your humble writer that these accusations come chief most from a lack of education. While to a zealous youth it should come with ease to make use of such pejoratives as HERESY, BUREAUCRAT, or “IBLEESIAN,” age is the greatest teacher. A conservative prudence may be deployed, with great care placed towards sober treatment of the Constitution. These virtues are best found in the middle aged man.

     

    This paper, to be published serially, endeavors a scientific study of the Constitution of Oren. A particular interest shall be placed in the LEGISLATURE, known colloquially as the Senate.

     

    As an aid to the faithful reader, citations have been provided where necessary to identify relevant documents.

     


     

    In the year of our Lord God 1731, the great houses of the realm elected to establish Adrian de Sarkozy as their Lord Protector. The abnormal death and later scandal surrounding Alexander I’s lineage prompted the convention; the Lord-Regent Duke Sunholdt KCHE (then John d’Balain) confirmed this election, and thus our country was placed under Interregnum. In the PROCLAMATION OF IMPERIAL INTERREGNUM, signed by all the great houses of the realm, the powers of the Lord-Regent were transferred to the Lord Protector, and thus the Crown prerogative.

     

    It is the opinion of some that the Edict of Establishment apparently loses its legitimacy because it was promulgated by a LORD PROTECTOR, and not an EMPEROR. Using our knowledge of the history just recounted, we may dismiss this falsehood with ease. While Adrian de Sarkozy did not wear a crown, he held in his power the Crown prerogative granted him by his office, and thus the right to promulgate edicts of law holding mandate over the Empire.

     

    We may find additional transcripts, treaties, and other Constitutional edicts promulgated by the Lord Protector. Curiously the legitimacy of these are not attacked by some in the papers.

     

    Is the Senate a self-sustaining institution, existing of its own will? Secondly, can the Senate pass acts of legislation without the assent (and thus willful promulgation) of the Crown? Thirdly, can the Senate appoint Councilors of State, and Justices of the Courts?

     

    If the answer to any of these questions is NO, then the accusations of some fall apart.

     

    According to the Edict of Establishment, the Imperial Senate “shall sit in perpetuity, until such time as its prorogation by the Crown.” This cycle of convention and prorogation are known as SESSIONS. The basic rules of philosophy would teach us that no being which exists only by the will of a higher being has self-sustaining being of its own. Therefore, we answer no. The Senate is a body which exists for and by the Crown’s own will.

     

    Secondly, some would believe that acts of legislation are passed and promulgated by the Senate alone. They identify acts which provide elves the rights of an Imperial citizen, and acts which provide rights to certain intelligent non-persons as evidence to this.

     

    The Edict of Establishment would prove this accusation as plainly untrue. The Crown “as the final actor in the Imperial Diet and the executive, formally approves bills that have passed through their respective chambers in a process known as imperial assent.” It is the prerogative of the Crown to provide assent or to withhold assent from any bill which it pleases. When granted assent “a bill becomes an act of law.” We may thus conclude that any Act of the Senate is not promulgated by the Senate of its lonesome, but instead by the mandate of the Crown. To the dismay of some this includes the granting of certain rights to the Anurian species. . .

     

    Thirdly, the papers have claimed that the Senate has the power to appoint Councilors of State and Justices of the Court without mandate. In our Constitution, who has the power of appointment and nomination?

     

    We may look to the Edict of Establishment and to the Judiciary Act 1740 for the answer.

     

    Firstly, the process for appointment of Councilors of State is detailed twice within the Edict of Establishment.

     

    “The Crown appoints both the Archchancellor and the Vice Chancellor unilaterally, as part of the Imperial prerogative, and these offices serve as the chiefs of the executive Council of State. To appoint the other members of the Council of State (i.e the respective secretaries who head their departments) the Archchancellor and Vice Chancellor give their formal and written advice for candidates to the Crown, who then sends these candidates to the Senate to fulfil their advice and consent role through a Writ of Confirmation, mentioned below.”

     

    Additionally, the definition of aforementioned Writ of Confirmation:

     

    “Writs of Confirmation, concerning the confirmation by the Senate of the Crown’s appointments on the Council of State or the Supreme Court, in conjunction with their role as a body to provide advice and consent for these appointments.”

     

    Nowhere in either of these two passages is it implied that the Imperial Senate may of its own accord appoint Councilors of State. Indeed, the prerogative of appointment lies entirely with the Crown, acting on the advice of the chiefs of the Council of State itself. The Senate’s relationship here to the Crown is one of advice and consent: as the Crown’s own deliberative legislature, it approves and denies appointments chosen by the Crown’s COUNCIL OF STATE. It is their responsibility, ordained by the Crown itself, to do so.

     

    Next remains the nomination of justices. The Judiciary Act 1740 defines nomination as such: “The justices of the Circuit Courts, both Western and Eastern, act with the delegated power of the Crown and are thus selected by it with the consultation of the government of each vassal province as well as the advice and consent of the Imperial Senate.” The Crown retains the prerogative of nomination to the Judiciary. These nominees are then given advice and consent by the Senate. To deny the mandate of these justices is thus to defy the Crown itself, may God forbid!

     

    As to the purposes of these justices who some would defy, we need look only to the words of Sir Veikko Harjalainen KM: “In cases of law, there will always stand two parties - those who insists upon the violation of the Emperor’s law, and the other who vehemently denies it. A sovereign would always judge as guilty those he accuses. It is therefore a necessity then that there should be a third person to decide this contest; a judge, or magistrate.” This passage is enshrined in Section I of Judiciary Act 1740, assented to and promulgated by His Imperial Majesty himself.

     

    It is the opinion of the writer that these claims have been given sufficient treatment and explosion. The Constitution remains unscathed. In the next serial edition of this paper, we shall endeavor to treat loftier ideas: Providence and Government.

    The Ministry of the Interior is an administrative department formed below the Council of State, charged with the duties of managing the lands of the Crown as well as all public lands. The head of the department is the Secretary of State for the Interior, often shortened to the Secretary of the Interior, who sits as one of the Great Ministers of the Imperial Cabinet.

     

    The Ministry is divided into two sub-departments, these being the Home Office and the Municipalities Office. These will be described in further detail further within this gazette.

     

    As one of the preeminent Ministries of the Crown, there are several permanent positions beneath the charge of the Secretary of the Interior, these being mandated either by Acts of the Senate or by Executive Order. Due to this fact, staffing for the Ministry is always in high demand, and the probability of promotion is high.

     


     

    THE DUTIES OF THE MINISTRY OF THE INTERIOR

    Prescribed by the Council of State Establishment Edict 1732, hereafter are the responsibilities of the Ministry.

     

    • The duty to manage the lands of the Crown as well as all public lands, as both the representative of the government and highest administrator.
    • The duty to commission and administer the construction of all public works, including infrastructure projects.
    • The duty to oversee housing and property within the Crown’s dominions, including the capital city.
    • The duty to manage policing, law enforcement and the safekeeping of the Emperor’s peace within the Crown’s direct dominions. 
    • The duty to oversee Imperial cities and all other direct dominions. 
    • The duty to administer the Imperial Everardine College, as honorary chancellor. 
    • The power to act with the Crown’s commission in the capital city, and to direct its governance in conjunction with the requisite elected bodies, which remain subservient to him. 
    • The power to contract architects, labourers and other aides in the completion of infrastructure projects. 
    • The power to temporarily manage the property of a deceased, absentee, or unworthy landowner without lawful heir, until the Council of State should choose to reappropriate this property.
    • The power to staff his office, the Ministry of the Interior, in such a way as to provide assistance in his duties.

    The Secretary of the Interior heads the Ministry, holding sole executive power of its staffing and operation. He sets the policies which the Ministry shall thereafter follow, and organizes greater departmental initiatives, which may include providing direction for the lesser permanent offices beneath his charge. He is appointed by the prerogative of the Archchancellor, with confirmation by the Imperial Senate.

     

    Every duty of the Secretary is outlined within the Council of State Establishment Edict 1732, which has been written above. Given the number of these duties, the expansive responsibilities entailed, and the vastness of the lands being the direct dominion of the Crown, staffing of his office with competent bureaucrats is one of his most important roles. No Secretary of the Interior operates alone – this much would require the ability of saints, such as Publius Bracchus.

    THE UNDERSECRETARY OF STATE FOR THE INTERIOR

     

    The Undersecretary of State for the Interior serves as the Secretary of the Interior’s chief lieutenant. He is charged with overseeing the day-to-day operations of the department. He is delegated all the responsibilities of the Secretary himself, and serves at his pleasure. 

     

    In the case of incapacitation of the Secretary of the Interior, the Undersecretary shall assume headship of the entire department, holding interim power until the Council of State should appoint a new Secretary and the Senate confirm him.

    THE HOME OFFICE

     

    The Home Office is one of the two sub-departments of the Ministry. This office primarily carries a more expansive role than its sister sub-department. Its duties are wide in scope, ranging from medical practice to assistance in administration of the Crownlands of Curon and Kaedrin. Most activities of these positions are handled outside of the Imperial City of Helena.

     

    IMPERIAL PRACTITIONER-GENERAL

     

    The Imperial Practitioner-General, known by the shorthand Practitioner-General, is a permanent public servant within the Home Office, established by the Medical Validation Act 1738. He is charged with the oversight, regulation, and research of matters of a medical nature within the Empire. The Practitioner-General is charged with the auditing and accreditation of clinics, apothecaries, and hospitals. He may staff his office, which is self-funded, at his pleasure.

     

    As per the Napier-Rutledge Act 1751, the Practitioner-General has the additional responsibility of suggesting a Surgeon-Sergeant of the Senate to the President Pro Tempore when called upon.

     

    Hereafter are the duties prescribed to the Imperial Practitioner-General by the Medical Validation Act 1738:

    • The Imperial Practitioner-General is responsible for the research and advancement of medicine; whether it be the refining of medicine, developing a new treatment, perfecting medical procedures, etcetera.
    • The Imperial Practitioner-General is responsible for the unbiased authorization of safe and authentic clinics or medical shops.  Applicants must pay 50 minae to the office to apply for each attempt authorization; if the application is authorized and then later found to be committing fraudulent medical practices, then they will be punished accordingly.
    • The Imperial Practitioner-General is responsible for the standardization and control of controlled or addictive substances, i.e night sap, king’s ivy, opium, shadeleaf, etcetera.

    SECRETARIAT OF THE IMPERIAL OFFICE OF EMPLOYMENT OPPORTUNITIES

     

    The Secretariat of the Imperial Office of Employment Opportunities, known shorthand as the Employment Secretariat, is the second permanent public servant within the Home Office, established by the Imperial Employment Opportunities Act 1743. He holds responsibility for the Imperial Employment Registry, a bi-annual gazette advertising employment opportunities throughout the four provinces of the Empire. To this end, the Employment Secretariat will often be in contact with provincial stewardry. 

     

    The Employment Secretariat has the additional responsibility of receiving prayers for employment from the less fortunate, and assigning them to employment where necessary.

     

    Hereafter are the duties prescribed to the Secretariat of the Imperial Office of Employment Opportunities by the Imperial Employment Opportunities Act 1743:

    • The Imperial Employment Registry shall be established to list all job postings and opportunities of work throughout the entire Holy Orenian Empire.
    • The stewards of the several provinces and in the Crownlands shall submit a list of employment opportunities available in their respective lands. The stewards are to update any changes in the job availabilities and must notify the Department of Internal Affairs between every two saint’s week and no less than one saint’s month. 
    • The Imperial Employment Registry must list all of the following articles of information to be published: Title of job, location, name of employer, wage ranges, and duration of the labor. 
    • The job listing must designate if it is from a provincial-state institution or a privately contracted employment.
    • The Imperial Employment Registry shall be regulated by the Department of Internal Affairs. The aforementioned entity shall establish and supervise a secretariat to scrutinize on the organization of the registry to be called The Imperial Office of Employment Opportunities.
    • The following are prohibited from being posted to the Imperial Registry of Employment: Forms of slavery, promiscuous and deviant labor, bounties for capture/execution, labor and industries not within the Holy Orenian Empire that do not have writs of permit 
    • The Imperial Office of Employment Opportunities shall have final discretion on the approval or denial of job posting petitions. However, appeals to their decisions may be made to the Imperial Senate with the sponsorship of two senators.
